MAP OF SURVEY LOCATED IN THE FRACTIONAL NEy4 OF THE NW!/4 OF SECTION 3, T30N, R18W, CITY OF NEW RICHMOND, ST. CROIX COUNTY. WISCONSIN; INCLUDING LOT 9, BLOCK 1 OF THE PLAT OF COUNTY CLUB PARK SURVEYOR'S REPORT There are several issues from a surveying standpoint with this property as shown hereon. The westem portion of this property was able to be defined and mapped. However, the eastern portion of the property, east of the west ordinary high water mark along the river, has overlaps, deed discrepancies and areas of ambiguity that cannot be resolved without retracing the plat of Syndicate Addition and establishing the true / original location of the N of Section 3. Below are some notes regarding the discrepancies and ambiguities found during the course of this survey. 1) The plat of Country Club Park is lacking infomiation on the face of the plat. Distances along tot lines are absent and the curve infomiation given does not fit the plat nor does it fit the markers that were found at the site. The "math" provided on the original plat is so bad that it is impossible to tell if the markers found along the road to the northwest of the site are actually original mariners from the plat or if they were an attempt by another surveyor or land owner to mark their property boundaries. The two westeriy mariners on Lot 9, Block 1 do fit reasonably well with the other monumentation found along the street to the south of the site. Even though that plat seems to indicate that iron pipes were set at the comers, it does not actually say "iron pipes". It refers to the mariners as "lot mariners". The 'T' post at the northeast corner of Lot 9, Block 1 fits the east line of the plat as well as the extension of the west line of that Certified Survey Map recorded in Volume 2, Page 307 of Certified Survey Maps in the St. Croix County Register of Deeds. The mariners that were found on Lot 9, Block 1 were accepted as comer positions. 2) The deed in Doc. No. 1127956 describes a parcel of land beginning at the southeast comer of Lot 9, Block 1 of Country Club Parte, thence describing property that eventually goes to the "east line of Outlet 13". Presumably, the call is to the east line of Outlet 13 of the plat of Syndicate Addition which, according to the plat of Syndicate Addition, is the north - south )^ section line of Section 3. St. Croix County does not have a confirmed / established position for this comer. There is an old mylar worksheet that the county surveyor has that shows a "broken off "T' post" as a possible comer position, There is also a somewhat recent survey of property to the east of this site that shows a 1 ^e" found iron pipe as the N>4 comer. The location of that pipe does not fit the distance west to the water that is shown on the plat of Syndicate Addition. It could be the course of the river has changed over the last 100 years since the plat was done. This may be the case but there is another pipe in the ground approximately 50' further east that fits the call on the plat of Syndicate addition much better. A third possible position for the north - south % section line is an extension of the east line of that Certified Survey Map reconjed in Volume 3, Page 307 of Certified Survey Maps. There was monumentation called out on that Certified Survey Map that appeared to be on the east line of Outlet 14 of the plat of Syndicate Addition. All of the mentioned possibilities are different and St. Croix County does not have a definitive position of record for the N YA comer position. As can be seen on sheet 1 of this map, the described area from the descriptton on Doc. No. 1127956 crosses overall of these potential north - south YA section lines. Another potential overiap is with property cunrently owned by Judith Simma. Property described on warranty deed recorded in Volume 1124, Page 640 as Outlet 1 of the plat of Syndicate Addtion. Outlet 1 is shown to lie north of the Willow River. As previously mentioned, it is unclear as to the exact location of Outlet 1 because the east line of Outlet 1 is shown as the north - south Y4 section line. Therefore, G & S Land Solutions will take no liability or responsibility for any of the property called for east of the west ordinary high water mark of the Willow River. The property owned by the Emerson's does not appear to have any conflict or description overiaps west of the ordinary high water marit of the Willow River. DESCRIPTION: Part of the fractional NE Y4 of the NW Y4 of Section 3, T30N, R18W, City of New Richmond, St Croix County. Wisconsin. Lot 9, Block 1 of the plat of Country Club Parte. TOGETHER WITH the following described parcel of land: Beginning at the southeast comer of Lot 9, Block 1 of the plat of Country Club Parte; thence S82°37'00"E 91.22' to the westeriy meander line of the Willow River; thence N05''13'58"W 154.96' along said meander line; thence N8r22'24'W 78.01' to the northeast comer of said Lot 9, Block 1; thence S00°17'49"E 154.30' along the east line of said Lot 9, Block 1 to the point of beginning. This description contains 12,843 square feet (0.29 acres) to the meander line and 16,026 square feet +- (0.37 acres) more or less to the water's edge and Is subject to any easements, restrictions or covenants of record.
