Community Development staff have approved Land Use Permit Application (File# LUP-2022-093)
pursuant to Riverway Overlay District provisions 1736 F.a.1, 2 and 4, to construct a new home, detach
garage, driveway, rain gardens, and landscaping including minor grading to finalize the site, within
the Riverway Overlay District. Note the following findings of fact and background information
pertaining to this approval.
1. The St. Croix County Board of Adjustment approved a Conditional Use Permit (CUP-2019-014) for
Filing and grading 10,000 square feet or more outside of the slope preservation zone as per
Section 17.36 F.3.a.6., of the St. Croix County Zoning Ordinance, St. Croix Riverway District.
Additionally, the Board also approved Conditional Use Permit (CUP-2019-015) to construct a
stairway pursuant to 17.36 H.12.a., of the St. Croix County Zoning Ordinance, St. Croix Riverway
District,
2. Community Development staff approved Land Use Permit (File# LUP-2019-027) to fill and grade
within the Flood Fringe and construction of a stairway for Riverway access pursuant to Section
17.40 of the Floodplain Overlay District.
3. Land Use Permit Application (LUP-2021-005) proposing to further modify the proposed home site
was originally submitted to the County on 1-12-2021. Throughout 2021 various additional
information was required by CDD Staff and negotiations took place with the property owners,
prospective buyers, and consultants.
4. Community Development staff approved Land Use Permit (File#: LUP-2021-005) to allow
construction of a home, driveway, stormwater related improvements and landscaping.

5. A revised Land Use Permit Application form and supporting plans and specifications for LUP-
2022-093 and supporting materials including a stormwater management plan was submitted to
the County by new owners, Mark and Lisa Swelland on 11-22-2022.
6. Revisions to project plans, an additional stormwater Drainage Agreement and additional written
responses to questions raised by Community Development Staff and the County's Consultant,
Stantec, were submitted to the County on 112412023,
7. Following further review by Community Development Staff and Stantec, it has been determined
that proposed alternations to the subject property comply with applicable Riverway Overlay
District regulations and Floodplain regulations.
Based on these findings, approval of the Land Use Permit is subject to the following conditions:
1. Proposed improvements shall be completed in conformance with plans and specifications
prepared by Sonnentag Consulting, LLC, referenced as *Amendment to Previous LUP #2021-005
. Swelland Property -Land Use Permit Construction in Riverway and Floodplain District (revised
1/17/2023 and with the Erosion Control and Stormwater Management Plan prepared by SEH
(revised 1/13/2023).
2. Apre-construction inspection is required to verify structure placement, discuss the project
timeline and to verify that erosion and sediment control is installed. It is the applicant's
responsibility to schedule this appointment, please contact Jake Dale, Land Use Technician II at
(715) 386-4684 orjake.dale@sccwi.gov to schedule this inspection.
3. The proposed grading and construction activity shall not extend beyond the limits indicated on
the site plans and shall be limited to Lot 7.
4. Materials that are buoyant, flammable, explosive, or injurious to property, water quality or human,
animal, plant, fish, or aquatic life shall be stored at or above the flood protection elevation or
flood proofed in compliance with Subsection 17.40D.5. Adequate Measures shall be taken to
ensure that such materials will not enter the water body during flooding.
5. No material may be deposited that is classified as a solid or hazardous waste material and must
be protected against erosion, by erosion matt, vegetative cover, sheet piling or bulkheading.
6. It is the applicant's responsibility to secure any other required local, state, or federal permits) and
approvals) prior to land disturbance activity.
7. Stormwater management practices will be placed as identified on the approved plans. Grading,
rain gutters, downspouts will be installed to direct stormwater to constructed rain garden(s).
8. The supplemental Stormwater Management Agreement (Operation and Maintenance) intended
to pertain to the final individual stormwater management of Lot 7, shall be filed with the St. Croix
County Register of Deed Office prior to the post construction inspection.

9. St. Croix County reserves the right to require additional sediment and erosion control measures
to be installed if found necessary due to site -specific concerns.
10. Upon completion, the property owner shall submit a "vegetation management plan" for the new
plantings. This plan shall include "as -built" conditions and details regarding watering, weeding,
pruning, etc. The maintenance period shall be a minimum of 24 months after installation
11. All temporary erosion control measures shall be left in place and maintained until the site has
reached a point of at least 70% permanent vegetation. Permanent vegetation shall be
established once final grade is reached or as soon as applicable per plan.
12. Apost-construction inspection is required to close out the permit. It is the applicant's
responsibility to schedule this appointment, please contact Jake Dale, Land Use Technician II, at
(715) 386-4684 orjake.dale@sccwi.gov to schedule.
13. Failure to comply with the terms or conditions above may result in the revocation of this permit
by the Zoning Administrator according to Chapter 17.
This approval is subject to the conditions listed above; it does not allow for any additional
construction, structures, or buildings beyond the limits of this request. Your information will remain
on file at the St. Croix County Community Development Department suite. It is your responsibility
to ensure compliance with any other local, state, or federal permitting or regulations, including
contacting the Town of Troy to inquire if additional permissions are required.
This permit is valid for one year, with the possibility of up to two (2) six-month extensions if the
applicant submits the appropriate permit extension fee and documentation to the Zoning
Administrator. A copy of the Land Use Permit placard should be submitted to the local Building
Inspector for the town upon application for the building permit. The orange placard must be posted
on thejobsite and visible from public view.
