ST. CROIX HEALTH CARE CENTER EMPLOYEES

DATED JANUARY 1, 1978.
BE IT RESOLVED by the County Board of the County of St. Croix as follows:
Section 1. That the revised Agreement between the Personnel Committee
of the County of St. Croix and S. Croix County Health Care Center Employees
Local 576-A, AFSCME, for the year January 1, 1978 through December 31, 1978,
is hereby adopted;

That a copy of the 19W.*X Agreement and the amendments thereto are
attached hereto as Exhibit A and incorporated herein by reference as though
fully set forth herein.
Section 2® That all resolutions or parts of resolutions contravening the
provisions of t is Resolution are hereby repealed.
Section 3. That if any part or parts of this Resolution are invalid, it
shall not invalidate the entire Resolution.
Section -4. That this Resolution shall take effect and be in force from
and after its passage and publication, and all wages and benefits shall be paid
in accordance with said Agreement from January 1, 1978.
This Resolution was introduced at a regular meeting of the County Board
of the County of St. Croix, held this 22nd day of February, 1978.

1978 COLLECTIVE BARGAINING AGREEMENT
ST. CROIX HEALTH CENTER
A. 1.01, Bargaining Unit: Revise to read as follows:
"All regular full-time and regular part-time employees of the
St. Croix Health Center, excluding the Superintendent,
Assistant Superintendent, professional, supervisory, co
dential and temporary employees and all other employees of
St. Croix County.'
B. 1.02, Management Rights: Revise as follows:
"The County possesses the sole right to operate County gover
ment and all management rights repose in its, subject only
the provisions of this contract and applicable law. These
rights include, but are not limited to, the following: I
A. To direct all operations of County government.
B. To establish reasonable work rules.
C. To hire, promote, schedule and assign work.
D. To suspend, discharge and take other disciplinary action
against employees for just cause.
E. To relieve employees from their duties because of lack of
work or lack of funds.
F. To maintain efficiency of County operations.
G. To take action which is necessary to comply with state or
federal law.
H. To introduce new or improved methods or facilities, or
change existing methods or facilities.

I. To determine the kinds and amounts of services to be per-
formed as pertains to County government operation and the
number and kinds o-f positions and job classifications to
perform such services.
J. To contract out for goods or services, provided such
actions shall not result in the layoff of bargaining unit
personnel.
K. To determine the methods, means and personnel by which
County operations are to be conducted.
L. To take action which is necessary to carry out the func-
tions of County government in situations of emergency."
C. 1.03, Fair Share Agreement: Add the followini
"Dama2es and Costs: In the event the provisions of this fair
share agreement are successfully challenged in a court or an
administrative body, and it is determined that the Employer
must pay such sums as have been deducted from earnings in
accordance with the provisions hereof, the collective bargain-
ing representative agrees to indemnify the Employer in full
for all sums which the Employer has been determined to be
liable."
A. 2.02, Step 1: Revise as follows:
"The grievant, with a Union Steward, s,hall take up the
grievance or dispute with the employee's immediate supervis
within ten (10) calendar days after the occurrence grieved
could have reasonably been known. In the event of a
grievance, the employee shall perform his assigned work tas]
and grieve his complaint later, unless the work order in
question represents an unreasonable threat to the safety or
fie-alth of the employee. The supervisor shall respond in
writing to the Steward and the grievant within five (5)
calendar days. I
B. 2.03, Step 2: Revise as follows:
"If the grievance has not been settled it may be presented
in writing by the grievant and the Union representative to
the Superintendent or hisdesignate. Any grievance not
submitted to the Super!-ntendent or his designate in writing
within ten (10) ' calendar days after receipt of the immediate
supervisor's response shall be orfeited. The
designated representative of the Unio,r,., the grievant, and
the Superintendent shall meet as soon as practical to discuss
the grievance. The Superintendent shall answer the grievance
in writing within ten (10) calendar days following the meeting.

C. 2.04, Arbitration: Revise as follows:
"Any grievance which cannot be settled through the above
procedure may be submitted to final and binding arbitration
by notifying the Superintendent or his designate in writint
within ten (10) calendar days after receipt of the Super-
intendent's decision that they intend to process the
grievance to arbitration as follows: The Union shall
request the Wisconsin Employment Relations Commission to
appoint one of its staff members as sole arbiter. If
either party is dissatisfied with the appointment made by
the WERC, said party shall request the Federal Mediation
and Conciliation Service to submit a list of five (5)
arbitrators. The parties shall alternately strike names
until one remains. The first party to strike shall be
determined by lot. The parties may attempt to agree upon
a neutral arbitrator."
A. 4.02, Probation Period: Revise as follows:

"The County retains the sole right to determine the qualifi-
cations for each classification; such qualifications shall
be uniformly applied and commensurate with the duties of
the position in question."

C. 4.06, Job Posting: Revise the second sentence as follows:
"Such posting shall state the job to be filled, the date the
job is to be filled, qualifications for the job, the
applicable shift and rate of pay."
D. 4.07, Filling of Vacancies: Revise as follows:
"Vacancies shall be awarded to the most senior applicant
providing qualifications to perform in accordance with the
Employer's standards for the position are met. The County
retains the sole right to determine qualifications for eac
classification; such qualifications shall be uniformly
applied and commensurate with the duties of the position i
question. Employees completing the trial period shall be
considered as having qualified. If no bidders for the I
vacancy are qualified, the Employer may hire a new qualifi
employee for the vacancy." I
E. 4.08, Retrocession: Revise as follows:
ployees not able to satisfactorily perform the work of an
awarded position shall be returned b the County to the
position formerly held. If the successful applicant is not
satisfied with the new position, he/she may return to the
position formerly held within five (5) days."
A. 5.03 Add the following paragraph (d):
"(d) On -Call Pay: Maintenance personnel are to receive Ten
Dollars ($10.00) per night they are required to be on
call at the St. Croix Health Center."
(Formerly $5.00 per night.)

A. 6.02, Pledge Against Discrimination: Delete entire Article.
VI. ARTICLE 8 DURATION AND EXECUTION
A. 8.01, Duration: Revise as follows:
"This Agreement shall be binding and in full force and effect
from January 1, 1978 through December 31, 1978."
VII, APPENDIX A - TOTAL COMPENSATION
A. 9.01, Wages:
1. Hourly Employees: Increase rates Twenty -Eight Cents (28t)
per hour.
2. Monthly Employees: Increase by 6.625 percent over 1977
wage rates.

C. Realign the rates paid Licensed Practical Nurses at the St.
Croix Health Center: Thirty -Five Cents (35() per hour at all
steps. (County proposal as a result of difficulty in finding
and retaining Licensed Practical Nurses at rates formerly paid.)
D. 9.01' (formerly Room and Board): Retitle Special Consideration,
renumber as 9.02, and redraft as follows:
"Employees Voluntarily residing at the St. Croix Health Center
for their own benefit shall be required to pay for their room
and board. One (1) meal per working shift shall be furnished
to employees of the Health Center, to be taken at a point half
way between the start and finish of the shift.
By mutual agreement of the Employer and the Union, the
Employer may employ individuals with physical and/or mental
limitations, which limit their ability of performing the
normal .duties regularly expected of other employees
similarly classified, at a rate of compensation less than
provided by this Agreement. Such mutual agreement shall
occur pursuant to negotiation on such individuals and
further providinq that the total number of such employees
shall not exceed five (5) at any one time.
The Employer shall be permitted to pay farm employees in
excess of the negotiated salary scale. The Employer, when
hiring new employees, may give credit for outside
experience."
E. 9.02: Entitle Work in a Higher Classification, renumber as
9.03, and add the following:
"The parties agree that no more than three (3) collecti
bargaining unit employees at any one time shall be
employed at two different classifications on a regular
basis." I
VIII. 12.01: (a) Health Insurance: Revise as follows:
"Effective January 1, 1978, the Employer agrees to pay up to
Sixty Dollars ($60.00).per month toward the applicable premium."
IX. 13.01, Vacations:

"Employees are not to be permitted to use earned vacati
until the conclusion of their probationary period." i
"One and one-fourth Cl 1/4) days per month for all employees
having eight (8) or more years of service."
(Formerly 10 or more years of service.)

X . 14.01 , Hol i day:
"The following days shall be recognized and observed as paid
holidays: New Year's Day, Easter Sunday, Memorial Day,
Independence Day, Labor Day, Thanksgiving Day, Friday foliotti,in
Thanksqivinq, Christmas Day."
XI. 15.03, Payment for Accumulated Sick Leave:
"Effective January 1, 1977, employees shall receive one-half
(1/2) of their unused accumulated sick leave in cash upon
retirement at age sixty-two (62)."
(Formerly to be paid out upon retirement at age 65.)

Driver on their own time and at no County cost will receive a
certificate indicating that they have successfully completed the
Red Cross First Aid Course ;Then the course becomes available Li
