application and supporting documents, the Zoning Administrator will,

Gary:
As I shared with you when we spoke yesterday, I have considered the question of whether anything needs to
be done to address a potential shared driveway requirement for Lot 16 and Lot 17, of the Lundy Meadows Plat.
In examining this situation, for some reason the shared driveways envisioned on the plat (there were supposed
to be 14 lots in that subdivision with shared driveways), have for the most part not been required. Only two
lots in that plat actually have a shared driveway.
You have share with that the Town does not have a problem with an Lot 17 having an individual driveway and
Lot 16, already has an individual driveway. My staff have already issued the Land Use Permit for Lot 17 (on 10-
17-2022). In this instance, we are not going to require the owner to have a correction instrument prepared by
a Land Surveyor to eliminate the shared driveway requirement, but may recommend that they do so.
Even the plat seems to be lacking a specific note regarding the lots that were supposed to have shared
driveways, so there may be a reason why the shared driveways were not required. The plat was filed in 2004
and it seem there is only one shared driveway, and it does not appear that the other lots intended to have
shared driveways were required to have correction instruments prepared by a Land Surveyor filed with the
Register of Deeds. If we make Jeffrey and Nicole Hawes, jump through a bunch of hoops to eliminate a shared
driveway, when, that has not been required of other in the same subdivision, I think they would have reason to
object.
If by chance any of the property owners were to ask for a second driveway, they would need to obtain my
approval and approval from the Town and I think it is unlikely we would grant approval. From a practical
standpoint, I do not see an issue with not requiring preparation and filing of a correction easement to modify
the plat.
