1) An Ordinance revising the St. Croix County Land Use Regulations to replace
Chapter 18, Subdivisions, with a new Chapter 13, Land Divisions, which is a
complete revision that will bring the ordinance into compliance with state law,
update county standards and procedures, and authorize Conservation Design
Development.
2) An Ordinance revising the St. Croix County Land Use Regulations to replace
Chapter 15, Sanitary Code, with a new Chapter 12, Sanitary Ordinance, to
conform with recent changes to the state plumbing code that establish
standards and procedures for permitting individual and common wastewater
treatment systems.
3) An Ordinance Amending the St. Croix County Land Use Regulations Chapter
17, Zoning Code, with complementary changes to maintain consistent policies
and standards between the Land Division Ordinance, Sanitary Ordinance and
the Zoning Ordinance.

PUBLIC HEARING NOTICE
The St. Croix County Planning and Zoning Committee will be conducting a public
hearing on Thursday, February 12, 2004 at 7:00 p.m. at the St. Croix County
Government Center (Community Room, lower level), 1101 Carmichael Road,
Hudson, Wisconsin, to consider the following petition(s):
1) An Ordinance revising the St. Croix County Land Use Regulations to
replace Chapter 18, Subdivisions, with a new Chapter 13, Land
Divisions, which is a complete revision that will bring the ordinance
into compliance with state law, update county standards and
procedures, and authorize Conservation Design Development.
2) An Ordinance revising the St. Croix County Land Use Regulations to
replace Chapter 15, Sanitary Code, with a new Chapter 12, Sanitary
Ordinance, to conform with recent changes to the state plumbing code
that establish standards and procedures for permitting individual and
common wastewater treatment systems.
3) An Ordinance Amending the St. Croix County Land Use Regulations

St. Croix County Planning and Zoning Committee
February 12, 2004
St. Croix County Government Center, Hudson, Wisconsin
Committee members present: Supervisors Art Jensen, Veronica Anderson, Jan Zoerb, Linda
Luckey and Lois Burri.
Staff present: Steve Fisher, Dave Fodroczi, Ellen Denzer, Rod Eslinger, Brett Budrow, Pete
Kling, Jon Sonnentag, Jessie Nye and Deb Zimmermann
Chairman Jensen called the meeting to order at 7:00 p.m. A motion was made by Luckey,
seconded by Zoerb and carried to adopt the agenda.
Jensen explained the hearing process and opened the hearing. Fisher read the notice into the
record as follows:

Chairman Jensen introduced the committee and staff and explained who was involved in the
ordinance preparation. He informed everyone that notices and copies of the proposed changes
were sent out to over 260 groups /individuals. Jensen went over the sheet outlining the "order of
business" and explained how the meeting would be conducted.
Dave Fodroczi and Steve Fisher gave a summary of the ordinance changes to the group and then
gave a Powerpoint presentation on the three ordinances being amended. They further explained
that there is a large interest in Conservation Design Development throughout the county and the
Sanitary Code needed to be changed to bring it up to the standards in the Administrative Code
and the State Statutes. There have been many changes at the state level and the county needs to
come into compliance with those rules.
Staff went over the ordinance approval authorities and stated that a number of towns have
subdivision ordinances that work concurrently with the county and it is important that the county
and the towns work together to co -exist in this area.
Fodroczi briefly explained the Conservation Design concept. He added that there will be new
definitions of classes of highways and reductions in roadway setbacks, vision triangles and
distances between driveways on certain classes of highways. The Conservation Design option
allows for common sanitary systems in a development and is now allowed in the state through
the new Comm 83 Code. Staff is also proposing to change the 35 -acre provision in the current
ordinance to allow any 35 -acre parcel to have one home on it and remain in Agricultural Zoning.
Fisher added that the staff and committee took this opportunity to "clean up" the land division
ordinance and to come into compliance with the Department of Commerce Code Comm 83.
Jensen opened up the hearing at 7:45 p.m. to take questions from the public. After the question
period was over, the public addressed the committee and staff with the following comments:
Doug Zahler
• Ordinance needs to be more flexible.
• Concerned with 25% slope issues
• Concerned about flag lots
• Concerned about depth to width ratio
• Concerned about the 600 -foot road length issue.
• We need mechanisms to vary from these standards.
• Would like to have more time to review the draft.
Teresa Johnson (representing the Town of St. Joseph)
• The town of St. Joseph does not have a CDD ordinance, so county rules would be more
restrictive. The town has concerns about that and would like to work with the county on
this issue.
• Wanted more time to review and comment on the draft.
Bob Rolle
• Does not want to see these ordinances rushed through.
• Urges the county to adopt regulations to protect groundwater in the sanitary ordinance
• In the towns where there are engineers working for them, the county should not regulate

• Allow the towns to follow their own subdivision ordinances
Bill Berndt (On behalf of the Homebuilders Assoc. and the Realtors Assoc.)
• Thanked staff and committee for all the hard work and these two associations are in favor
of Conservation Design.
• 13 -2: Compliance — Land Use — take out "compliance" and replace "in harmony"
• 13 -3: Plat review — change 60 -90 days to 75 days. Feels this would be more appropriate
• Had concerns with the extension of roads to boundary.
• 13 -36: Look at limiting the number of road extensions in CDD
• 13 -37: Cul -de -sac lengths — should remain at 1000 feet, loop roads are a good idea as
allows roads to go deeper into the property
• 13 -40: Need definition of regional stormwater pond
• 13 -44: Concerns with ghost platting — should scratch this.
• CDD — kept attractive to the developers and homeowners
• Allow the concept plan for CDD to be a "sketch" plan and not a preliminary plat plan, as
that is very expensive to have done.
• The rounding rule for lots should be up not down
• Clearly identify environmental corridors on the maps
• Be more flexible on 25% slopes — There are times when it should be ok to use these
slopes for development.
• Would like to work with the county on this and offered their support in the
implementation.
Bob Pierce
• Appreciates the hard work everyone has put into this. Knows that there will be
challenges. Agrees with the CDD.
Dennis Blegen
• Thinks the amount of acreage that someone owns should be considered when splitting 4
times in 5 years. (ex. The more acreage, the more times you could split).
Bruce Elliott
• Has concerns about the wording "conceptual" approvals. Towns need to be careful when
giving a "conceptual" approval.
Joe Granber
• For the most part this is a good ordinance and protects the land.
• He has a problem with eliminating the flag lots
• Concerns with the 3 to 1 lot ratios. Look at lot size also.
William Hunt
• Thanked the staff and committee for all of the work. Told the public not to lose the big
picture that this is a way to preserve this beautiful area.
Louis Filkins
• This is a step in the right direction and basically a good start, but would like a longer
review process.
• Believes 13 -2 is conflicting.

• Has concerns with the 25% slope restrictions. These plats are designed by professional
engineers and they can design for erosion control measures on these slopes.
• Has concerns with the 3 to 1 ratio wording and should be abolished.
• Flag lots: Will continue to run into this and believes is going against what we are trying
to achieve.
• Two weeks is not enough for reviewing of these ordinances. Would like to review longer
and have input. There are many professionals that have input on these and believes these
professionals know what they are doing.
Jay Fletch
• Good plan but need to look at more closely.
• Concerns with the 600 -foot roads
• Concerns with the 3 to 1 lot ratio and the flag lots
• Need to reconsider the rounding up on lots.
• Need a longer review process
Ron Bonte
• For the most part agrees with the ordinances and likes the CDD, but may need some
"tweaking" County has done a good job.
• The sewers today are much better than in the past.
• Good plan to keep the area nice even with all the development
Elizabeth Christensen
• More public input is needed
• Towns should review
• Ordinance needs more flexibility regarding flag lots
• CDD — good idea, but should be more flexible
Ted Anderson
• Thanked staff and committee for all of their hard work
• CDD needs to be more thoroughly looked at with regards to roads, etc.

• Need more review time

• Complimented the committee and staff for their work on this and for listening to all of the
comments.
• Encouraged the public to look beyond the present and how decisions made now will
affect the future.

After all comments were received, Jensen concluded that the hearing was over. Written
comments may be sent to the Zoning Office up until 5:00 p.m. on February 23, 2004.
Jensen declared the hearing adjourned at 9:20 p.m.
