Therefore, this notice also serves as notice of'a meeting of'the County Boardfor the purpose of'ohtaining information relaxing to subjects listed above for use at future County Board Meetings. 9/12/2011 MINUTES COMMUNITY DEVELOPMENT COMMITTEE SEPTEMBER 15, 2011 CALL TO ORDER: Vice Chair Norton- Bauman called the meeting to order at 6:00 p.m. ROLL CALL - Members Present: Supervisors Sharon Norton- Bauman, Lorin Sather, James Stauffer, Bill Peavey, Buzz Marzolf and FSA Representative Ken Graf. Steve Hermsen arrived at 6:01 p.m. Robert Shearer was absent and excused. STAFF PRESENT: Dave Fodroczi, Kevin Grabau, Bob Heise, Ryan Sterry, Pat Thompson, Michelle Pietrick and Monica Lucht GUESTS: Ross and Pauline Goerdt, Supervisor Clarence `Buck' Malick APPROVAL OF MINUTES OF PREVIOUS MEETING: Motion by Sather, 2nd by Peavey approving the minutes of August 18 and September 1, 2011. Motion carried. BUSINESS ITEMS Financial Report: Thompson explained the financial report and stated he sees nothing that stands out in the expenses and asked if anyone had any questions. No questions were asked. Schedule Public Hearings: Three waivers to the Land Division Design Standards were received; McDermid, Town of Richmond; Country Comfort LLC, Town of Cylon; and Rosenow, Town of Glenwood. Two rezonings were also received; Hagen, Town of Stanton and Sell, Town of Baldwin. The public hearings are scheduled for October 20, 2011, at 6:30 p.m. in Baldwin with room availability to be confirmed. 2012 Budget Update: Thompson handed out the 2012 Budget Summary for the departments reporting to the Community Development Committee. His recommendations will go to the Administration Committee in September, then to County Board in November. Thompson highlighted specific items for each department's budget. The UW Extension office is not budgeting for furloughs in 2012, because the State of Wisconsin will not have furlough days. Thompson also designated $8,500 to be transferred to the Fair Board from UW Extension as a transfer of responsibility to be more involved in the process of paying premiums. Chair Hermsen questioned the increase in the Parks Department expenses. Pietrick answered that the Perch Lake operations and maintenance has increased. Thompson is recommending to County Board to have the total amount for Capital outlay approved and will provide a list of those improvement items for each department, along with the dollar amounts. Farmland Preservation Plan: Fodroczi announced the final open house and presentation for the St Croix County Farmland Preservation Plan Update to be held on Wednesday, September 21, 2011 at the Baldwin Ag Center. The purpose is to present the draft Farmland Preservation Areas Map and the agricultural goals, objectives and policies for the plan. WCA Resolution #2 on Recycling: Thompson explained the resolution is to reinstate recycling funding and asked the Committee for their endorsement. Motion by Norton - Bauman, 2nd by Marzolf to support the WCA Resolution as printed. Motion carried, Sather opposed. Public Hearing Amendment to St Croix County Code of Ordinances, Chapter 17 Zoning, regarding Kennels and Commercial Kennels: Grabau gave a brief overview of the amendments. Current setbacks are very restrictive and all recent requests required a variance. All variances require establishing a hardship. The Board of Adjustment asked the committee to consider amendments to reduce setback standards and to add other restrictions. Grabau explained staff research and draft amendments. Corporation Counsel offered clarification edits that staff incorporated into the draft amendments. Chair Hermsen asked for public questions. Ross Goerdt, from the Town of St. Joseph, has a registered kennel with the hunt clubs and knows of several existing kennels that this setback would harm. He questioned how the amendments would affect existing kennels. Chair Hermsen answered stating that these kennels have been in front of the Board of Adjustment and operate legally. Fodroczi clarified that kennels permitted under the County General Zoning Ordinance involve zoning permits and doesn't effect the licensing for these animals. Licensing of animals is handled at the town level. Goerdt also questioned if his own property ever wanted to become a commercial kennel, the property isn't big enough and creates a hardship for the business. He feels ten acres should be adequate, especially since most kennels use bark collars, and that 450 feet is extreme. Malick suggested a good provision to consider would be bark collars. Chair Hermsen clarified that any changes to the amendment need to come from the public, and he asked for those in favor of the amendment at 450 feet from property lines. Malick stated he is in favor of reducing the distance provided there are sound proofing protections such as barking suppression devices, along with a limit on the number of animals outside at a time. He feels 300 feet would be acceptable. Pauline Goerdt agreed with the reduction to allow kennels on property less than ten acres. Grabau explained that a 300 foot setback would require a minimum of 9.4 acres. Ms. Goerdt then asked to reduce the setback to 250 feet, which would require a minimum of 6.7 acres, and would allow more options on where the kennel is placed on the property. Chair Hermsen asked three times for anyone wishing to speak in opposition. Mr. Goerdt questioned why kennels have more restriction than any other agriculture use. Malick answered that it is the barking that becomes so annoying to people, not the sounds cows and horses make. Malick asked that the Committee balance what type of businesses we want to create. Chair Hermsen closed the public hearing. Motion by Norton- Bauman, 2nd by Sather to amend the draft Amendment to St Croix County Code of Ordinances, Chapter 17 Zoning, regarding Kennels and Commercial Kennels to change setbacks from 450 feet, to 300 feet from property lines, and to require that bark suppression devices or bark collars be used on all dogs when outside their kennels, with a limit of two dogs outside at a time. Motion amended by Peavey to clarify this is meant for adult dogs, six months of age or older. Grabau clarified these are all dogs associated with the commercial kennel business. A vote was taken on the amendment to the motion. Motion carried. A vote was taken on the passage of the ordinance as amended. Motion carried. Proposed AT &T Tower in Denmark Township, Washington County: Fodroczi explained the tower proposal to be located at Afton Alps ski area. Washington County is reviewing the conditional use permit and has required a crane test for height and viewing considerations in the Riverway. Fodroczi presented a series of pictures taken from different areas of Ewaco Road in the Town of Troy to show the Committee the visibility of the crane. The St. Croix County Zoning Ordinance would require stealth design for a tower in such a location. Malick requested that the Committee authorize a letter stating that it is the policy of St .Croix County to respect Washington County's view across the river, and we would like to request the same of them. Motion by Norton - Bauman, 2nd by Marzolf to authorize staff to send a letter to 2 Washington County asking to consider modifications. Discussion. Motion carried, Peavey and Sather opposed. Resolution Authorizing St. Croix County LWCD to Apply for a Municipal Dam Grant: Motion by Sather, 2nd by Peavey to authorize application. Motion carried.
