Community Development Staff has finished the review of the submitted Land Use Permit Application #LUP-2023-
071 for filling and grading less than 70,000 square feet outside of the slope preservation zone and greater than 40 feet
from the slope preservation zone in the Lower Saint Croix Riverway Overlay Distrcit, as required by Section 17.36.F.2.a.
This application has been conditionally approved based on the site plan set, dated December 14, 2023 and the
following findings of fact for the site and the project:
• The project is located in the Town of Saint Joseph and is under general zoning administered by the Town.
• The project is located in the Lower Saint Croix Riverway Overlay District.
• Divine Custom Homes will serve as the general contractor and manager for this project.
• The total extent of the project consists of construction of a driveway from the private driveway known as
1320a Avenue, consisting of a total disturbed area of 9,400 square feet.
• This application does not cover any approval for any other work on this site.
• The submitted planset meets the prescriptive requirements listed in Chapter 17 Lower Saint Croix Rivenvay
Overlay District of the SS Croix County Code of Ordinances, including stormwater management and erosion
and sediment control plans meeting Wis. Admin Code NR 151, subchapter III and DNR technical standards
respectively.
Based on these findings, conditional approval of this Land Use Permit shall be granted with the following:
1) An on -site pre -construction inspection shall be completed by Department Staff after all erosion control
measures and best management practices are in place.
2) An on -site final inspection shall be scheduled prior to the expiration of this permit, once the driveway is
installed and stabilized, and other features shown on the submitted planset are completed.
3) The applicant shall secure all necessary local, state or federal approvals for this project.

4) Any future filling and grading on this site beyond 10,000 square feet shall require a conditional use permit,
as required by Section 17.36.F.3.a.6. Note, the submittal deadline of conditional use applications are on the
first Monday of the month. Complete applications are submitted to the respective town, reviewed by Staff,
and placed on the following month's Board of Adjustment agenda for public hearing and consideration.
5) The permit does not allow for any additional construction of structures or buildings, removal of trees or
other vegetation beyond the limits of this application.
Failure to comply with the standards listed herein shall result in the revocation Of this land use permit and may result
in citiations and issuances of fines pursuant to Section 15.555 Land Use Permits. This permit does not grant any
modifications to property not included in the initial scope as submitted in the application.
This permit is valid for one year, with the possibility of up to two (2) six-month extensions if the applicant submits
the appropriate permit extension fee and documentation to the Zoning Administrator. A copy of the Land Use
Permit placard should be submitted to the towns local Building Inspector upon applying for town building permit(s).
The orange placard shall be posted on thejobsite and visible from public view.
