The request has been conditionally approved based on the application submission and the following findings: • The conditionally permitted structures are proposed in the Town of Somerset, within a Shoreland Overlay District. • Proposed land disturbance is within 300 ft of the ordinary high-water mark (OHWM) of a navigable unnamed pond. • All parts of the structures meet the 75-foot setback to the OHWM. The setback shall be measured to the closest point of the structure pursuant to Ch.16.315.1.a. • There will be no disturbance greater than 10,000 Square -feet of slope between 12-19.99%. • There will be no disturbance of slopes greater than 20%, measured horizontally over 50 feet. • The proposed driveway meets the standards in Section 15.405. • The total impervious surface calculation within 300 feet of the OHWM is 3.9%, therefore mitigation is not required pursuant to Ch.16.350.1. • The proposed structures meet all setbacks and maximum height requirements. • The Erosion Control plan meets or exceeds the WDNR Technical Standards for Erosion and Sediment Control. • Sanitary permit has been approved on November 15, 2022. Based on these findings, approval of the Land Use Permit is subject to the following conditions: 1. Prior to Construction, erosion control measures, must be installed prior to any land disturbance activity. 2. A pre -construction inspection is required to validate setbacks and verify the installation of erosion and sediment control. Please call me at (715) 386-4683 to schedule this inspection and ensure the site is staked prior to the inspection. 3. The following must be staked prior to the pre -construction inspection: a. St. Croix County reserves the right to require additional sediment and erosion control measures to be installed if found necessary due to site -specific concerns and will be documented in an as -built site plan. 5. Distrubed ground shall follow the Ersosion Control Plan for stabilization during and after construction. 6. Removal of vegetation within 35 ft of the OHWM shall comply with Section 16.340. 7. All temporary erosion control measures shall be left in place and maintained until the site has reached a point of at least 70% permanent vegetation. Permanent vegetation shall be established once final grade is reached or as soon as applicable per plan. 8. Apost-construction inspection is required prior to removing the temporary sediment and erosion control measures to verify proper vegetation cover has been established. Please call me at (715) 386-4683, to schedule this inspection 9. The Department of Natural Resources shall be contacted for a NR 216 permit if land disturbance equals one acre or greater in size. 10. It is the applicant's responsibility to secure any other required local, state or federal permits) and approvals) prior to land disturbance activity. 11. Failure to comply with the terms or conditions above may result in the revocation of this permit by the Zoning Administrator pursuant to Chapter 15.770.1. This approval is subject to the conditions listed above; it does not allow for any additional construction, structures, or buildings beyond the limits of this request. Your information will remain on file at the St. Croix County Community Development Department suite. It is your responsibility to ensure compliance with any other local, state, or federal permitting or regulations, including contacting the Town of Somerset and the Department of Natural Resources to inquire if additional permissions are required. This permit is valid for one year, with the possibility of up to two (2) six- month extensions if the applicant submits the appropriate permit extension fee and documentation to the Zoning Administrator. A copy of the Land Use Permit placard should be submitted to the town's local Building Inspector upon applying for town building permit(s). The orange placard must be posted on thejobsite and visible from public view.
