The submittal described above has been reviewed for conformance with applicable Wisconsin AdministTativtiM!5joN OF INDUI
and Wisconsin Statutes. The submittal has been CONDITIONALLY APPROVED. This system is to be constructed
and located in accordance with the enclosed approved plans and with any component manual(s) referenced above.
The owner, as defined in chapter 10 1 .0 1 (10), Wisconsin Statutes, is responsible for compliance with all code
requirements.
No person may engage in or work at plumbing in the state unless licensed to do so by the Department per s. 145.06, SEE C;ORRES
stats.
The following conditions shall be met during construction or installation and prior to occupancy or use:

• In the event this soil absorption system or any of its component parts malfunctions so as to create a health
hazard, the property owner must follow the contingency plan as described in the approved plans. In addition,
the owner must insure that the operation, maintenance and monitoring duties as described in the "In -Ground
Soil Absorption Manual System" are complied with. A copy of this information must be given to the owner
upon completion of the project.
• This approval is for the replacement of a septic tank only. The existing septic tank that is being replaced must
be properly abandoned. The proposed septic tank shall be connected to an existing dispersal cell that is code
compliant or was code compliant at the time of installation and currently functioning properly.
The septic tank that is to remain must be inspected for structural soundness, size and baffles and must be
brought into conformance with the requirements of SPS 3 83, Wis. Adm. Code. If it does not conform a state
approved tank must be installed.
A copy of the approved plans, specifications and this letter shall be on -site during construction and open to
inspection by authorized representatives of the Department, which may include local inspectors. All permits
required by the state or the local municipality shall be obtained prior to commencement of
construction/installation/operation.

In granting this approval the Division of Industry Services reserves the right to require changes or additions should
conditions arise making them necessary for code compliance. As per state stars 10 1. 12(2), nothing in this review
shall relieve the designer of the responsibility for designing a safe building, structure, or component.

I have received and reviewed your recent transmittal of completed WDNR form 3400-185 in reference to
your proposal for installation of a new wastewater holding tank to serve the vehicle building / shop for ECI,
LLC located at 742 13 01h Street, Roberts, W1. According to your transmittal, the proposed holding tank will
be used to store non -domestic wastewater, and the stored wastewater will be hauled by ABC Septic Service to
the Menomonie municipal wastewater treatment facility for ultimate treatment / disposal. Based on this
review, the proposed holding tank installation is acceptable to the Department of Natural Resources.
As part of this acceptance, please also review and discuss the conditions of approval as outlined on page

Brian Wert forwarded on a complaint from the Town of Warren. Apparently the owners have
demolished the house on the property and have hauled in a bunch of storage containers as if it is
some sort of contractor's storage yard. the property is actually zoned Industrial, which allows a
contractor's storage yard without a permit as long as they meet the rest of the criteria. Just
thought I would check before I looked into it. Brian says there are potential setback violations

configuration of the drive/parking may change with final siting of the future warehouse building weobviously want

Daniel Haase was the applicant to rezone the property, but then he sold it to your company and there was never a
special exception permit approved for the use ofthe property. Kevin double checked our records and all vvehave isthe
rezoning. If you have any documentation that a special exception permit was obtained we would be happy to review
Otherwise, we are just down to the general standards as described in the ordinance. As|mentioned toyou before,
these standards would have been required anyways as part of a special exception permit prior to our ordinance change,
but now you don't need the permit as long as you can: meet these standards and stay within the permitted uses as listed.
In your last response' you proposed paving of2O' wide by 50' long. After further discussion with Kevin' we do not
believe this will satisfy parts (b) or (j) of the general standards for the Industrial District. The minimum pavement width
must be 24' and you must provide paving for the entire driveway and a parking area. Typically this requirement is
satisfied prior to use of the property, but your business managed to go un-noticed over the past few years and has not
been held to any standards. I realize that this requirement is very expensive, but every business in the Industrial District
isheld tothis standard. Perhaps you could revise your proposed paving plan and give us a reasonable timeframe as to
when it would be satisfied. With such a plan, maybe we could at least give Brian Wert the OK so that he can issue your
building permit to begin construction.
I will be out of the office for the rest of the week after today, but I understand that you want to get this resolved as

Schlontick Holdings (current owner) did not apply for the rezoning nor the special exemption permit - those items were
contingent to the sale and completed by the previous owner - the Haas's. It is my understanding they went through the
previous processes in place in the county to get the rezone and permit - so I believe Mr. Grabau is correct in his
recollection. I would see any paving on the property to be practical - an apron abutting the town road continuing into
the property - approximately 20' wide x 50' long - consistent with a typical vehicle tracking pad.

Rob,
had a chance to discuss your property with our Code Administrator, Kevin Grabau. Kevin remembered when you
purchased that property and applied for the rezoning, but also thought that you had obtained a Special Exception Permit
for the use of the property as well. As I believe I mentioned during our conversation, prior to our ordinance amendment
in 2010, ANY use in the Industrial District required a special exception permit. So at that time, you should have had a
permit just for the contractor's storage yard. These permits usually had conditions regarding paving, screening, etc.
Anyways, despite Kevin believing you have an existing permit, I cannot find any record of such a permit. Because of this,
you have to meet our current standards. When looking at the current general standards that I sent you, every standard
must be met in order for us to approve the use. As I mentioned to your during our last phone call, your plans do not
show any paving on the property, which is required in 0) of the general standards in the commercial district. Can you
describe to me how you plan to address this?

The reconnection permit is required so that staff can determine that the existing septic system is code compliant and
that it is large enough for your business. During our discussion, I have indicated that the size of the existing system
should be large enough for your employees. But the plumber has to inspect the existing system and the tanks to make
sure that they aren't cracked or anything. You have to have the permit issued before you construct the building. It's the
same if you were to build a house - you have to get the sanitary permit before you can get the building permit. The cost
of the permit is $225 and a only a licensed plumper may apply for the permit. I apologize if I didn't make this more clear
before.
