CROIX COUNTY BOARD OF SUPERVISORS Regular Session January 16, 1996 Chair Boche called the meeting to order at 9:00 a.m. Invocation was given by Father Jim Brinkman, St. Anne's Catholic Church, Somerset. Pledge of Allegiance was recited. Roll call: 26 present, 5 absent including Vern Dull, John Bradley, John Finn, John Breault and George Sinclear (all excused). Sinclear arrived at 9:30 a.m. making 27 present, 4 absent. Motion by Supr. Bailey, 2nd by Supr. Grant to approve the November 21, 1995 minutes. Carried. Motion by Supr. Oemichen, 2nd by Supr. Burke to adopt the agenda. Carried. Next meeting is March 19. Appointments: Chair Boche appointed Wanda Viellieux to the Long Term Support Planning Committee and re -appointed Parnell Pederson to the Indianhead Federated Library System. Western ITBEC appointees are Luis Sanchez from Doboy Packaging, New Richmond and Duane Bakke, Nor Lake, Hudson to the Foreign Export Committee; Barb Polfus, New Richmond Chamber of Commerce to the Tourism Committee. Conservation Speaking Winner: Supr. Art Jensen introduced Shannon Marr, the Jr. Division winner, who gave her speech on Pollution. Shannon is from River Falls Elementary and the daughter of Sharon Marr and Richard Marr. Applause by Board. Judges' Report: Judge Eric Lundell and Judge Scott Needham explained a new Small Claims mediation program they hope to have up and running by March 1. Small Claims limit has increased to $5000 and this creates more complicated cases. Eau Claire County has implemented a program using volunteer mediators (most retired persons) and they have been successful in settling about 750 of their cases. A training session is scheduled for January-30, 12:00 noon in the Community Room at the Government Center and Lundell invited anyone interested to attend. Needham noted these are non -attorney cases and if a settlement is reached that day, people do not have to return to court and go through the formality of a trial. These situations can be highly emotional and hopefully clients will feel they are treated fairly when settlements are resolved through negotiations. If either party objects to a mediator, a trial date is assigned in 60 to 90 days. In answer to Supr. Giese's question on liability, Judge Lundell believes mediators would have the cloaking of judicial immunity. Resolution #1 (96): Accepting Development of a Nonpoint Source Water Pollution Abatement Program Kinnickinnic River. Motion by Supr. Dorsey, 2nd by Supr. Jensen to place on the floor. County Conservationist Chuck Christenson stated this resolution authorizes the development of a watershed plan and introduced Dan Simonson from DNR. Simonson explained a grant has been offered to both Pierce and St. Croix Counties and a county government entity has to accept the offer and should be in support of the project. Two of the goals of Priority Watersheds is to protect high quality water in developing areas and control non point source pollution; After the plan is developed (usually takes two years) , it is brought back 1 I I to the County for approval. The grant amount for the first year is $134,000 divided between the two counties. The counties must apply each year for the grant. Motion by Supr. Raymond, 2nd by Supr. King to adopt the resolution. Carried. Work - Not Welfare Program: Pierce County Health and Human Services Director Dale Mehlstrom outlined the "Work -Not Welfare" program which is designed to make people responsible for themselves. Welfare clients had to sign a contract regarding training and orientation. Mehlstrom noted when the program began, some clients went directly to work and others were too shy or bashful to apply for a job. There were 219 cases at the beginning of the program; after one year the caseload is 90. Clients are starting at an average wage of $7.19 per hour and they receive Medical Assistance and Child Care paid for one year. Working parents have a more positive effect on their children who can now say their Mom and/or Dad has a job. Mehlstrom said the media is trying to prove this program is hurting people but no complaints have been received from the people who now have jobs. He is disappointed the program will end in 1996 to make way for the new W-2 jobs program. People on welfare need stimulation to get jobs and the savings in Pierce County has been $59,000 per month. St. Croix County Health and Human Services Director John Borup and Economic Support Supervisor Marilyn Fruit explained the Work First program implemented in the county. In December 35% of applicants have been diverted from applying for AFDC and so far in January 610 were diverted. Fruit outlined Benefit Caps, JOBS Program requirements and Pay for Performance. Resolution #2 (96): Authorizing the Submittal of a State Grant Application and Subsequent Appropriation of County Funds for a Tire Collection Program. Motion to adopt by Supr. Horne, 2nd by Supr. Jacobson. Waste Management Chair Horne explained this resolution gives us grant money to conduct a waste tire collection throughout the county this spring. Carried. Ordinance #386 (96) : Rezoning Land from Ag. Residential to Commercial for Larry K. and Karen D. Peterson. Motion to adopt by Supr. Dorsey, 2nd Supr. Menter. Carried. Ordinance #387 (96): Rezoning Land from Ag. Residential to Commercial for Aaron Bazille. Motion to adopt by Supr. Dorsey, 2nd by Supr. Menter. Carried. Ordinance #388 (96): Rezoning Land from from Ag. to Ag. Residential for Margaret Orf. Motion to adopt by Supr. Dorsey, 2nd by Supr. Oemichen. Carried. Resolution 3 (96): Correcting Resolution Approving Town of St. Joseph Zoning Map. Motion by Supr. Dorsey, 2nd by Supr. Menter to adopt. Dorsey advised the County Board had approved a zoning map in April of 1995 for the Town of St. Joseph but there was an error in the map. The County Board needs to approve a correct map which 2 shows the Harold W. Carlson property of approximately 6 acres zoned as industrial rather than commercial. Corporation Counsel Timmerman said from 1979 to 1994 the Town of St. Joseph has tried to document past zoning of its property. In December, 1994 the County Planning and Development Committee held meetings to determine zoning. New evidence showed the land was previously zoned Industrial. The County Board of Adjustment noted the use of this parcel has been industrial for the last 30 years and the land is assessed as manufacturing. Supr. Luckey introduced St. Joseph Town Board Supervisor Paul Nasvik who referred to a letter from former District Attorney Eric Lundell. This letter stated the 1961 zoning map would stand until a new one is developed. Nasvik thinks the resolution is incorrect and there should be an amendment to the map, not a correction. Carlsons' Attorney Ed Vlack stated a 1974 map shows this parcel to be zoned industrial and the error needs correction. Supr. Luckey, representing part of the Town of St. Joseph, stated she was not present last April when the Board approved the Town of St. Joseph zoning map. However, other property owners believe this Board action did rezone property and are following those guidelines. Scot Fogelberg, St. Joseph Town Board Supervisor, also disagreed with the correcting resolution. Timmerman said most of this controversy relates to the fact that the St. Joseph Town Board does not wish to make any provision for industrial zoning in their zoning map. Roll call vote: 25 yes, 2 no. Motion carried. Rezoning from Aq. Residential to Commercial for Wastebusters Disposal Service and Frieda Sampair Estate: Motion by Supr. Sinclear, 2nd by Supr. Jacobson to deny. Supr. Dorsey explained the purpose of rezoning would be to use this parcel as a waste disposal and dumping station. The Town Board and Planning and Development Committee denied this rezoning request. Supr. Filipiak questioned if it was appropriate to deny this request based on intended use. Motion by Supr. Oemichen, 2nd by Supr. Krueger to amend the ordinance to read in the THEREFORE, BE IT ORDAINED by the St. Croix County Board of Supervisors, meeting in regular session that it "denies" the parcel is now rezoned from Ag. Residential to Commercial. Amendment carried. Ordinance as amended carried. Re- zoning was denied. St. Croix Economic Development Corporation: Supr. Oemichen announced Director David Piggot is leaving to work for the East Metro Development Corporation and introduced Paula Stolp, member of the Economic Development Corporation. Ms. Stolp indicated the Corporation is considering a potential merger with Pierce County Economic Development. The advantages would be more depth of staff, elimination of duplication (the two Counties already share rides, booths at shows and prospects) and a merger would provide. a regional concept. A search team is being formed to find a new director in case the merger is not completed. Suprs. Brown and Nyland favored the merger; Suprs. Giese and Oemichen were opposed. 9 Ordinance #389 (96) and Ordinance 390 (96): Establishing a Primary and Secondary Development Moratorium for Lands Within and Adjoining a Major Transportation Corridor. County Planner Dave Fodroczi stated the State of Wisconsin is designing major transportation improvements along State Highways 35 and 64. A moratorium is needed to allow time to complete studies, make plans and adopt ordinances to provide for orderly development along this corridor. One Ordinance applys to lands located in anticipated right-of-way to STH 35 and 64 from the St. Croix River to New Richmond and the other applys to lands within 1,000 feet of the anticipated right- of-way. Motion by Supr. Raymond, 2nd by Supr. Sinclear to adopt. Carried. Ordinance #391 (96): Amending County Zoning Ordinance Sections 17.18, 17.19, and 18.16 relating to Commerical and Industrial Districts and supplemental design and improvement standards for commerical and industrial subdivisions. Motion to adopt by Supr. Dorsey, 2nd by Supr. Menter. Both Corporation Counsel Timmerman and Zoning Administrator Tom Nelson said the amendments eliminate permitted uses in commerical districts and would require going through rezonement and'then Board of Adjustments as a special exception. Motion by Supr. Standafer, 2nd by Supr. Horne to table until March meeting. Show of hands: 7 yes, 20 no. Motion failed. Supr. Oemichen stated the old Zoning Ordinance is archiac and a temporary ordinance is needed for Board of Adjustment until revisions to the present ordinance are completed. Supr. Horne made comments on the proposed changes and believes government is in a "taking" mode. He questioned why more ordinances are needed for someone to enforce. (Suprs. Jacobson, Bethke and Sinclear were excused at noon.) Tom Nelson replied the Town of Hudson is not under this ordinance. Only Towns under County Zoning will be affected. Resource people, such as the County Highway Dept., will be needed to determine how to meet some of the requirements. After more discussion, Supr. Brown suggested sending this back to the committee. Supr. Dorsey said Planning and Development has worked many hours on these revisions. Town Boards requested this review of all uses of property as they want control of what they get and where they get it. Motion by Supr. Brown, 2nd by Supr. Mortensen to send this Ordinance back to Planning and Development. Supr. Oemichen disagreed with the motion commenting that the committee would do nothing further. Supr. Raymond said within the next 18 months the revised Zoning ordinance should be ready. Motion failed to send back to committee. Roll call vote: 18 yes, 6 no. Ordinance adopted. Oral Reports: Chair Boche excused those scheduled for reports. 91 Ordinance to Rezone from Exclusive Aq to AcT. Residential for Steve Halleen: Motion by Supr. Dorsey, 2nd by Supr. Oemichen to deny rezoning. Motion by Supr. Dorsey, 2nd by Supr. Oemichen to amend ordinance to read "County Board denies the parcel is rezoned from Exclusive Ag. to Ag. Residential." Carried. Ordinance as amended carried. Committee Reports: Waste Management Chair Horne said due to the closure of the incinerator case, about $380,000 of unspent funds from the 1995 Waste Management budget will be returned to the General Fund. It is anticipated the $150,000 budgeted for litigation in 1996 won't be used. Horne recommended the Waste Management committee be disbanded in April when the new Board is sworn in and recycling and recycling education be placed under the Resource and Education committee. Mileage and Per Diem: Motion by Supr. Oemichen, 2nd by Supr. King to approve total of $6,047.97 for November and $5,010.46 for December, 1995. Carried. Farmland Preservation: Motion by Supr. Oemichen, 2nd by Supr. Giese to send application of Francis and Susan Klatt and the Klatt Family Trust to the Land Conservation Committee. Carried. Correspondence: Letters have been received from Representative Sheila Harsdorf and Governor Thompson regarding the Snow Plow Liability resolution. Thank yous were read from former County Clerk Verna Stohlberg's family for the plant and from County Clerk Sue Nelson for the plant, cards and memorials in memory of her father. Other: Supr. Giese requested a detailed Financial Report; Krizek said one will be given at the April session when the 1995 books will be closed. Motion to adjourn by Supr. Oemichen, 2nd by Supr. Bailey.
