C R O lx a14-4UNTY ORDINANCES LAND USE AND DEVELOPMENT CHAPTER 17 ZONING SECTION 17.72 REZONING AMENDMENTS - PETERSON, TOWN OF ERIN PRAIRIE 1 The St. Croix County Board of Supervisors does ordain as follows: 2 3 WHEREAS, Milton & Lynn Peterson applied to St. Croix County Community 4 Development Department to rezone approximately 5.545 acres in the NW 1A of the NW 1/4, Section 5 17, T30N, R17W, in the Town of Erin Prairie, from Agricultural District to Agricultural Residential 6 District; and 7 8 WHEREAS, the St. Croix County Community Development Committee held a public 9 hearing on the rezoning request on January 16, 2014 in, Hudson, Wisconsin; and 10 11 WHEREAS, the St. Croix County Community Development Committee considered all 12 written information and verbal testimony presented at the hearing, and made the following findings 13 in support of the request: 14 1. The Town of Erin Prairie has recommended approval. 15 2. The request is consistent with the St. Croix County Comprehensive Plan and the St. 16 Croix County Natural Resources Management Plan based on: 17 a. The use will preserve productive soils as identified by the county land evaluation 18 system. 19 b. The proposed use will minimize the loss and fragmentation of farmland in rural 20 areas. 21 c. The propose use will limit development and will not convert productive 22 agricultural land. 23 d. The proposed use is consistent with the County's policy to favor agricultural uses 24 over non-agricultural uses when considering land use conflicts. 25 e. The proposed use is consistent with the County's policy of agricultural uses to 26 include a broad range of agricultural activities. 27 f. The proposed use is consistent with the County's policy to establish and make 28 available zoning standards to prohibit major subdivisions in the farmland 29 preservation areas. 30 g. The proposed use is consistent with the County's policy to prohibit non-farm 31 development on productive farmland. 32 h. The proposed use is consistent with the goal to protect and improve groundwater 33 quality to supply clean water for drinking and recharging surface waters and 34 wetlands. 35 i. The proposed use is consistent with the goal to protect and enhance surface waters 36 and wetlands to preserve their ecological functions and recreational and scenic 37 values. 38 j. The proposed use ig consistent with the goal to protect and restore fish and 39 wildlife habitats for native species, improved water quality, recreational 40 opportunities, and natural beauty. 41 k. The request is consistent with the goal to preserve agricultural land for crop 42 production, scenic values, and wildlife habitat. 43 3. It appears that the proposed use can comply with standards in the Land Use, Land 44 Division and Sanitary ordinances. 45 4. REZONING PROCEDURE The following process takes anywhere from 60 to 90 days to complete. Step 1,Pre-Application Meeting: Prior to submitting an application the landowner or their agent must schedule a meeting with County Community Development Department staff to discuss the application and the process. Since Towns have statutory authority to disapprove of a rezoning request,applicants are encouraged to also meet with Township officials prior to submitting an application to the County to ascertain their level of support for the request. Step 2,Application Submittal and Review: Applications are due on the 1st Monday of the month. Applications will not be accepted if the applicant has not met with staff prior to submitting an application. The application must include all items identified on the checklist. After a preliminary review, additional information may be requested. Once it has been determined that all requested information has been obtained the application will undergo an interdepartmental and interagency review. This review includes notification to the Town in which the request takes place. Step 3,Town Review and Comment: As identified in Step 2,the interagency review process involves notification to the applicable Town for their consideration and comment. Under Wisconsin State Statute §59.69 Towns have the authority to disapprove a rezoning request before the County Board. While individual Towns may have different processes for review and comment back to the County, all Towns will likely place the rezoning request on an agenda for discussion and recommendation by their Town Board. The applicant should follow this process closely and ensure that the issue is placed on a Town agenda and a resolution supporting the request is forwarded to the County in a timely manner. Approval by the County is difficult to obtain without formal Town support. Step 4,Public Hearing: All rezoning requests must undergo a public hearing before the St. Croix County Community Development Committee. A notice of the hearing is published in local newspapers for 2 weeks prior to the scheduled hearing date. Notice of the hearing is also sent to all adjacent property owners. Hearings are typically held on the 3`d Tuesday of the month(subject to change)in Hudson or Baldwin following completion of the interdepartmental and interagency review. Step 5,County Board Approval: Upon approval by the Community Development Committee,a recommendation is forwarded to the County Board for action at their next regularly scheduled meeting. Once approved by the County Board the rezoning is complete,pending any conditions that may have been placed on the approval. Page 2 of 3 REZONING QUESTIONAIRE All rezonings are to be consistent with County land use plans, County ordinances and other applicable local plans. Your application will be reviewed by staff and presented to the County Community Development Committee for consistency with the following ordinances and plans: St. Croix County Zoning Ordinance(Ch. 17), St. Croix County Land Division Ordinance(Ch. 13), St. Croix County Sanitary Ordinance(Ch. 12), St. Croix County Comprehensive Plan, St. Croix County Outdoor Recreation Plan and the St. Croix County Land and Water Natural Resources Management Plan. It is the applicant's responsibility to show that their proposed use is substantially consistent with these ordinances and plans. Each ordinance and plan is available for review by contacting the Community Development Department or on the County website at: www.co.saint-croix.wi.us. To assist in determining how your proposed use relates to the aforementioned ordinances and plans,please answer the following questions on a separate sheet of paper and include them with your application materials. 1) Explain why you wish to rezone this property. Identify the proposed use if rezoned. This parcel has not been farmed since the mid 1970's. The neighbors wish to add it to their property as a buffer. The property use would not change. 2) Explain the compatibility of your proposed use with uses on existing properties in the vicinity of this site. By rezoning this parcel and adding it to the neighbors property it would be very compatible with the adjoining properties because all the adjoining lands to the north and west of this parcel are currently zoned ag/res. Proposed use is to remain the same as it is used now. 3) Explain any interaction that you have had with the Town in which this property resides and elaborate on any concerns they may have with your request. We have had preliminary meetings with the township regarding the rezoning of this land. They are in support of the rezoning. The only concern was the possible development of the property being rezoned. However the proposed configuration of the property combined with the fact that no public road access is available, makes the development of this property impractical and cost prohibitive. 4) Explain how the proposed use will affect stormwater runoff,wetlands or will impact any shoreland areas. The rezoning will have no affects on any of the items mentioned above. The property is currently Red Pines and grass lands. There are no wetlands or shoreland areas that will be affected. Proposed use will not affect runoff. 5) Discuss if the site has any wildlife, scenic or recreational value that should be protected or enhanced. Indicate if you are willing to pursue such efforts as part of your proposed use of the property. The intended use of the property will remain the same for the foreseeable future. So there are no wildlif,scenic or recreational values that will be affected. 6) If the proposed use is residential development please submit a concept plan of an anticipated lot layout and describe any significant features on the site(wetlands,floodplain,poor soils, steep slopes,etc.)that either support development or are challenging. No development anticipated. 7) Discuss any additional issues your feel that supports the consistency of your proposed use with County ordinances and plans as well as any Town ordinances or plans. Because this property is not farmed, it would have been added to the neighboring parcel long ago if it were not for the difference in zoning between the two parcels. By rezoning the property, zoning in this"40"would be consistent with surrounding properties. Existing farmland will continue to be farmed. 8) If proposing to rezone out of the Agriculture Zoning District, explain how your request does or does not comply with the following(Wisconsin State Statute§ 91.48): (a) That adequate public facilities to accommodate development either exist or will be provided within a reasonable time. (b) That the provision of public facilities to accommodate development will not place an unreasonable burden on the ability of affected local units of government to provide them. (c) That the land proposed for rezoning is suitable for development and development will not result in undue water or air pollution,cause unreasonable soil erosion or have an unreasonably adverse effect on rare or irreplaceable natural areas.
