PLANNING AND ZONING COMMITTEE
ST. CROIX COUNTY GOVERNMENT CENTER, HUDSON, WI
April 27, 2004
Supervisors: Jan Zoerb, Linda Luckey, Veronica Anderson and Lois Burri were present. Supervisor Art
Jensen was absent and excused. Staff: Rod Eslinger, Jon Sonnentag, Deb Zimmermann, Pete Kling
Others: Ed Flanum, Doug Zahler, Ty Dodge, Roger Humphrey, Mike Rivard, Tom Healy
Vice Chairperson Luckey called the meeting to order at 9:00 a.m. Zoerb moved, seconded by Bum, and
carried, to adopt the agenda, noting that Department Reorganization and Register of Deeds items will be
postponed to the next meeting.
Date of next meeting: The next meeting for this committee is April 28, 2004, at 1:00 p.m. at the
Government Center in Hudson.
Minutes: Motion by Burri, seconded by Zoerb to approve the February 24 and March 31, 2004 minutes
with minor corrections.

The committee recessed from 11:00 a.m. to 11:10 a.m.
11:10 a.m.: Hearing for Phyllis Menke: Vice Chair Luckey opened the hearing at 11:10 a.m. Jon
Sonnentag read the hearing notice. He then explained that this request is for a variance to the subdivision
ordinance to seek relief from access improvement requirements in order to split an existing residence
from the original parcel. Pete Kling, representing the Star Prairie Land Preservation Trust and Phyllis
Menke, explained the request. Menke has owned this 60 -acres on Cedar Lake for 60 years and wants to
preserve this land. There are hardwoods, wildlife, and natural habitat on the property. Menke would like
to keep 3 -acres and the summer home and donate the remaining 57 -acres to the Star Prairie Land
Preservation Trust. A memo of understanding has been signed by all parties and the transfer would take
place in January of 2005. Kling showed slides and a video of the property to the committee.
The variance is required so that the access to the property does not have to be upgraded, per the ordinance
requirements. The road will not be serving any more residences, as this property will not be developed,
but ownership will change over to the Trust. Kling assured the committee that the Memo of
Understanding is very secure and attorneys for both sides have seen this. Kling added that this is a
wonderful way to preserve property on Cedar Lake.
Discussion held by committee.
Motion by Burri, seconded by Anderson and carried to approve of the subdivision variance request to
sections 18.16(H)(3), 18.16(D)(6)(b), and 18.16(D)(7(i) of the St. Croix County Subdivision Ordinance.
The Committee's decision was based upon the following findings:
1. The variance request does not create any negative impacts or atypical land use.
2. There will be no change in use for the existing access that has served the residence for the last 75
years.
3. The variance request does not provide additional opportunities to develop new parcels for
residential construction.

4. The protection of the remaining land will contribute to the preservation of the water quality in
Cedar Lake.
5. The Town of Star Prairie supports the land division as presented.
6. A literal enforcement of the ordinance would cause an unnecessary hardship. The variance
request will avoid the need to disturb environmentally sensitive areas in conjunction with access
construction and will result in the permanent protection of approximately 60 acres of
environmentally sensitive land.
With the following conditions:
1. One lot will be created to separate the parcel containing the summer home, from the parcel being
donated to the Star Prairie Preservation Trust.
2. There will be no development of the remaining acres.
3. The Decision of the Planning and Zoning Committee is to be recorded with the Register of Deeds
office against the deed on the property, notifying future owners that this property may not be
further divided.
Motion carried on a 4 -0 vote.
Violations and Citations: The Committee reviewed the report with staff.
Rezoning Schedule: The committee set the following date for a rezoning hearing: May 26, 2004 at the
St. Croix County Ag Center in Baldwin at 7:00 p.m. — Thompson (Cylon)
Bills, Invoices and Revenue Report: Motion by Zoerb, seconded by Bum and carried to approve March
2004 bills of $23,477.82 and to note revenue of $119,402.00.
Personnel Update: A new secretary has been hired for zoning, Monica Lucht. She will begin work on
May 24"'. Jessie Nye is out with pregnancy complications and Judy Kahler will be helping out in the
interim. The zoning intern position will be filled soon. Cedar Corporation has been covering many of the
septic inspections for the zoning office.
Escrow Money for Town of Star Prairie: Motion by Zoerb, seconded by Burri and carried to release
escrow money for the Town of Star Prairie in the amount of $10,000 to donate to New Richmond Hatfield
Park Soccer Complex.
Department Reorganization: Zoerb distributed a handout from Chuck Whiting on the reorganization of
the planning and zoning departments for the committee to review. No discussion held.
The committee recessed from 12:55 p.m. to 2:00 p.m. for lunch.
Ordinance Development: County Board Chairman, Buck Malick, joined the group to announce new
committee appointments, effective immediately. Based on the changes in committee membership, a
motion was made by Zoerb, seconded by Burri and carried to adjourn. The committee meeting for April
28"' was canceled.

Staff Recommendation: Conditional approval: 1) The developer and project engineer must sign
the supplemental "Conditions of Approval - Exhibit #1"; 2) Minor map revisions as requested; 3)
Minor revisions to road construction plans as requested.
Committee Action: Motion by Burri, seconded by Zoerb to approve with conditions
recommended by staff, carried.

Disturbance of slopes greater than 20% Start here
Vogel, Town of Star Prairie (Section 8): Motion by Zoerb, seconded by Burri and carried to
approve this concept map to disturb 20% slopes for the purpose of dedicated public roads in areas
described on the Vogel property only. Any other accesses are to comply with the ordinance
based on the existing ordinance. The preliminary map must be submitted before the new
ordinance is put into place, or the concept map must be revisited/ re- approved and the remainder
of the plat must comply with the 20% slope policy
T & T, Town of Star Prairie (Section 17): Motion by Zoerb, seconded by Anderson and
carried to approve this concept map to disturb 20% slopes for the purpose of dedicated public
roads in areas described on the T & T property only. Any other accesses are to comply with the
ordinance based on the existing ordinance. The preliminary map must be submitted before the
new ordinance is put into place, or the concept map must be revisited/ re- approved and the
