Community Development Staff has finished the review of the submitted Land Use Permit Application #LUP-2023-
072 for filling and grading on a riparian lot in the Shoreland Overlay Zoning District for Cedar Lake, as required in
Section 16.345 Land Disturbance. This application has been conditionally approved based on the site plan set, dated
January 2, 2024 and the following findings of fact for the site and the project:
• The project is located in the Town of Star Prairie and is under general zoning administered by the County.
• The project is located in the R-2 Residential and Shoreland Overlay Zoning Districts.
• The dwelling is a nonconforming structure, as the structure is setback approximately 45 feet from the
ordinary high-water mark. As of January 1, 1968, all structures are required to be setback 75 feet from the
ordinary high-water mark.
• The nonconforming structure has an approximate 720 square -foot footprint.
• The deck, an exempt accessory structure, is nonconforming due to being within the required 35-foot
vegetative area from the ordinary high-water mark and exceeding the allowed 200 square foot footprint
allowed within the 75-toot setback from the ordinary high-water mark.
• The boathouse, an exempt accessory structure, is nonconforming due to being within the required 10-foot
seback from the ordinary high-water mark
• Wittstock Builders will serve as the general contractor and managerfor this project.
• The total extent of the project consists of construction of a driveway extension, construction of an accessory
stmcture and installation of a new sanitary system.
• A sanitary permit has been submitted and approved under SAN-2023-301 (651370).
• This application does not cover any approval for any other work on this site.
• The submitted planset meets the prescriptive requirements listed in Chapter 15 General Zoning and Chapter
16 Shoreland Overlay District of the St, Croix County Code of Ordinances, including stonnwater management

and erosion and sediment control plans meeting Wis. Admin Code NR 151, subchapter III and DNR technical
standards respectively.
Based on these findings, conditional approval of this Land Use Permit shall be granted with the following:
1) An on -site pre -construction inspection shall be completed by Department Staff after all erosion control
measures and best management practices are in place.
2) All activites resulting in soil disturbance shall be protected with dual silt fences, 6 feet apart, between said
activities and the ordinary high-water mark. This shall be in place for both the north and south sides of the
dwelling.
3) THE SOIL TESTED AREA FOR THE PRIVATE ON -SITE WASTEWATER TREATMENT SYSTEM SHALL NOT BE
DISTURBED UNTIL INSTALLATION OF THE POWTS IS COMPLETED AND INSPECTED.
4) An on -site final inspection shall be scheduled prior to the expiration of this permit, once the driveway is
installed and stabilized, and other features shown on the submitted planset are completed.
5) The applicant shall secure all necessary local, state or federal approvals for this project.
6) Any future use that may occur within this approved structure shall be subject to standards listed in any
future zoning district for which this property may be zoned, regardless of the list of approved uses for the
current R-2 Residential or shoreland overlay zoning district.
7) The permit does not allow for any additional construction, reconstruction or alteration of structures or
buildings, removal of trees or other vegetation beyond the limits of this application, specifically in the
required 35-foot vegetative buffer from the ordinary high-water mark.
Failure to comply with the standards listed herein shall result in the revocation of this land use permit and may result
in citations and issuances of fines pursuant to Section 15.555 Land Use Permits. This permit does not grant any
modifications to property not included in the initial scope as submitted in the application.
This permit is valid for one year, with the possibility of up to two (2) six-month extensions if the applicant submits
the appropriate permit extension fee and documentation to the Zoning Administrator. A copy of the Land Use
Permit placard should be submitted to the town's local Building Inspector upon applying for town building permit(e).
The orange placard shall be posted on thejobsite and visible from public view.

APPLICATION:
Applications will not be accepted until the applicant has.
• Met with the Zoning Administrator to review the application;
• Submitted Original Pius 2 copies of the entire packet me citing all supporting information, maps Bit diagrams;
• Resolved any land use violations and paid any outstanding fees owed to the Community Development Department;
• Signed the application form (the signatures of the prop¢ry owners and agents acting on their beharyare required), and
• Submitted the appropriate application fee(nonrerandiddi payable to: St. Croix County.
REVIEW:
The Zoning Administrator will review the application for completeness and assign a file number to the application. The Zoning
Administrator may require additional information anteing notify tie applicant of this within 10 days. Upon receiving a complete
application and supporting documents, the Zoning Administrator will:
• send copies of the applications to the appropriate reviewing agencies for comment. Applicants are encouraged to contact
their town to discuss their application and inquire about necessary building Permits and approvals a the town level;
• schedule a site visit to the applicant's property, at which time the applicant shall Flag all applicable property/project comers
and label the gags accordingly; and
• review the file and prepare fi ndings for approval or denial of the permit within 60 days. Upon approval, the permit will be
mailed to the applicant or to the applicant's agent.
If approved, the land use permit will be valid for one year from the date of the permit issuance. The applicant may also be required
to apply through the Town for a local building permit. All site plans, pictures, and other materials submitted with the application
become the property of the Community Development Department and will remain in the file.

• location of the OHWM of any abutting navigable waterways and all setbacks from the OHWM;
• location and landward limit of all wetlands, specifications and dimensions for areas of proposed wetland alteration;
•existing and proposed topographic and drainage features and vegetative cover;
• location of floodplain and floodway limits on the property; and
• any other unique limiting conditions of the property or'Iaffirmation deemed necessary by the Zoning Administrator.
For projects that involve land disturbance requests, the following rdditional information may be required:

❑ Project schedule and contractor list.
❑ Erosion control plan (Best Management Practices).
