Dear Mr. Pakonen, Community Development staff have approved Land Use Permit Application (File# LUP-2023-051) pursuant to St. Croix Count Zoning Ordinance, Section 15.415, grading and land disturbance to construct driveway and retaining wall on slopes exceeding 12% grade and less than 25% grade. within an R-2 Residential District. Note the following findings of fact and background information pertaining to this approval.
• The requested land use permit is to authorize grading and land disturbance on slopes exceeding 12% grade and less than 25% grade within an R-2 Residential District.
• The driveway access from 210th Avenue has been approved by the Town of Somerset.
• The driveway and retaining wall will be constructed in conformance with plans and specifications prepared by Auth Consulting/associates (AC/a), Sheets C1.0 – C6.1 dated 9/23/2023. These plans and specifications were submitted in preliminary form and labeled for review only and not for constructions. Any modifications made to the plans and specifications for the project for construction purposes will be submitted to the Land Use Administrator for review for conformation with applicable zoning provisions. Based on these findings, approval of the Land Use Permit is subject to the following conditions: 1. Proposed improvements shall be completed will be constructed in conformance with plans and specifications prepared by Auth Consulting/associates (AC/a), Sheets C1.0 – C6.1 dated 9/23/2023. These plans and specifications were submitted in preliminary form and labeled for review only and not for constructions. Any modifications made to the plans and specifications for the project for construction purposes shall be submitted to the Land Use Administrator for review for conformation with applicable zoning provisions.

2. A pre-construction inspection is required to verify structure placement, discuss the project timeline and to verify that erosion and sediment control is installed. It is the applicant’s responsibility to schedule this appointment, please contact Stephanie Haumschild, Land Use Technician I at (715) 381-4400 or stephanie.haumschild@sccwi.gov to schedule this inspection. 3. The proposed grading and construction activity shall not extend beyond the limits indicated on the plans and specifications submitted with the application for LUP-2023-051.
4. No material may be deposited that is classified as a solid or hazardous waste material and must be protected against erosion, by erosion matt, vegetative cover, sheet piling or bulkheading. 5. It is the applicant’s responsibility to secure any other required local, state, or federal permit(s) and approval(s) prior to land disturbance activity.
6. Stormwater management practices will be placed as identified on the approved plans.
7. The Department of Natural Resources shall be contacted for a NR 216 permit if land disturbance equals one acre or greater in size. 8. The supplemental Stormwater Management Agreement (Operation and Maintenance) intended to pertain to the final individual stormwater management of Lot 7, shall be filed with the St. Croix County Register of Deed Office prior to the post construction inspection.
9. St. Croix County reserves the right to require additional sediment and erosion control measures to be installed if found necessary due to site-specific concerns.
10. All temporary erosion control measures shall be left in place and maintained until the site has reached a point of at least 70% permanent vegetation. Permanent vegetation shall be established once final grade is reached or as soon as applicable per plan. \A post-construction inspection is required to close out the permit. It is the applicant’s responsibility to schedule this appointment, please contact Stephanie Haumschild, Land Use Technician I at (715) 381-4400 or stephanie.haumschild@sccwi.gov to schedule this inspection.
11. A Stormwater Affidavit describing the approved storm water management structures/facilities, erosion and sediment control, and vegetative management plans and maintenance requirements is required to be filed with the Register of Deed’s Office within 30 days after construction is completed. 12. Failure to comply with the terms or conditions above may result in the revocation of this permit by the Zoning Administrator according to Chapter 15.

This approval is subject to the conditions listed above; it does not allow for any additional construction, structures, or buildings beyond the limits of this request. Your information will remain on file at the St. Croix County Community Development Department suite. It is your responsibility to ensure compliance with any other local, state, or federal permitting or regulations, including contacting the Town of Somerset to inquire if additional permissions are required. This permit is valid for one year, with the possibility of up to two (2) six-month extensions if the applicant submits the appropriate permit extension fee and documentation to the Zoning Administrator. A copy of the Land Use Permit placard should be submitted to the local Building Inspector for the town upon application for the building permit. The orange placard must be posted on the jobsite and visible from public view. GENERAL APPLICATION REQUIREMENTS
APPTICATION:
Applications will not be accepted until the applicant has:
. Met with the Zoning Administrator to review the application;
. Submitted O ginal plus 2 copies ofthe entire packet including all supporting information, maps &diagrams;
. Resolved any land use violations and paid any outstanding fees owed to the Community Development Department;
. signed the application form (the signotures of the property owners ond ogents octing on their beholf ore required); and
. submitted the appropriate application lee (nonrefundoble) payable to: st. croix county.
REVIEW:
The Zoning Administrator will review the application for completeness and assign a file number to the application. The Zoning
Administrator may require additional information and will notify the applicant of this within 10 days. Upon receiving a complete
application and supporting documents, the Zoning Administrator will:. send copies of the applications to the appropriate reviewing agencies for comment. Applicants are encouraged to
contact their town to discuss their application and inquire about necessary building permits and approvals at the
town level;. schedule a site visit to the applicant's property, at which time the applicant shall flag all applicable property/project
corners and label the flags accordingly; and. review the file and prepare findings for approval or denial of the permit within 60 days. Upon approval, the permit will
be mailed to the applicant or to the applicant's agent.
lf approved, the land use permit will be valid for one year from the date of the permit issuance. The applicant may also be
required to apply through the Town for a local building permit. All site plans, pictures, and other materials submitted with the
application become the property of the Community Development Department and will remain in the file.

The purpose of this summary is to provide a synopsis of the proposed site improvements
located in part of the NW1/4 of the NW1/4 and the SW1,/4 of the NW1/4 of Section2L,and
part of the SEl/4 of the NE1/4 of Section20, all in T31N, R19W, Town of Somerset, St.
Croix County, Wisconsin. The project will consist of the construction of a new section of
driveway from 21,0th Avenue to an existing driveway located on the property.Additional,
improvements will be made to the existing driveway along with site stabilization along
slopes. These improvements will provide access to the property for proposed forestry
management op erations.
The old driveway connection along 21Oth Avenue was obliterated when 2l0th Avenue was
relocated and reconstructed in the Mid - 1990s. The road was elevated at that point and
there is now guardrail along that section of 2l0th Avenue making it necessary for a new
connection point. The new connection point is at the easterly end of the guardrail. The
town has approved the new location and has issued a driveway permit for the connection
to 21,0th Avenue. That portion of the driveway has been installed. The new driveway will go
southwesterly for about 700 feet until it connects with the existing driveway. From there,
the existing driveway will be improved for a distance of approximately 400 feet through a
pinch point created by slopes along the west property line. The proposed improvements
will terminate with a turn-around southwest of this location.
On fanuary 27th,2022, a public hearing was held by St. Croix County Board of Adjustments
for a request of two variances. One variance request was for disturbance of slopes. The
other variance request was for driveway setback. The variance requests were denied.
Field work was completed in the spring of 2023 by Auth Consulting & Associates, Inc., at
this location, to verify the location of the existing driveway, property line and slopes as
opposed to relying on aerial and LIDAR topography data. The survey work is presented in
the proposed plan and confirms that a 12ft wide driveway can be installed, meeting the 5ft
setback requirement, without disturbing 25o/o or greater slopes beyond the existing
driveway corridor.
The new driveway will be constructed with a minimum width of 1,2 feet and a maximum
grade of LZo/o per St. Croix County ZoningChapter 15.405. For the first approximately 475
feet, the driveway will be constructed on slopes of tZo/o to 1.9.99o/o and disturb greater than
1-0,00Osf. A Land Use Permit is required per St. Croix County Zoning Ordinance Ch15.415.
