HomeMy WebLinkAboutOrdinance 2024 (924) Ordinance No. 924 (2024) AMENDING THE COMPREHENSIVE ZONING ORDINANCE - SECTION 26, TOWNSHIP 28N, RANGE 16W, TOWN OF EAU GALLE - REZONING 0.277 ACRES FROM R-1 RESIDENTIAL DISTRICT TO R-2 RESIDENTIAL DISTRICT AND REZONING 0.245 ACRES FROM R-2 RESIDENTIAL DISTRICT TO R-1 RESIDENTIAL DISTRICT COVER MEMO TO: County Board of Supervisors FROM: Ken Witt, County Administrator Jason Kjeseth, Community Development Director DATE: January 2, 2024 AGENDA ITEM: Amending the Comprehensive Zoning Ordinance - Section 26, Township 28N, Range 16W, Town of Eau Galle - Rezoning 0.277 acres from R-1 Residential District to R-2 Residential District and rezoning 0.245 acres from R-2 Residential District to R-1 Residential District ______________________________________________________________________________ BACKGROUND INFORMATION Steve Lynum and Jason Lynum have applied to rezone the following acreage in the Town of Eau Galle: 1. 0.277 acres from the R-1 Residential District to the R-2 Residential District; and 2. 0.245 acres from the R-2 Residential District to the R-1 Residential District A Class II notice was published in the Star Observer on November 30, 2023 and December 7, 2023, establishing a public hearing on December 14, 2023, at 5:00 PM with the St. Croix County Community Development Committee (CDC) in the St. Croix County Government Center Board Room, 1101 Carmichael Road, Hudson, Wisconsin. The staff report/recommendation and rezoning application materials are included in the agenda packet. Ordinance No. 924 (2024) AMENDING THE COMPREHENSIVE ZONING ORDINANCE - SECTION 26, TOWNSHIP 28N, RANGE 16W, TOWN OF EAU GALLE - REZONING 0.277 ACRES FROM R-1 RESIDENTIAL DISTRICT TO R-2 RESIDENTIAL DISTRICT AND REZONING 0.245 ACRES FROM R-2 RESIDENTIAL DISTRICT TO R-1 RESIDENTIAL DISTRICT 1 The St. Croix County Board of Supervisors does hereby ordain as follows: 2 3 The St. Croix County Code of Ordinances, Land Use and Development, for the County of St. 4 Croix, Wisconsin, is hereby amended by rezoning the following properties: 5 6 A parcel of land located in the NW ¼ of the SW ¼ of Section 26, T28N, R16W, Town of Eau 7 Galle, St. Croix County, Wisconsin, further described as follows: 8 9 Commencing at the W ¼ of said Section 26; thence S00°05’46”E 443.65’ along the west line of 10 the SW ¼ to the southwest corner of Lot 1 of Certified Survey Map recorded in volume 14, page 11 3820, document number 620390 in the St. Croix County Register of Deeds, this being the point 12 of beginning of the parcel to be described herein; thence continuing along said west line 13 S00°05’46”E 43.25’; thence S87°10’03”E 278.22’; thence N06°02’36”E 43.26’ to the south line 14 of said Lot 1; thence N87°10’03”W 282.85’ along said south line to said west line of the SW ¼ 15 and the point of beginning. This description contains 12,049 square feet (0.277 acres) more or 16 less. 17 18 From R-1 Residential Zoning District to R-2 Residential Zoning District 19 20 and 21 22 A parcel of land located in the NW ¼ of the SW ¼ of Section 26, T28N, R16W, Town of Eau 23 Galle, St. Croix County, Wisconsin; Being part of Lot 1 of Certified Survey Map recorded in 24 volume 14, page 3820 as document number 620390 in the St. Croix County Register of Deeds, 25 further described as follows: 26 27 Commencing at the W ¼ of said Section 26; thence S00°05’46”E 174.79’ along the west line of 28 the SW ¼ of said Section 26 to the north line of Lot 1 of Certified Survey Map recorded in 29 volume 14, page 3820, document number 620390 in the St. Croix County Register of Deeds 30 office; thence S83°40’17”E 311.17’ along the north line of said Lot 1 to the point of beginning 31 of the parcel to be described herein; thence continuing S83°40’17”E 43.00’ to the northeast 32 corner of said Lot 1; thence S06°02’36”W 247.30’ along the east line of said Lot 1 to the 33 southeastern corner; thence N87°10’03”W 43.07’ along the south line of said Lot 1; thence 34 N06°02’36”E 249.93’ to the north line of said Lot 1 and the point of beginning. This description 35 contains 10,690 square feet (0.245 acres) more or less. 36 37 From R-2 Residential Zoning District to R-1 Residential Zoning District 38 39 The official zoning map of the Town of Eau Galle on file in the Community Development 40 Department shall be amended in accordance with this ordinance. 41 42 This ordinance shall be effective upon passage and publication as provided in Wis.
