Dear Ms, Ormstron
I have reviewed the information which you have provided regarding
the septic system which serves your home. The septic was designed
to treat and dispose of the waste generated from a two bedroom home
when the codes required much less absorption area than the current
codes. Because of the increased sizing requirments, your existing
system is undersized for a home of this size. It is my
understanding that you wish to obtain a building permit for an
addition to the house, which is to include adding living room.
Increasing the size of the house increases the number of people who
could potentially live in it. This would cause an increased waste
water load over and above what the system can effectively treat and
dispose of, and may cause a premature failure.
We have no objections to an addition to your home provided two
provisions are met. The first being that an affidavit, which we
will provide, is signed and recorded with this office. This
affidavit basically states that you are aware the septic system
will be undersized for the dwelling after the addition is
completed, and that any future parties interested in purchasing the
property will be made aware of this condition.
The second provision is that the addition must not encroach upon

EXISTING EPTIG SYSTEM AFFIDAVIT
The existing septic system which serves the dwelling being added on
to must be inspected by a licensed soil tester for compliance with
high ground water and/or bedrock separation requirements as set
for in s. ILHR Chapter 83,10(2) WI. ADM, CODE. The results of
that inspection must be made available to this office. If the
existing septic system meets these minimum requirements, and is
properly functioning, an addition may be added to the dwelling
without updating that system. This addition must not, however,
encroach upon the required septic system setbacks as setforth in s.
ILHR Chapter 83-10(1).

Your petition for a variance to section ILHR 83.10 (1). Wisconsin
Administrative Code, has been reviewed. The petition has been approved.
The rule being petitioned requires that a soil absorption system shall be
located at least 25 feet from a below -grade foundation of any occupied or
habitable building or dwelling.
The variance requested was to allow the existing drywall which is located
20 feet from the existing residence and would be located 14 feet from a
proposed addition.
All of the data and statements submitted on behalf of the petitioner were
considered. This variance is specific to the subject petition and cannot be
used for any additional modifications.
