The request has been conditionally approved based on the application submission and the following findings: • The conditionally permitted structures are proposed in the Town of Erin Prairie, within a Shoreland Overlay District. • The proposed structures meet setbacks to the property lines and maximum 25-foot height requirement. • Proposed land disturbance is within 300 ftofthe ordinary high-water mark (OHWM) of the Willow River. • All parts of the structures meet the 75-foot setback to the OHWM. The setback shall be measured to the closest point ofthe structure pursuant to Ch.16.315.1.a. • There will be no disturbance of slope greater than 25%. • The total impervious surface calculation within 300 feet of the OHWM is approximately 2.1%, therefore mitigation is not required pursuant to Wis.Stat. 59.692. Based on these findings, approval of the Land Use permit is subject to the following conditions: 1. Priorto Construction, the following must be flagged to prevent any unplanned land disturbance in this area. a. 75 ftsetback from OHWM. b. Slopes greater than 25%. c. Location of all proposed structures. d. Nearest property line. 2. A pre -construction inspection is required to validate setbacks and verify the installation of erosion and sediment control. Please call (715) 386-4680to schedule this inspection and ensure the site is staked prior tothe inspection. Reed Junco Reed.junco@sccwi.gov (715) 386-4683 3. St. Croix County reserves the right to require additional sediment and erosion control measures to be installed if found necessary due to site -specific concerns and will be documented in an as -built site plan. 4. All temporary erosion control measures shall be left in place and maintained until the site has reached a point of at least 70% permanent vegetation. Permanent vegetation shall be established once final grade is reached or as soon as applicable per plan. S. A vegetation buffer zone is required 35 feet from the OHWM, and allows for a viewing corridor per Section 16.340. 6. A post -construction inspection is required prior to removing the temporary sediment and erosion control measures to verify proper vegetation cover has been established. Please call (715) 386-4680, to schedule this inspection. 7. The Department of Natural Resources shall be contacted for a NR 216 permit if land disturbance equals one acre or greater in size. 8. It is the applicant's responsibility to secure any other required local, state or federal permit(s) and approval(s) prior to land disturbance activity. 9. Failure to comply with the terms or conditions above may result in the revocation of this permit by the Zoning Administrator pursuant to Chapter 16.570.1. This approval is subject to the conditions listed above; it does not allow for any additional construction, structures, or buildings beyond the limits of this request. Your information will remain on file at the St. Croix County Community Development Department suite. It is your responsibility to ensure compliance with any other local, state, or federal permitting or regulations, including contacting the Town of Erin Prairie and the Department of Natural Resources to inquire if additional permissions are required.
