C R OP( UNITY ORDINANCES LAND USE AND DEVELOPMENT CHAPTER 17 't'[S.O1asin ZONING SECTION 17.72 REZONING AMENDMENTS - CRONK, TOWN OF BALDWIN 1 The St. Croix County Board of Supervisors does ordain as follows: 2 3 WHEREAS, Richard and Brenda Cronk have applied to the St. Croix County Community 4 Development Department to rezone approximately 14.0 acres from Agricultural to Agricultural 5 Residential, and 32.55 acres from Agricultural to Agricultural District Two, all within the NE 1/4 of 6 the NE 1/4, and the NW 1/4 of the NE 1/4 of Section 5, T29N,R16W,in the Town of Baldwin; and 7 8 WHEREAS, the St. Croix County Community Development Committee held a public 9 hearing on the rezoning request on September 19,2013 in Hudson, Wisconsin; and 10 11 WHEREAS, the St. Croix County Community Development Committee considered all 12 written information and verbal testimony presented at the hearing, and made the following findings 13 in support of the request: 14 1. The Town of Baldwin has recommended approval. 15 2. The request is consistent with the St. Croix County Comprehensive Plan and the St. 16 Croix County Natural Resources Management Plan based on: 17 a. The uses will preserve productive soils as identified by the county land evaluation 18 system. 19 b. The proposed uses will minimize the loss and fragmentation of farmland in rural 20 areas. 21 c. The propose uses will limit development and will not convert productive 22 agricultural land. 23 d. The proposed uses are consistent with residential densities of 1 unit/20 acres 24 based on the productivity of the soils as rated by the LESA system. 25 e. The proposed uses are consistent with the County's policy to favor agricultural 26 uses over non-agricultural uses when considering land use conflicts. 27 f. The proposed uses are consistent with the County's policy of agricultural uses to 28 include a broad range of agricultural activities. 29 g. The proposed uses are consistent with the County's policy to establish and make 30 available zoning standards to prohibit major subdivisions in the farmland 31 preservation areas. 32 h. The proposed uses are consistent with the County's policy to prohibit non-farm 33 development on productive farmland. 34 i. The proposed uses are consistent with the goal to protect and improve 3 5 groundwater quality to supply clean water for drinking and recharging surface 36 waters and wetlands. 37 j. Application packets should be collated and either stapled or paper clipped in the upper left-hand corner. All maps, plans, and engineering data must be submitted on paper no larger than 11x17. REZONING PROCEDURE The following process takes anywhere from 60 to 90 days to complete. Step 1,Pre-Application Meeting: Prior to submitting an application the landowner or their agent must schedule a meeting with County Community Development Department staff to discuss the application and the process. Since Towns have statutory authority to disapprove of a rezoning request, applicants are encouraged to also meet with Township officials prior to submitting an application to the County to ascertain their level of support for the request. Step 2,Application Submittal and Review: Applications are due on the 1st Monday of the month. Applications will not be accepted if the applicant has not met with staff prior to submitting an application. The application must include all items identified on the checklist. After a preliminary review, additional information may be requested. Once it has been determined that all requested information has been obtained the application will undergo an interdepartmental and interagency review. This review includes notification to the Town in which the request takes place. Step 3,Town Review and Comment: As identified in Step 2,the interagency review process involves notification to the applicable Town for their consideration and comment. Under Wisconsin State Statute § 59.69 Towns have the authority to disapprove a rezoning request before the County Board. While individual Towns may have different processes for review and comment back to the County, all Towns will likely place the rezoning request on an agenda for discussion and recommendation by their Town Board. The applicant should follow this process closely and ensure that the issue is placed on a Town agenda and a resolution supporting the request is forwarded to the County in a timely manner. Approval by the County is difficult to obtain without formal Town support. Step 4,Public Hearing: All rezoning requests must undergo a public hearing before the St. Croix County Community Development Committee. A notice of the hearing is published in local newspapers for 2 weeks prior to the scheduled hearing date. Notice of the hearing is also sent to all adjacent property owners. Hearings are typically held on the 3`d Tuesday of the month(subject to change) in Hudson or Baldwin following completion of the interdepartmental and interagency review. Step 5, County Board Approval: Upon approval by the Community Development Committee, a recommendation is forwarded to the County Board for action at their next regularly scheduled meeting. Once approved by the County Board the rezoning is complete,pending any conditions that may have been placed on the approval. Page 2 of 3 • REZONING QUESTIONAIRE 41) Ail rezonings are to be consistent with County land use plans,County ordinances and other applicable local plans. Your application will be reviewed by staff and presented to the County Community Development Committee for consistency with the following ordinances and plans: St. Croix County Zoning Ordinance(Ch. 17), St. Croix County Land Division Ordinance(Ch. 13), St. Croix County Sanitary Ordinance(Ch. 12), St. Croix County Comprehensive Plan, St. Croix County Outdoor Recreation Plan and the St. Croix County Land and Water Natural Resources Management Plan. It is the applicant's responsibility to show that their proposed use is substantially consistent with these ordinances and plans. Each ordinance and plan is available for review by contacting the Community Development Department or on the County website at www.co.saint-croix.wi.us. To assist in determining how your proposed use relates to the aforementioned ordinances and plans,please answer the following questions on a separate sheet of paper and include them with your application materials. 1) Explain why you wish to rezone this property. We have sold our house and outbuildings and it is necessary to comply with Baldwin Township ordinances to rezone from Agriculture to Ag-Residential. The new owners of the property will have 14 acres and they intend to have a few 4-H steers and heifers on the property. 2. Explain the compatibility of your proposed use with uses on existing properties in the vicinity of this site. We currently live on the property and raise heifers. The new owners have the same intentions and therefore the proposed use will not change at all. 3. Explain any interaction that you have had with the Town in which this property resides and elaborate on any concerns they many have with your request. We are currently on the Town Rezoning Board agenda for August 5th and the Town Board meeting for August 8th to present our rezoning request. We have talked to two Town Rezoning Board members and they don't anticipate any problems. 4. Explain how the proposed use will affect stormwater runoff, wetlands or shoreland areas. We currently have heifers on pasture land and we follow a Nutrient Management Plan developed by Popple Consulting in Osseo, WI. The new owners intend to follow a similar plan. 5. Discuss if the site has any wildlife, scenic or recreational value that should be protected or enhanced. Indicate if you are willing to pursue such efforts as part of your proposed use of the property. The new owners are not changing anything that will impact the wildlife we see on our property. 6. If the proposed use is residential development please submit a concept plan of an anticipated lot layout and describe any significant features on the site (wetlands,floodplain, poor soils, steep slopes, etc. that either support development or are challenging. We are selling the house and outbuildings with 14 acres and not planning to develop the property. 7. Almost all of the Town is identified as Farmland Preservation area. As such, it would not be likely to rezone the entire property from Agricultural to Agricultural Residential (Ag Res) , since rezoning all of it to Ag Res would not be protecting farmland. I thought when we talked before that the remnant parcel after rezoning a portion to Ag Res, was going to be larger than 35.0 acres. What I would suggest, is to rezone the +/- 32.13 acre portion of the property to Agricultural District Two, which has a minimum lot size of 20.0 acres, and which would also be seen as protecting farmland. Then, also rezoning the +/- 13.74 acre portion of the property to Ag Res, which could be more easily justified since the driveway and the building and septic system are on it already, and the fact that the 32.13 acre property would remain in an agricultural-type district (Ag District Two) which would be preserving farmland. This approach would seem to work with the Cronks plan to retain the larger portion of the property and would also allow for a residential structure to be constructed on the site. Since this 32.13 acre parcel zoned Agricultural District Two, it could not be further subdivided which would protect farmland. Please let staff know your intentions as soon as you make a decision. The application that was submitted to our office would have to be revised, and we would have to make sure that the public hearing notice stated this approach. You would also need to take this exact approach to the Town of Baldwin so they can provide an appropriate recommendation to the County. It may be too late to get this latest request through the Town in time for the hearing in September. If it is, we would wait to move this forward until we have a recommendation from the Town. Also, I seem to recall that the house was built after October of 1988, correct? There would be another avenue to explore if the house was built before this date.
