HomeMy WebLinkAboutResolution 1983 (24)RESOLUTION RECOMMENDING REVIEW OF WISCONSIN STATUTE CONCERNING PROTECTIVE OCCUPATION PARTICIPANTS. Resolution #��� WHEREAS, Wisconsin Statutes Section 40.23, entitled "Retirement Annuities" contains provisions for protective occupation participants (includes all active law enforcement officers); and WHEREAS, said Section 40.23 presently enables protective occupation participants to retire from age 50 on; and WHEREAS, said Section 40.23 further provides for a monthly annuity to the pro- tective occupation participants, which monthly annuity is presently determined by multiplying the participant's final average earnings by the participant's creditable service and by using the applicable percentage of 1.8% (as a protective occupation participant) ; and WHEREAS, presently general employees of St. Croix County are eligible for monthly annuities based on the same formula as set forth above except that the applicable percentage for general employees of St. Croix County is 1.3%; and WHEREAS, St. Croix County pays the difference between the applicable percentages for general employees and for protective occupation participants, and WHEREAS, recently the Supreme Court of the United States decided in the case of Wyoming vs The Equal Employment Opportunity Commission, that the federal laws con- cerning age discrimination apply to states and local governments as well as the federal government, meaning that counties may no longer retire protective occupation participants, at the county's option, at age 55; and WHEREAS, the Public Protection Committee of the St. Croix County Board of Super- visors has met and has considered the subject matter of this resolution and recommends that the State Legislature and Governor review this apparent disparity in calculating monthly annuities and costs between protective occupation participants and general employees for counties. NOW THEREFORE, BE IT RESOLVED by the St. Croix County Board of Supervisors, meeting in regular session, that the Board hereby recommends that the Wisconsin Legislature and the Governor of the State of Wisconsin review Wisconsin Statutes 40.23 in light of the recent Supreme Court case of the State of Wyoming vs Equal Employment Occupation Commission in regard to the apparent disparity in calculating monthly annuities and costs between protective occupation participants and general employees for counties. BE IT FURTHER RESOLVED that copies of this .resolution be sent by the County Clerk to each member of the Wisconsin Legislature serving St. Croix County, to the Governor of the State of Wisconsin, and to the Majority and Minority Leaders in both Houses of the Wisconsin Legislature.
