ST. CROIX COUNTY BOARD OF SUPERVISORS
Regular Meeting January 21, 1997
Meeting called to order at 9:05 a.m. by Vice Chair Dorsey. Guests
and press were welcomed. Invocation was given by Pastor Michael
Girolimon, First Presbyterian Church, Hudson. Pledge of Allegiance
was recited.
Roll call: 26 present, 6 absent including Gerald Peterson, Robert
Boche, Chris Bethke, John Bradley, Nancy Bieraugel and Einar Horne
(all excused) .
Motion by Supr. Berenschot, 2nd by Supr. Jacobson to adopt the
agenda. Carried. Motion by Supr. Sinclear, 2nd by Supr. Raymond
to approve the December 17, 1996 minutes. Carried.
Announcements: Kim Reaman, 4-H Youth Agent, announced the new plat
books were available with a new feature of colored maps. The book
is sponsored by the County 4-H Leaders Association and the profits
are used to supplement educational programs for 4-H members and
leaders. Cost of the plat book is $20 which is available at the
County Treasurer's office and UW-Extension Office in Baldwin.
Clerk Nelson reported Chair Boche was back on the respirator for a
few days but was taken off late Monday afternoon and was doing
well. Best wishes were given for a speedy recovery.
Next meeting scheduled for March 19, 1997. No meeting planned for
February.
Administrative Coordinator: John Krizek reported the county may
not get state funds to help with the $200,000 expense of installing
automatic controls for the Lake Mallalieu dam. Automatic lift
gates have been installed at Willow River dam so no notification is
given about high water levels on Lake Mallalieu. The county, along
with the City of Hudson, has applied for a grant. Ownership of
Lake Mallalieu dam is shared with the City of Hudson, the Village
of North Hudson, Town of Hudson and St. Croix County of which the
county owns 50%.
The WI Supreme Court has ordered the State of Wisconsin to pay back
$200,000,000 to the WI Retirement Fund by 1998. This could have
adverse affects on the State Budget in transportation and other
areas. Supr. Jacobson explained several years ago Governor
Thompson wished to increase the pension of some older retirees but
used the retirement fund rather than the general fund. Now the
Court has ordered this money, plus interest, be repaid to the WI
Retirement Fund.
Resolution #1 (97): Requesting the State of Wisconsin Continue
Financial Support to Responsible Units for Recycling After 1999.
Motion to adopt by Supr. Dull, 2nd by Supr. Berenschot. Supr. Dull

indicated this resolution had been revised and asked Planning
Director Dave Fodroczi for comments. Fodroczi stated this
resolution requests the State maintain funding for recycling after
1999 and generate the funding from revenue sources more directly
related to waste such as a tipping fee surcharge. Motion carried.
Resolution 2 (97): Supporting Construction of Stillwater Bridge.
Motion by Supr. Sinclear, 2nd by Supr. King to adopt. Highway
Commissioner Dan Fedderly explained this resolution requests an
audience with Governors and Secretaries of Dept. of Transportation
of MN and WI, Federal agency personnel and representatives of St.
Croix County to determine a course of action to facilitate
immediate construction of the proposed bridge.
Fedderly said the reconstruction of the Highway 64 corridor is
moving along. This is a separate project from the Stillwater
bridge. Supr. Olson commented it would be helpful to have
resolutions signed by sponsoring committees before they are sent.
Motion to adopt carried. Supr. Krueger voted no. Corporation
Counsel requested permission to send this resolution to Minnesota
entities. Motion by Supr. Standafer, 2nd by Supr. Grant to send
this resolution to the Cities of Stillwater and Oak Park Heights,
Washington County, Governor Carlson and the Minnesota Dept. of
Transportation. Carried.
Public Hearing: Vice Chair Dorsey called the Public Hearing to
order at 9:30 AM regarding amending Chapter 18 of the Subdivision
Ordinance relating to Road Construction. Supr. Raymond indicated
this amendment allows for curb and gutter in a housing development
along with storm sewers. The present Ordinance does not allow for
curb and gutter installation; only allows for ditches if
municipality is under county zoning regulations.
Supr. Sinclear said the Transportation Committee supports this
amendment as along as the Town has the final say. Supr. Hense said
Towns need to be aware of maintenance and repair costs because the
county is not responsible for storm sewer drainage.
Vice Chair Dorsey asked for public input; there being none the
public hearing was closed at 9:45 a.m.
Ordinance #"-13 (97): Amending Chapter 18, County Subdivision
Ordinance, Relating to Road Construction. Motion by Supr. Raymond,
2nd by Supr. Menter to adopt. Carried.
Ordinance 412 (97) : Rezoning from Ag. to Ag Residential for Donald
and Debra Potting, Town of Somerset. Motion to adopt by Supr.
Sinclear, 2nd by Supr. Raymond. Raymond explained this is a 40 A.
parcel on which the Pottings will build a home and keep the
remainder in farmland. Corporation Counsel noted the legal
description was incorrect. Motion by Supr. Sinclear, 2nd by Supr.
Gunderson to amend the legal description by removing "a parcel of
land located in." Carried. Ordinance as amended carried.
Ordinance Amending Section 17 36, Lower St. Croix River District,
St. Croix County Zoning Ordinance. Motion to adopt by Supr.
Luckey, 2nd by Supr. Menter. Supr. Hense said this Ordinance
amendment creates a 100' setback from the bluffline. He also said
it allows for building on a landward slope of 120 or greater if a
land use permit is obtained from the County Zoning Administrator.
An additional requirement is for every tree removed, another tree
shall be planted and the pruning description has been clarified.
In answer to Supr. Berenschot's question, Corporation Counsel said
the penalty for non compliance could be $100 to $500 for each day.
Vice Chair Dorsey noted the Public Hearing on this Ordinance
Amendment had been well noticed.
Supr. Brown introduced constituent Bob Rolle who is a member of the
Troy Town Planning Board and Lower St. Croix Task Force Commission.
Rolle missed the Public Hearing for a variety of reasons. He is an
owner on the river and opposes this amendment because it is not
well thought out. He believes the Riverway Act is working well.
He stated there is no need to rush to change the Ordinance without
understanding the implications. He believes this could constitute
a "taking" by the County as it prevents building in some locations
because it requires the 100 foot setback be applied to ravines way
back from the river and may open the County up to liability. Rolle
said this amendment should have a legal review.
Dorsey stated the Planning, Zoning and Parks Committee did not rush
into presenting this amendment; the committee worked on it for
several months.
Corporation Counsel Timmerman advised it is difficult to try to
help a committee and disagree with it at the County Board meeting.
The County should not over regulate, i.e., why should the set back
be 100 feet from the bluffline if the structure can't be seen from
the river at 40 feet back from the bluffline. He agreed some of
the issues brought forth are real and could result in a lawsuit to
the County.
Supr. Gunderson commented some years ago people wanted a National
Park in the county and now the Park has put thumbs down on new
bridge construction. The Ordinance deals with two standards -
incorporated and unincorporated - on the Minnesota side of the
river, which is incorporated, industry, businesses and residences
can build right up to the river. Gunderson asked who we are
protecting the river from and does not think it is right to stop
development on the river bank.
Motion by Supr Brown, 2nd by Supr. Krueger to refer this Ordinance
back to the Planning, Zoning and Parks Committee to review the

questions raised today and get a legal opinion by outside Counsel.
Carried.
Interstate Relocation: Supr. Mehls shared a Norwegian story.
Oral Reports: Reports were given by Finance Director Rich Loney
and Children's Services staff Fred Johnson and Kathy Dunlap.
Written reports were provided by Personnel Director Debra Kathan
and Dept. on Aging Director Sandy Gehrmann.
Farmland Preservation: No applications received.
Mileage and Per Diem: Not presented due to the cancellation of the
January Finance meeting.
Correspondence: Clerk Nelson read a note from Supr. Vern Dull and
wife Vi thanking the Board for the cards, gifts and attendance at
their 50th Anniversary celebration.
Announcements: Supr. Giese requested the Dept. on Aging report be
rescheduled later in the year. Director Sandy Gehrmann recently
had surgery and was unable to do an oral report.,
Motion to adjourn by Supr. O'Connell, 2nd by Supr. Sinclear.
