ST. CROIX COUiNTY BOARD OF SUPERVISORS Regular Session Tuesday June `nth, 1981 7:00 P.M. Board called to order by Chairman Anderson. Invocation: Superv. Ross Pierson, Town of Rush River. Pledge of Allegiance to the Flag by all present. Roll Call by Clerk. 30 present. I late at Roll tine. 'lotion by Superv. O'Connell, 2nd by Superv. fleiting, to accept the minutes of the Previous session as vir'itten and mailed to each County Board Supervisor. 'lotion carried. AN1'11OUHCEt'EiT11TS Chairman Anderson read Rules 19 and 21 as follows: "111henever any member is to speak or deliver any matter to the Board he shall rise and address himself to the Chair, confine his remarks to the question under debate and avoid personalities. The member who shall rise to address the Chair shall speak first. t4hen 2 members rise to speak at the same time the Chair shall name the member who is to speak first." Rule 21: "Any person not a member of the County Board desiring to address the County Board on any subject shall first obtain permission from his or her Supervisors. In case of objection such person must have a simple majority consent of the Board." The Chairman announced:The notice of this meeting has been published in the official media of the County as prescribed by Law; 1,1'elconed all guests and members of the Press in attendance; The date of the next session will be August 11, 1901 at 9: 00 A. 11. Superv. O'Connell on behalf of the County Board extended sympathy to Chairman Anderson for the recent loss of his brother. Superv. Nelson announced and extended appreciation to the sponsors for June Dairy month. St. Croix Farm Bureau; St. Croix NFO,,, St. Croix Farmers Union; State Bank of Roberts and the sponsors for this evening's meeting, St. Croix County Dairy promotion Committee. Superv. Blakeborouqh announced that Gary Johnson, Health Center Program Director has extended an invitation to the County Board members on July 13th between 9:00 A.M. and 9:30 A.M. The County Board members will be divided into groups for a tour and lunch will be served at 11:30 A.M. The group will then tour the Pre -Release Center at 4:00 P.M. OLD Btl-SI,"IESS tilotion by Superv. Brown to reconsider the motion made by Supery Bochey. 2nd by Superv. Brown at the last session approving the MJV Enterprises, Inc. request for a Cou.ntry 6Iestern Festival contingent on the approval by the Town -of St. Josen.h. klot-!Lon carried. Notion by Superv. Bro-vin, 2nd by Superv. Rock to deny the license 1,107.iest to MJV Enterprises, Inc. Superv. Lowe requested that the Chairman of the Tovin of St. Joseph report on the reasons why they turned down the request. Superv. brol,,,,n called upon Benjamin George, Chairman of town of St. Joseph. Mr. George stated that, at the Hay meeting the Town of St. Joseph turned down the applicaticn of MjY Enterprises to hold the Festival. The Township had been contacted b .,U y the City of Still�,,iater, City of Hudson and Village of Somerset showing great concern over problems that could arise from the Festival. He further stated that the Township or the County could not handle the crowd and the traffic on the Highviay. Also they have discovered that the cost would be extremely high for the County. Superv. Brown introduced Linda L. Luckey, Secretary of St. Joseph Township Residents Committee. Ms. Luckey read a letter from this Committee stating reasons for opposing the Festival, pointing out the deviations away from the County Ordinance. Attached to the letter were 31 pages with approximately 530 St.Joseph Town residents signatures opposing the Festival. Superv. Lowe, Chairman of the Lavi Enforcement Committee read a Resolution adopted by the Lay., Enforcement Committee opposing the waiving of any of the provisions of Ordinance #2(73) Regulating Large Assemblies. Vice Chairman Meinke called upon Hich!,iay Commissioner Ralph Brown and Traffic Patrol Capt. Roe to speak regarding cost to the County etc. Cost figure sheets were distributed to the County Board members. P-1r. Brown explained the complete procedure that would be used by the Hi9hi-%iay Departments "Sign Department"; the cost of the labor and fringe benefits at an estimation of $20,000.00. Caot.Roe spoke on the schedule costs for I day estimated at �,5500.00. Chief of Police, Abrahamson, Stillwater and Chief of Police Burke, Hudson stated the reasons for -2- their concern within their Cities. Superv. Lowe asked to hear from IIJU Enterprises representative. fiiss. Patricia Peterson, Manager stated they had made some concessions to a 1 day Festival instead of a 2 day. Limit the crowd to 10,000 to 12,000 people instead of 17,000 to 20,000. Superv. Brown called upon Don Henne from the Town of St. Joseph delegation. Several residents from St. Joseph Township were in attendance. Mr. Henne stated his reasons for opposing the Festival. Superv. Pierson requested an opinion from District Attorney Lundell. District Attorney stated that he felt the matter has been decided and should not have come up. It is essentially a dead issue when the Town Board voted in May. Motion by Superv. Sias to table the motion. No second. Motion died. Roll Call vote resulted in 29 yes, 1 abstain and 1 no. Superv. Sias stated his reason for abstaining as he doesn't understand what they are doing therefore he is abstaining from voting. Motion carried to deny the license request. Report on Bids for space needs for the County Library. Superv. Pock, Chairman of Finance, Budget, Building and Bonds Committee reported that they had received 4 Bids and the Bids were opened at 1:15 P.m. June 8, 1981 in the presence of the Special Building advisors and the St. Croix County Library Hoard. The Bids were as follows: 1. Hielkema Construction for a Baldwin site, 3000 square feet 0 U.45/square foot. (all utilities except electricity). 2. Findley Electric for a Hammond site, 2584 square feet 0 $4.30 /square foot. No electricity, heat, janitorial etc. 3. Hammond Development Corporation for a Hammond site, 2950 feet 0 3.49/square foot. (no utilities) or $4.74 (all utilities). 4. Cenex for site in New Richmond, 2500 square feet 0 $-5.75/square foot (no utilities) $5.95/square foot (ail utilities). EMERGENCY RESOLUTIONS RESOLUTION #24(81): Read by the Clerk pertains to accepting the bid of Hammond Development Corporation. motion by Superv. Pierson, 2nd by Superv. Hop to adopt. Roll Call vote resulted in 30 yes. 1 no. I'lotion carried and Resolution 7#24(81) adopted. RESOLUTION # 25(81): Read by the Clerk pertains to increase of wage rates for St. Croix Health Center Registered Nurses. Motion by Superv. Heiting, 2nd by Superv. Shay to adopt. Roil Call vote resulted in 29 yes, 2 no. Flotion carried and Resolution #25(81) adopted. EMERGENCY ORDINANCE ORDINANCE #47(81): Read by the Clerk pertains to Prohibiting Possession or Use of arijuana. i'iotion by Superv. Pierson, 2nd by Superv. Sias to refer the Ordinance to th2 General Services Committee. District Attorney Lundell explained the purpose of the Ordinance being an emergency. He stated that about 1 week ago it came to his attention that there was a lot of interest amongst the Lava Enforcement Officials in the County that St. Croix County along with the City of Hudson and the City of River Falls pass an Ordinance regulating possession of marijuana. According to the schedule for County Board mectings, a meeting won't be held until August.The summer season is the vast majority of the time for possession and use of marijuana. The District Attorney would prefer the Ordinance being passed tonight because of the tirao months lapse before the next County Board meeting. This Ordinance gives the officers a choice of arresting on County Ordinance as a civil matter or State Statute as a criminal natter. Law Enforcement throughout the State is M ask{ on arresting according to State Statute where as this Ordinance would rekindle the interest of arresting. A lengthy discussion was held with Mayor Schommer, City of Hudson, John Martin, County Law Enforcement Deputy and County Board members. Motion by Superv. Boche, 2nd by Superv. Day to table Superv. Pigrson's motion. Motion carried. Motion by Superv. Dorsey, 2nd by Superv. Handles to adopt Ordinance #47(81). Roll Call vote resulted in 29 ,yes, 1 no, 1 absent. Motion carried and Ordinance #47(31) adopted. Superv. Pierson stated his reason for voting "no" was that he felt the Board should have more time to consider the Ordinance. Superv. Soche, Chairman of General Services and Redistricting Committee inquired from the Chairman if they could take up the matter of the Redistricting at this time as they are connected on ETH t�aith Professor John i'lartin in Nadison to ans!T,Ier any further questions. -3- There being no objection from the Board of Supervisors, the General Services Committee, Superv. Boche and Superv. Shay presented a Revised 0/4-/81 Tentative Redistricting Plan. Superv. Boche stated that they would appreciate the Board of Supervisors adoption of this Revised Redisarirtinc; Plan this evenin q as they must have the Plan to the Local Governments by the loth of this month. The local governing luni ci pal i ti es have 60 days to draw up or adopt their Nfard lines. On the date Municipal. Government adopts their Hard Plans and returns them to St. Croix County, then St. Croix County has 60 days to hold Public Hearings and adopt the final Redistricting Plan. Superv. Shay explained the changes that were rude on the Revised Plan in coriparison to the Advisory Map prepared by Professor Martin. A lengthy discussion was held. Superv. Shay explained that there seems to be 3 areas of major contention. 1st area, District 6 involves Town of Star Prairie, Town of Somerset and Village of Star Prairie. This area ended up as being dissolved by the Toiims and Village_ themselves and decided to follow Highway.35 & 64 as a boundary line.2nd area of contention, District 22, 23 and 24, Town of Baldwin, Village of Baldwin, Village of t-foodville, Village of U'ilson, Town of Springfield, Town of Cady and part of the Town of Eau Galle. Revised they took a portion of Springfield and include Village of t4ilson. Town of Baldwin would take in Village of Baldwin and the Village of lloodville would be Eau Galle area. Then each of these areas would have a Village in their District. 3rd area of contention, District.10,11,12,13,14,15,16 and 17. City of Hudson, Village of North Hudson, Town of St. Joseph and Town of Hudson. Original Plan City of -Hudson would net 4 Supervisors. One problem with this plan there was a possibility that the Toi*rnship of Hudson could be without a representative. Revised plan, District 13 would he part of Village of.(lorth Hudson and part of City of Hudson. District 17 would be part of City of Hudson and Town of Troy. District 14,15 and 16 would be the City of Hudson. District 10 would be Town of Hudson and part of To+gym of St. Joseph. Questions were presented to Professor Nartin by Mayor Schommer, City of Hudson, Bernard Kinney and Lyle Baer, To�gn of Hudson. After considerable discussion, motion by Superv. Shay, 2nd by Superv. Hop to adopt the 6/4/81 Revised Tentative Redistricting Plan. [lotion by Superv. O'Keefe to amend the motion that Mr. Martin be invited to help the Districts to remedy the situation. 2nd by Superv. Heiting. !lotion by Superv. Boche to amend the motion by Superv. O'Keefe that the District areas that ask for his assistance pay for Mr. Martins assistance. 2nd by Superv. Lowe. Superv. Boche and Superv. Logue withdre%a their motion and second: Superv.0'Keefe and Superv. Heiting withdrew their, motion and second. Roll Call vote called for resulted in 22 yes, 3 no, 1 abstain. Notion carried to adopt the Revised Tentative Plan. Superv. O'Keefe stated he abstained from voting because he is confused and felt they should go back to the original Plan. Superv. O'Keefe then voted with the majority making final Poll Call 23 yes and 8 no. AMENDATORY ORDINANCE # 48(81) : Pertains Ordinance. [lotion by Superv. Thompson-, carried. to updating the St. Croix County Zoning 2nd by Superv. leli1link to adopt. lotion Superv. Heiting gave a brief update report on West Cap due to the absence of Patrick.Herriges and distributed the 1980-1981 West Cap Directory to the Board members., Superv. Pierson presented 5 Farmland Applications that have been referred to the Agriculture, Soil and plater Conservation Committee as follows:316-Judith Hill,Forest; 317-Rex Hanson, Rush River; 318-Donald & Lucille Quam, Eau Galle; 319-Ross-Pierson, Rush River; 320 Elmer UO Elsie Bergseng, Kinnickinnic. Manion by Superv. Pierson, 2nd by Superv. Thompson that the Clerk send.the applications to.the State of t,lisconsin Department of Agriculture, Trades and Consumer Protection. Motion carried. COS: "SPONDENCE Letter from City of !,Iew Richmiand regarding use of the Health Center Puildinn that is being replaced read by the Clerk. Chairman referred the letter to the Finance, Budget, Building and Bonds Committee. MILEAGE ', PER DIET" Mfleage and Per Dietji for the 1 night session totaling $1,449.40 read by the Clerk.. Motion by Superv. R.Peterson, 2nd by Superv. Kelly to adopt. Notion carried. Superv, iV akeborough announced that he and his wife are retiring July 1, 1981 and Would recommend Carlton Dell . From Glenwood City as his successor. Chairman Andersan stated that Air. Blakeborough would be missed by the CcUnty Board `anc) that the County Board N6.1l.make the appointment at the next session. - 4 - Superv. Pierson announced that the Law Enforcement P,"Ierger Study Committee had sent questionaires to 6 Counties and the responses have been received. The Committee will go over the results at a meeting they have scheduled for June 30th at 9:30 A.M. till noon. Chairman Anderson congratulated the Committees for their diligent work. Superv. Day informed the Board that Jane Rusch, Addressograph Operator and Tax Lister has retired. Motion by Superv. Sias, 2nd by Superv. Swanson to adjourn at 11:30 P.M. "lotion carried. Superv.
