COMPENSATION FOR SHERIFF'S DEPUTY RICHARD HAVERLAND

WHEREAS, on January 12, 2011, while performing his official employment duties,
Deputy Richard Haverland was injured in a motor vehicle accident, in which another driver had
failed to stop at a stop sign on 140` Street at CTH G causing Deputy Haverland to take evasive
action to avoid a collision with the other vehicle. Deputy Haverland subsequently struck a snow
bank and injured his back and neck; and
WHEREAS, as a result of his crash, Deputy Haverland has been incapacitated since
January 12, 2011, by significant injuries; and
WHEREAS, those injuries require extensive long term rehabilitation and have affected
the quality of life and have placed a financial strain on Deputy Haverland and his family; and
WHEREAS, while Worker's Compensation benefits are available to Deputy Haverland,
they will not make up what Deputy Haverland's normal compensation would be had he not been
incapacitated and he has had to use PTO (personal time off) to make up the difference; and
WHEREAS, Article 17 — Duty Incurred Disability — of the Bilateral Agreement between
St. Croix County Deputy Sheriff's Association Local 4453 and St. Croix County allows the
County Board to approve, upon recommendation of the Sheriff, that any employee covered by
said agreement receive his /her established rate of compensation without deduction from accrued
PTO if benefits paid to the employee under Worker's Compensation are assigned to the County;
and
WHEREAS, Sheriff John A. Shilts has recommended that during Deputy Haverland's
incapacity, he receive his established rate of compensation, retroactive to January 12, 2011,
without deduction from accrued PTO and assign his Worker's Compensation benefits to St.
Croix County; and
WHEREAS, the recommendation was made on the basis that it is fundamentally unfair to
force Deputy Haverland to use accrued PTO to supplement the Worker's Compensation benefits
for injuries incurred while protecting the public and enforcing the law.

THEREFORE, BE IT RESOLVED by the St. Croix County Board of Supervisors that
Deputy Richard Haverland receive his established rate of compensation during his incapacity, for
a maximum period of six months, retroactive to January, 2011, without deduction from accrued
PTO, on the condition that Deputy Haverland assign any Worker's Compensation benefits for
the incapacity resulting from the incident of January 12, 2011 to the County.
