HomeMy WebLinkAboutResolution 2011 (42) EMERGENCY RESOLUTION AUTHORIZING REPAIR OF HEALTH CENTER WATER HEATING SYSTEM Resolution No. � � t St. Croix County, Wisconsin WHEREAS, Building Services Department staff discovered an unusual increase in boiler water pressure at the St. Croix Health Center (Nursing Home); and WHEREAS, staff has determined that water is coming from a fault in the domestic hot water heater, a tube and shell design that utilizes hot water heating boilers to create the required hot water for Health Center domestic hot water needs (hand sinks, baths, kitchen, etc.); and WHEREAS, the water heater (circa 1982) has no readily accessible inspection panels that can be removed to pinpoint the problem, there is no replacement heat exchanger for this water heater, and disassembly and repair would likely create additional leaks; and WHEREAS, Building Services staff believe the water heater and other components need to be replaced at a cost of between $35,000 and $70,000; and WHEREAS, failure of the water heater would leave the Health Center with no domestic hot water; and WHEREAS, Building Services staff believe this situation could become an emergency situation at any time; and WHEREAS, repairs to County facilities are public work and the cost of these repairs would normally require compliance with the public work bidding laws requiring a formal bidding process to be followed and a contract awarded to the lowest responsible bidder; and WHEREAS, the public work bidding laws do not have to be followed and work can be done if a county board adopts a resolution finding an emergency exists; and WHEREAS, the St. Croix County Board of Supervisors could find that the threatened damage to the Health Center and its residents if the water heater fails is an emergency because the water heater could fail at any time and the Health Center and its resident would be without hot water for several weeks if the public work bidding process was not completed. THEREFORE, be it resolved by the St. Croix County Board of Supervisors that it determines that an emergency could arise in regard to the domestic hot water heater system at the St. Croix Health Center because: the water heater could fail at any time; the Health Center and its residents cannot go without hot water for any extended period of time; the existing water heater cannot be repaired. EMERGENCY RESOLUTION AUTHORIZING REPAIR OF HEALTH CENTER WATER HEATING SYSTEM - Continued FURTHER, be it resolved that a replacement water heater system be engineered and replaced and other necessary repairs be done following the public work -bidding laws to restore a reliable source of domestic hot water to the Health Center, but in the event the water heater system fails during the public work bidding process the work be completed based on an emergency if there exists no alternative to restore hot water to the Health Center. FURTHER, be it resolved that the Administration Committee is authorized to transfer funds up to $70,000 from the contingency fund, between line items in the Building Services Department budget, between line items in the Health and Human Services Department budget, or from the Recovery Zone Economic Development Bonds, or use a combination of two or more of these funding sources, for replacement of the water heater system. Note: This emergency resolution did not originate in a committee. It is offered directly to the Board of Supervisors from the Building Services Department. The Board will need to waive its rule requiring all resolutions to originate in a committee and the rule requiring all resolutions be sent to supervisors 5 days before a Board meeting.
