Linda Luckey was absent and excused. Staff present: Steve Fisher, Deb Zimmermann Chairman Jensen called the meeting to order at 7:00 p.m. A motion was made by Anderson, seconded by Burri and carried to adopt the agenda. Motion by Zoerb, seconded by Anderson and carried to approve the following minutes as written: December 8, December 3, 2003, and January 8, 2004. Jensen explained the hearing rocess and opened the hearing. Fisher read the hearing notice. g P g g Tim Bazille: The request is to rezone approximately 5 -acres from Agriculture to Residential and 2- Acres from Agriculture to Ag/Residential. Location: The SW '/4 of the SW ' / 4, Section 23, T29N- R16W, Town of Baldwin. Wayne Hilgendorf, Pastor of Immanuel Lutheran Church, spoke on behalf of the church. He explained that the 5 -acres being proposed to residential is for the purpose of future expansion of the church and parking area. The expansion will not be completed for 3 to 5 years, but they are asking for the rezoning now so they can purchase it from Bazille before the land becomes too expensive to buy. The 2 -acre site is being requested for rezoning to Ag/Residential to allow Jerry Strobush to build a home on this parcel. This land was his original family farm. Joe Hurtgen, Chairman for the Town of Baldwin, spoke on behalf of the town stating that the town is in favor of this request. There was no opposition to the request. Fisher went over the staff report, stating that the request is consistent with the County Plan. He explained that churches are a permitted use in the residential district. This church has had other expansions, and it has worked well in this area with no problems. The staff supports the request for the churches proposed expansion and for the 2 -acre site to be rezoned for Strobush to construct a home on the site. The committee reviewed the staff report. Discussion held. Hearing recessed. Motion by Jensen, seconded by Zoerb and carried to approve the rezoning request to rezone 5 +/- acres of land from Ag to Residential and to rezone 2 +/- acres of land from Ag to Ag/Residential and forward to County Board for approval. The approval was based on the following findings: 1. The parcels are in the rural planning area and are an appropriate use. 2. Both sites are presently open land. 3. Site access to both sites is a town road, 80 Avenue. 4. Neither site has any environmental corridor. 5. There are no limitations for Private Onsite Wastewater Treatment Systems (POWTS). 6. Surrounding land uses include a church and two small residential lots to the east and open agricultural land to the west, north and south. 1 t 7. Surrounding zoning is exclusive ag to the north, west, south and southeast and ag- residential to the northeast. 8. Proposed use of the five -acre site is expansion for the church, including a one -acre parking lot, 1/3 of an acre for an easement to access the fields to the north and three plus acres for future playground and as a buffer against future development. These three acres will be farmed temporarily. 9. Proposed use of the two -acre site is one building site. 10. Potential development is two lots on the five -acre site and one lot on the two -acre site. 11. The St. Croix County Natural Resource Management Plan Goals 11, 111 and IV also encourages protection and preservation of surface waters and wetlands; fish and wildlife habitats; and agricultural land and soils to preserve ecological functions and recreational and scenic values and wildlife habitat. 12. The Town of Baldwin has recommended approval of the rezoning, and has considered §91.77 in making their recommendation. The request will be forwarded to the County Board. David Gazdik: The request is to rezone approximately 40 +/- acres of land from Agriculture to Ag/Residential. Location: the SE '/a of the NW ' /a,Section 14, T30N- R19W,Town of Somerset. Jerry Ripley, with JEO Consulting, represented David Gazdik. He explained the request to the Committee stating that Gazdik would like to rezone this property to Ag/Residential to allow him to sell off 5 -acres with the existing buildings, and to build a home on the remaining 35- acres. The Town has recommended approval of the request and it meets the Town of Somerset criteria for rezoning. The proposed use of the property is compatible with the surrounding area. There was no opposition to the request. Fisher went over the staff report, stating that the parcel is 40 -acres in size, but the original Ag tract of land already has two home on the property so the owner needs to rezone in order to build another home. The request is consistent with the Town and County Plan. The committee reviewed the maps of the property. Discussion held. The hearing was recessed. Motion by Burri, seconded by Zoerb and carried to recommend approval of the rezoning request for 40 acres to be rezoned from Ag to Ag/Residential, based on the following findings: 1. The parcel is in the rural planning area and is an appropriate use. 2. Site consists of open rolling land with some woods, a residence, outbuildings, a man- made grade stabilization structure in the northeast. 3. The site is currently a single residence and former farm fields. 4. The site has woodlands, moderate slopes and shorelands and is adjacent to a waterfowl protection area. 5. The whole site is an environmental corridor. 6. Approximately 1/3 of the site is prime farmlands. 7. There are no limitations for Private Onsite Wastewater Treatment Systems (POWTS) on the site. 8. Surrounding land uses include open agricultural land to the west and south, U.S. Fish and Wildlife lands to the east and smaller residential sites to the north. 9. Surrounding zoning is exclusive ag to the west and south, ag residential to the north and conservancy to the east. 2 10. The site has access to a town road, 75 Street, to the east. 11. Proposed use is to sell the existing structures with five acres and construct a residence on the remaining 35 acres. 12. Potential development is approximately 12 lots. 13. The St. Croix County Natural Resource Management Plan Goals II, III and IV also encourages protection and preservation of surface waters and wetlands; fish and wildlife habitats; and agricultural land and soils to preserve ecological functions and recreational and scenic values and wildlife habitat. 14. The Town of Somerset has recommended approval of the rezoning, and has considered §91.77 in making their recommendation. The Somerset Town Plan uses five guidelines to delineate where preferred development areas shall be located. Based on the criteria in the plan, this rezoning is generally consistent with the Town Plan. 15. The area is in proximity to some existing development. The parcel's terrain is suitable for development. 16. The area is located in the southern part of the town. 17. Avoid areas adjacent to or in proximity to rivers, wetlands, lakes and conservancy areas. 18. Justify non - agricultural uses on land in the agriculture district.
