ST. CROIX COUNTY BOARD OF SUPERVISORS
Regular Session October 9, 1990
Board of Supervisors called to order at 9:00 a.m. by Chair
Peterson. He announced meeting has been properly published and
welcomed guests and the press. Invocation given by Pastor
Russell Paulson, First Baptist Church, New Richmond. Pledge of
Allegiance was recited.
Roll call by Clerk: 29 present, 2 absent - Karen Bailey and
Milton Meinke, both excused.
Motion by Supr. Grant, 2nd by Supr. Wallace to approve minutes as
corrected on page 3, paragraph 2, add after a wheel tax "before
raising property taxes." Carried. Motion by Supr. Malick, 2nd
by Supr. Bradley to adopt agenda after adding another first
reading in regard to Reducing Number of Committees. Carried.
Next meeting will be October 23.for budget hearing only.
ANNOUNCEMENTS AND APPOINTMENTS
County Clerk read Proclamation of Red Ribbon Weeks October 13-28,
1990 in regard to prevention of drug and alcohol abuse.
Chair Peterson appointed Supr. Oemichen to the WESTCAP Board of
Directors. Motion to approve by Supr. Stephens, 2nd by Supr.
Rebhan. Carried. (Ray McCarthy, previously appointed, was unable
to serve.) In response to recommendation from County Planner
Dave Fodroczi, Chair Peterson appointed the following to the Land
Information Committee: Sue Nelson, James O'Connell, Ruth Nelson,
Bruce Brantner, John Krizek (ex-officio), Marguerite
Kobylarczyk, Dave Fodroczi, Tom Nelson, Jim Janke, Al Bentley,
Bruce Callen, Catherine Benoy, Jim Rusch, Chuck Christenson and
Inge Bleier. Motion to approve by Supr. Hop, 2nd by Supr.
O'Connell. Carried.
OLD, UNFINISHED AND NEW BUSINESS
Ordinance #256 90 : Rezoning from Agriculture to Commercial for
Andrew Rudesill. Motion to adopt by Supr. Dorsey, 2nd by Supr.
Stephens. Carried.
Ordinance #257 90 : Rezoning from Residential to Commercial for
Kraig Krampert. Motion to adopt by Supr. Dorsey, 2nd by Supr.
Oemichen. Carried.
Ordinance #258 90 : Rezoning from Ag. Residential to Commerical
for Keith Knudtson. Motion to adopt by Supr. Dorsey, 2nd by
Supr. Oemichen. Carried.
Resolution #26 90 : Approving Cemetery Plat, Town of Cylon.
Motion to adopt by Supr. Dorsey, 2nd by Supr. Stephens. Supr.
Dorsey explained this is an expansion to Calvary Cemetery located
near Deer Park. Motion carried.

Town of Troy Ordinance: Supr. Dorsey commented that amendments
have been added to the original ordinance which have not been
reviewed by the Comprehensive Zoning, Planning and Parks
Committee. He recommended action on this at the November County
Board Session. Board concurred.
Town of Hudson Waste Disposal Ordinance: Letter from Town Board
was read requesting withdrawal of ordinance at this time.
Discussion on County -wide Waste Disposal Ordinance. Corporation
Counsel Timmerman is not ready to propose a county ordinance at
this time. Supr. Kinney said it is difficult to write one to
cover the entire county. Supr. Malick urged the Zoning Committee
to take the Troy and Hudson models and promptly write a county-
wide ordinance dealing with this urgent topic. He also urged the
Committee to gather and disseminate information on the state laws
and regulations which currently exist. He noted for the record
that many supervisors were nodding in agreement. Chair asked
Corporation Counsel to help develop this plan.
Supr. Oemichen explained reasons for delay on Troy ordinance.
The Troy Town Board met with the City of Hudson staff and the
amendments and misconceptions need to be clarified. He also
agreed a county -wide ordinance is needed and Town of Troy is
committed to revoking their ordinance when a county one is
developed.
Resolution #27 90 : Disband Economic Development Committee.
Chair Nyland explained the committee had completed its mission
and less than 20% of the communities in the county were willing
to support a county wide program. Extension Resource Agent Jim
Janke said some effort should be continued as some communities
may want future help and he is willing to take some of this
responsibility and would report to the Ag. and Extension
Committee.
Motion by Supr. Stephens, 2nd by Supr. Malick to disband
committee. Motion by Supr. Stephens, 2nd by Supr. Sinclear to
amend motion by adding "and that dissolution not occur until new
Committee is appointed based on recommendations of General
Services." Amendment carried. Motion carried.
Resolution on Night Committee Meetings: Motion to adopt by Supr.
Oemichen, 2nd by Supr. Malick. Supr. Oemichen stated it is
difficult for full time workers to be able to be on County Board
when most committee meetings and board sessions are held during
the day. Supr. Garske said the resolution has merit but hasty
decisions may be made at late night meetings. Many of the day
meetings are lengthy. General Services Committee recommended
each committee poll their members and a majority vote could
change the schedule. Supr. Luckey stated we have lost some good
Supervisors due to mostly day scheduled meetings. She has also
heard criticism from the public regarding not being able to
attend meetings during the day.

Several amendments were made to the resolution but no action was
taken. Motion by Supr. Stephens, 2nd by Supr. Malick to postpone
action on the resolution and return it to General Services for
further modification and recommendation. Motion carried.
Rules and Regulations: Chair Garske reported General Services
Comm. recommends resolutions be brought to Administrative
Coordinator for review and an impact statement be sent at least
seven days before the County Board meets. This resolution then
becomes a first reading at the next County Board session. Admin.
Coord. Krizek replied a more practical solution would be to have
a first reading, then an impact statement, if warranted, sent 7
days prior to the next board meeting when action would be taken
on the resolution. Chair Garske agreed on behalf of the
committee to this arrangement.
Administrative Coordinator's Report: John Krizek outlined the
1991 budget which is a record of what we are planning to do in
1991. The total figure is $30,000,000. The zero mill rate
increase does not mean there is no room for growth. There is an
increase from increased evaluation and more shared revenues. The
Finance Comm. realigned $325,000; $200,000 restored to the
Highway Budget and $125,000 put in the contingency fund in
anticipation of increased energy costs. Krizek described the
index and tab system in the budget book and gave an overview of
budget and cuts made. Krizek said Supervisors were welcome to
call either he or Finance Director Rich Loney if they have any
questions. Supr. Bradley expressed his compliments and
appreciation to John Krizek and Rich Loney for their fine work
with the 1991 budget. Applause by Board.
Legislative Report: Chair Stephens said committee is waiting for
vote on referendum regarding State mandates and State funding.
Following that vote, the Committee will proceed to contact the
Legislators.
Emergency Resolution #28 90 : Increasing County Imposed Fees
for Solid Waste Disposal to $40 for in county and $45 for outside
county. Motion to adopt by Supr. Stephens, 2nd by Supr.
O'Connell. Solid Waste Comm. Chair Willink said the committee
has already implemented a 75% increase and gave advance notice to
the haulers in order for them to pass the increase on to their
customers. The Solid Waste Comm. opposes the resolution and
urged the Board to ask for more next year. Hauler John Murtha
said it is hard to accept another $5 increase and urged phasing
into another increase next year. Murtha said rural residents
will refuse to pay and burn or dump in ditches. A representative
from Johnson Sanitation said fuel prices are also causing
haulers' rates to be increased.
Supr. Stephens believes in user fees and these should be assessed
to people who use the services. Supr. Kinney did not concur with
Solid Waste Comm. on not raising the fee. He stated, "Let the
people know what services cost through user fees and not hide

costs of services." Supr. Willink said we are working towards
user fees but feels the county can subsidize somewhat. He
contended that user fees are not used for everything such as law
enforcement, recycling and parks. Supr. Draxler said the county
does subsidize the waste -to -energy facility with over a million
dollars. Supr. Dorsey agreed with Supr. Willink and added that
with the increased fuel costs to haulers the County does not need
the extra $5 to balance the budget.
Solid Waste Coordinator George Hayducsko compared tipping fees of
other counties - Barron charges $27 and $40 and Washington and
Ramsey County fees are $49. Hayducsko said tipping fee is only
half of the haulers cost. He also does not want to see garbage
dumped along roadsides. Supr. Brown said the costs should be
more equitable; if the tipping fee is not increased the
$152,000 will be paid in taxes by land owners and farmers.
Roll call vote on resolution: 21 yes, 8 no. Motion carried.
Emergency Resolution #29 90 : Requesting Amendment of Wisconsin
Act 335. George Hayducsko explained that Recycling Grants are
available but Act 335 contains a clause that subtracts "avoided
disposal costs" from the grant. If the county were to achieve a
goal of 25% recycling, we would be penalized in grant money. The
better job you do in recycling the less grant money you receive.
Supr. Wallace moved to adopt resolution that would eliminate the
phrase "less any avoided disposal costs," 2nd by Supr. Rebholz.
Motion carried.
Motion by Supr. Stephens, 2nd by Supr. Jensch to dispense with
first readings. Carried. Chair referred first reading on
reducing number of committees to General Services.
WCA Convention Reports: Supr. Giese attended a Recycling
workshop at which Pierce Co. explained their program which
includes the county picking up and marketing recyclables. Giese
also toured the mock up jail planned for Milwaukee County and
City. Supervisors Bradley, Barker and Malick and Chair Peterson
also shared convention experiences.
Solid Waste Committee Report: Corporation Counsel Timmerman gave
an update on the ARR law suit. Attorney for the County Tom Bell
is in the process of answering the claim and filing a counter
claim. Solid Waste committee is working to implement the Dispute
Resolution Committee which consists of one person from the
county, one from ARR and a neutral party.
Solid Waste Coordinator Hayducsko reported the DNR had contracted
with Waste Depot Inc. to shred tires in the Somerset tire pile.
He is working on a plan to contact garages and households in St.
Croix Co. and possibly get rid of more tires at a cost of $1.00
per tire. A performance test on the incinerator is now in
progress.

County Planner Fodroczi said we need to be cautious and
deliberate in regard to the Recyling Law and determining what the
costs to the county will be.
Government Center Report: Chair Malick announced the firm of
Ayers and Associates have been contracted as architects for the Design
Plan at a cost of $125,000. The Committee plans to hire a
Construction Representative and a contract is being developed
with Sherm Peterson for this position.
Farmland Preservation: Extension for 25 years have been
requested by Andrew and Ruth Tollefson, Hazel Peterson and Mari
Jane Cernohous. Motion to refer to Land Conservation Committee
by Supr. Willink, 2nd by Supr. Dull. Carried.
Mileage and Per Diem: County Board Mileage and Per Diem for the
month of September 1990 totaled $8,046.43. Motion to approve by
Supr. Stephens, 2nd by Supr. Rebhan. Motion carried.
Announcements: County Clerk reported that the City of Hudson is
still making parking permits available for Board members and on
Saturday, October 13 a Pig Roast will be held for Board member
Milton Meinke at the Somerset Town Hall, 7:00 p.m. Nelson
announced she had been appointed County Clerk one year ago and
thanked the Board members for the opportunity.
Supr. Nyland stated he objected to campaign materials being
distributed on Supervisors' desks.
Motion to adjourn by Supr. Malick, 2nd by Supr. Rebhan. Meeting
adjourned at 12:29 p.m.
