WHEREAS, the Wisconsin Legislature recently passed a new Public
Records Law, Wisconsin Statutes Section 19.21 et seq., which law mandates
that counties provide access to public records in each public office, and
WHEREAS, said law further requires custodians of such public records
to make or receive a copy of any public record, and
WHEREAS, counties may impose fees upon a requester of a copy of a
public record for the actual, necessary, and direct cost of reproduction
and transcription of the public record, unless a fee is otherwise specifi-
cally established or authorized to be established by law, and
WHEREAS, the District Attorney's Office and the County Board Office
have done a study concerning the actual, necessary, and direct expenses to
various county departments for reproducing and transcribing public records
within those offices, and
WHEREAS, such study has found that the actual, necessary, and direct
cost of reproducing and transcribing public records within the various
departments of St. Croix County closely average approximately $1.00 for
the first copy and $ .10 per copy for additional copies of the same public
record, and
WHEREAS, the Finance, Budget, Building and Bond Committee has made
and has also considered this topic, and has recommended that a uniform
fee be established for each county department or office for the cost of
reproducing and transcribing public records within all departments or
offices,
NOW THEREFORE, BE IT RESOLVED by the St. Croix County Board of Super-
visors, meeting in regular session, that all county departments and county
offices shall, effective immediately, charge a fee upon a requester of a
copy of a public record within such department or office of $ .95, plus
Wisconsin sales tax of 5%, totalling $1.00 for the first copy of a particular
public record, and a fee of $ .10 per copy, including Wisconsin sales tax,
for each additional copy of that particular public record.
BE IT FURTHER RESOLVED that all county departments or county offices
are authorized to post such fees in prominent places within such department
or office and shall further follow the requirements of Wisconsin Statutes
Section 19.21 et seq. in all other_ respects.
BE IT FURTHER RESOLVED that those departments or offices within
St. Croix County which impose fees for reproducing or transcribing public
records shall continue to impose such fees according to existing law.
BE IT FURTHER RESOLVED that all fees collected by any deparment
or office within St. Croix County, pursuant to this resolution, shall be
periodically delivered to the County Treasurer for inclusion in the General
Fund.
