Application packets should be collated and either stapled or paper clipped in the upper left-hand corner. All maps, plans, and engineering data must be submitted on paper no larger than 11x17. REZONING PROCEDURE The following process takes anywhere from 60 to 90 days to complete. Step 1,Pre-Application Meeting: Prior to submitting an application the landowner or their agent must schedule a meeting with County Community Development Department staff to discuss the application and the process. Since Towns have statutory authority to disapprove of a rezoning request, applicants are encouraged to also meet with Township officials prior to submitting an application to the County to ascertain their level of support for the request. Step 2,Application Submittal and Review: Applications are due on the lst Monday of the month. Applications will not be accepted if the applicant has not met with staff prior to submitting an application. The application must include all items identified on the checklist. After a preliminary review, additional information may be requested. Once it has been determined that all requested information has been obtained the application will undergo an interdepartmental and interagency review. This review includes notification to the Town in which the request takes place. Step 3,Town Review and Comment: As identified in Step 2,the interagency review process involves notification to the applicable Town for their consideration and comment. Under Wisconsin State Statute § 59.69 Towns have the authority to disapprove a rezoning request before the County Board. While individual Towns may have different processes for review and comment back to the County, all Towns will likely place the rezoning request on an agenda for discussion and recommendation by their Town Board. The applicant should follow this process closely and ensure that the issue is placed on a Town agenda and a resolution supporting the request is forwarded to the County in a timely manner. Approval by the County is difficult to obtain without formal Town support. Step 4,Public Hearing: All rezoning requests must undergo a public hearing before the St. Croix County Community Development Committee. A notice of the hearing is published in local newspapers for 2 weeks prior to the scheduled hearing date. Notice of the hearing is also sent to all adjacent property owners. Hearings are typically held on the 3`d Tuesday of the month(subject to change)in Hudson or Baldwin following completion of the interdepartmental and interagency review. Step 5,County Board Approval: Upon approval by the Community Development Committee,a recommendation is forwarded to the County Board for action at their next regularly scheduled meeting. Once approved by the County Board the rezoning is complete, pending any conditions that may have been placed on the approval. s:\cdd\zonshare\administrative\application forms\zoning applications\rezoning application.docx[Type text] Page 2 July 16, 2015 RZ88585 St. Croix County Future Land Use: This rezoning request is compatible with the St. Croix County Future Land Use - Rural Areas map, for agricultural uses. Prepared by St. Croix County Community Development Department 8 July 16, 2015 RZ88585 Rezoning Staff Report St. Croix County Community Development Committee Gerald & Joan Mellgren Hearing Date: July 16, 2015 Property Owners: Gerald & Joan Mellgren Agent: William Mellgren Site Address: 97 230th Street Town: Eau Galle File #: RZ88585 Legal Description: NW Y4 of the NW%of Section 33, T28N, R16W Total Acres: +/- 0.805 Current Zoning: Commercial District Requested Zoning: AG-1 Agricultural District Attachments: 1. Application 2. Land Use Map BACKGROUND: Purpose of Request Gerald and Joan Mellgren own a 40.0 acre parcel that has an approximate 0.805 acre portion of the property zoned Commercial and 39.195 acres zoned AG-1. They have applied to rezone the portion zoned Commercial District to the AG-1 Agricultural District (AG-1). The portion of the property that is currently zoned Commercial was rezoned from Agricultural Residential to Commercial District in 1993 to allow for a commercial plumbing business, Lickness Plumbing, and the remainder of the 40.0 acre property remained in Agricultural Residential. In 2013 St. Croix County amended its agricultural districts through a comprehensive revision to its Land Use Ordinances in order to bring the agricultural districts into conformance with the newly created Farmland Preservation rules in Wisconsin State Statutes (WSS) Chapter 91. As part of this process the Towns within St. Croix County were allowed the option to stay under County zoning. If a Town decided to stay under County zoning then they had the option to change the zoning on properties within their Town and create a new zoning map. This new zoning map then needed approval by the St. Croix County Board of Supervisors. The Town of Eau Galle decided to stay under County zoning and it decided to keep the small portion of the Lickness property zoned Commercial District(see below) and the other larger portion of the property to be zoned AG-/(see red arrow below). The Mellgrens have since purchased the property and they now pursue this rezoning request so that their entire property will be zoned AG-1. No new structures or uses are planned at this time. There is not a commercial business operating on this site. She also suggested the very edits that we had anticipated. How would you like me to move forward with this rezoning description? 1. Use the suggested description from Britta below; or 2. Craft some language stating that the end result of this rezoning is to make certain that all portions of the NW of the NW of Section 33 be rezoned to AG-1? (using some sort of language to convey this idea) Do you have a preference of one of the above suggested approaches, or would you like to see some type of other approach? It is missing key grammatical language to comprise a legal description including a directional call and includes errors of terms used. Mainly it did not define a clear point to begin the description. That said, if one were to infer a description, though one never should, it would sorta match the current zoning area for the commercial piece located in that% % . (See attached image.) A better legal description would have been written as: (I have underlined the key words that were missing from the previous written description of the ordinance that change the meaning entirely). A parcel of land located in the Northwest Quarter of Section 33,Township 28 North, Range 16 West, Town of Eau Galle, more particularly described as: Commencing at the NW Corner of the NW Quarter, thence East 215 feet to the Point of Beginning, thence South 350 feet, East 100 feet, North 350 feet and West 100 feet back to the Point of Beginning.
