BACKGROUND INFORMATION
2023 Wisconsin Act 4 gives counties the choice of classification for County Jailers. The two
options for St. Croix County are to confirm the current status as "protective occupation
participants" or change the status to "general participating employees." Changing the status
changes who is responsible for additional Wisconsin Retirement System (WRS) contributions
and is a cost shift of $138,000 from the County to the employees via salary reduction. Act 4 is
effective January 1, 2024.

STATUS
1 WHEREAS, the State of Wisconsin enacted 2023 Wisconsin Act 4 on April 6, 2023,
2 with an effective date of January 1, 2024; and

4 WHEREAS, 2023 Wisconsin Act 4 provides counties with options on how to classify
5 and treat County Jailers with regards to Wisconsin Retirement System (WRS) classification; and

7 WHEREAS, St. Croix County is one of thirteen counties that currently classify County
8 Jailers as “protective occupation participants;” and
9
10 WHEREAS, 2023 Wisconsin Act 4 allows counties who currently classify County
11 Jailers as “protective occupation participants” to continue classifying County Jailers as
12 “protective occupation participants” with no change to reporting or handling of WRS premium
13 contributions.

15 NOW, THEREFORE, BE IT RESOLVED that the St. Croix County Board of
16 Supervisors hereby confirms the classification of St. Croix County Jailers as “protective
17 occupation participants.”

Fiscal Impact: Status quo has no fiscal impact. Changing jailer classification reduces County
expenses by $138,000.
