ST. CROIX COUNTY BOARD OF SUPERVISORS
Regular Session May 21, 1996
Meeting called to order at 7:00 p.m. by Chair Boche. Guests and the
press were welcomed. Father John Rasmus, St. Paul's Episcopal
Church, Hudson, gave the invocation. Pledge of Allegiance was
recited.
Roll call: 29 present, 2 absent - Tom Irwin and Chris Bethke (both
excused) .
Motion by Supr. Bradley, 2nd by Supr. Giese to adopt the April 16
minutes. Carried. Next meeting is scheduled for June 18; meeting
is tentative depending upon number of agenda items. Motion by
Supr. Giese, 2nd by Supr. Oemichen to adopt the agenda. Carried.
Administrative Coordinator: John Krizek reported the PBX phone
system was installed on May 3 and now the "bugs" are being worked
out. The number of lines was reduced from 100 to 55 and a payback
is expected in two and one-half years. Krizek thanked Bruce
Brantner and other team members for their work on this project. The
Information Services Committee is having new cabling installed in
Health and Human Services. Krizek asked Corporation Counsel
Timmerman for an update on the Junker Landfill situation.
Timmerman stated the State DNR and the Attorney General first
negotiated with Junker Landfill Trust for clean up of the Junker
Landfill. Jim Junker also met with the State and was awarded a
consent decree which makes the Jim Junker Group responsible for the
clean up. The Junker Landfill Trust had filed a suit against 800
users of the landfill including St. Croix County and the future of
this suit is tentative. The Jim Junker Group may file a suit but
no Notice of Claim has been served yet.
Timmerman maintains whoever files a lawsuit must prove a user
dumped hazardous waste and he does not believe the 1965 Courthouse
disposed of any such waste.
Krizek continued his report by noting WMMIC (the county's insurance
carrier) had its largest settlement ever since forming. A Judge
awarded $950,000 in a shooting incident in Dodge County at which
Deputies were found at fault for not having the safety on their
guns and their finger off the trigger.
The KIDS program will be implemented August 1 in the Clerk of
Courts and Child Support offices.
Election of Finance Committee Member: After a recount of the April
election, one candidate did not receive a majority vote. Chair
Boche advised if any remaining candidates had been elected to a
committee, they would have to resign in order to be a candidate for
the Finance Committee. Both Herb Giese and Daryl Standafer

withdrew their candidacy and Ron Raymond had withdrawn previously
by letter. Votes for the two remaining nominees were John Bradley -
20 and Tom O'Connell - 9. Supr. Bradley thanked the Board for
their support.
Resolution #10 (96): Authorizing Exchange of Parcels Between St.
Croix County and the City of Glenwood City. Timmerman reviewed the
agreement which was approved after the City of Glenwood, Super Valu
representatives and the Fairboard negotiated. The City of Glenwood
wishes to exchange the land and then sell it to Brian Ormson who
will build a new grocery store. An overhead map was used to show
the land to be exchanged. Details of the exchange were outlined
including $6500 payment to the County from Glenwood City and
provision of approximately 650 yards of gravel to increase fair
parking on the north side of the Fairgrounds.
Motion by Supr. Berenschot, 2nd by Supr. Jensen to adopt the
resolution exchanging parcels. Carried.
Supr. Mehls was excused at 7:30 p.m.
Ordinance #398 (96) Amending Section 17.29, St. Croix County Zoning
Code, Filling and Grading In or Near Navigable Bodies of Water:
Motion by Supr. Dorsey, 2nd by Supr. Menter to adopt. Timmerman
explained the Highway Department will submit a list of practices
and will be given a license to allow them to complete projects near
navigable bodies of water. Motion carried.
Oral Reports: Emergency Government Director Jack Colvard reported
damage figures from the recent wind storm with a total estimate of
$2,774,300. He noted this could increase by another $300,000 to
$350,000. Estimates were based on individual homeowner estimates,
insurance appraisals, Consolidated Farm Service estimates, Red
Cross and Emergency Government estimates.
Supr. John Mortensen, also affiliated with the Red Cross, was
relieved there were no deaths and very few injuries from this
storm. Officials are working with DNR to get a special release for
disposing of construction materials.
Register in Probate report was given by Deputy Registrar in Probate
Sue Gary. County Clerk Sue Nelson submitted a written report.
Resolution #11 (96): Designating June 1996 as "Dairy Month" in St.
Croix County. Motion by Supr. Oemichen, 2nd by Supr. Mortensen to
adopt. Carried. Oemichen reported a Federal Judge has ruled the
present dairy pricing policy is arbitrary and capricious which is
a good ruling for dairy farmers.
Resolution #12 (96): Opposing Removal of Mound Pond Dam. Motion
by Supr. Jacobson, 2nd by Supr. Raymond to adopt. Raymond stated
if this dam is removed, all the water would drain and wetlands

would be lost. Supr. Giese reported a recent article which said a
majority of the people at a hearing want the dam removed and he
questioned if the county should be taking sides.
Supr. Horne commented the Board needs to support the resolution.
Most of the people at the hearing were trout fisherman who were in
favor of dam removal which would create a good trout stream. Chair
Boche noted there is $700,000 difference between removing and
repairing the dam. He questioned why the DNR would continue to buy
more wetlands and why they would want to destroy this wetland area.
Vice Chair Dorsey indicated more hearings should be held. Motion
to adopt carried.
Ordinance #399 (96): Rezoning from Ag. to Ag. Residential for Jon -
De Farms, Inc./Todd Doornink. Motion to adopt by Supr. Dorsey, 2nd
by Supr. Menter. Carried.
Ordinance #400 (96): Rezoning from Agriculture to Ag. Residential
for Wm. and Lois Sommerfeldt. Motion to adopt by Supr. Dorsey, 2nd
by Supr. Sinclear. Carried. Motion by Supr. Oemichen, 2nd by Supr.
Kreuger to reconsider this Ordinance and the legal description.
Carried. There was discussion regarding the amount of land to be
rezoned. Motion by Supr. Oemichen, 2nd by Supr. Bradley to make a
friendly amendment noting that 1.84 A. was to be rezoned rather
than 118.3 A. Ordinance as amended carried. (Note: See June 18,
1996 minutes for further corrections.)
Resolution #13 (96): Approving Amendment of the Town of Hudson
Zoning Ordinance, Section 2.9. Motion by Supr. Dorsey, 2nd by
Supr. Horne to adopt. Carried.
Committee Reports: Supr. Horne commented he could not understand
the LEPC minutes because too many acronyms were used. Supr. Giese
noted several committees are very late with minutes.
Mileage and Per Diem: Motion by Supr. Oemichen, 2nd by Supr. King
to approve a total of $8,369.50 for the month of April. Carried.
Announcements: County Clerk Sue Nelson advised Supervisors of the
Inter County Meeting on June 7 in Eau Claire County. Please
register with her by May 29 so rides can be pooled. The American
Legion Annual Golf Tournament is scheduled for June 5 at the
Hammond Golf Course. Revenues are used to sponsor kids attendance
at Twins Games, Shrine Circus, other events and recently an $800
donation was given to the Library for paperback books to be given
to children attending the Reading Festival. For more details,
contact Supr. Charlie Grant. Clerk Nelson thanked Supr. King for
his help in collecting for the flower and refreshment fund.
Correspondence: Clerk read a letter from Tom Bell, President of
the Bass Lake Rehabilitation District, who commended Pete Kling,
project manager for the Lake Cluster group, for his fine work.

Legislative Report: Representative Sheila Harsdorf outlined some
of the issues passed by the Legislature. Funding property tax
reform to fund schools with $1.2 billion and not raising income or
sales tax was a big item. Funding was obtained by a 5 to 100 cut
in state agency budgets. Program changes are not as easy or
popular such as the major reform of welfare to the W-2 program.
Harsdorf said people and communities need to work together to get
people off welfare.
Protective Childrens' Services will no longer focus on keeping a
child in the home but rather deal with the best interest of the
child. A Medical Savings Account was legislated which gives a
person the option of purchasing a high dollar deductible medical
plan and putting money in a savings account for usual medical
costs. This will not take effect until January 1997 or until
Congress passes a bill relating to medical savings accounts.
Other items legislated were a College Prepayment program which does
not require a large investment at one time, Trespass Law which does
not require land to be posted, inmates paying medical expenses and
stopping infestation of zebra mussels in the St. Croix River.
Supr. Brown asked if the Legislature would impose budget
limitations to counties. Harsdorf said the mill rate limit would
be in effect but did not know if other limits would imposed.
Motion by Supr. Oemichen, 2nd by Supr. Giese to adjourn. Meeting
adjourned at 9:10 p.m.
