This application has been conditionally approved based on the site plan set dated January 25, 2024 and the following findings of fact for the site and the project: • The project is located in the Town of Star Prairie and is under general zoning administered by the County. • The project is located in the R-2 Residential and Shoreland Zoning Districts. • The dwelling is in conformance with Chapter 16 Shoreland Zoning. • The boundaries of the property were modified via Certified Survey Map number 33-7344, fled with the Register of Deeds on December 6, 2023. • The total extent of the project consists of construction of an accessory structure consisting of 22 feet by 28 feet, totalling 616 square feet • The structure is proposed to be setback 36 feet from the right-of-way. The request per the application is to apply setback averaging in Section 15.405.4.b. Average Setbacks. The front setback for the property to the north is 25 feet. The front setback for the property to the south is 43 feet; thus, the required setback from the right-of-way shall be 34 feet. • The impervious surface of the property will exceed 15%, at 21.4%, which requires a mitigation plan. The mitigation plan submitted indicates that a native vegetative buffer will be planted within the 35-foot vegetative setback from the ordinary high-water mark • This application does not cover any approval for any other work on this site. • The submitted planset meets the prescriptive requirements listed in Chapter 15 General Zoning and Chapter 16 Shoreland Overlay District of the St, Croix County Code of Ordinances, including stormwater management and erosion and sediment control plans meeting Wis. (715) 386-4742 Based on these findings, conditional approval of this Land Use Permit shall be granted with the following: 1) An on -site pre -construction inspection shall be completed by Department Staff after all erosion control measures and best management practices are in place. Note, silt fence is required to be installed in the ground. 2) The structure shall be setback 10 feet from the dispersal cell component and 5 feet from the septic tank compenent of the private on -site wastenvater treatment system (POWTS). 3) The vegetative buffer shall be planted in accordance with the submitted plan, specifically with native vegetation, area, and location. 4) Anon -site Final inspection shall be scheduled prior to the expiration of this permit, once the vegetative buffer is planted and stabilized, and other features shown on the submitted planet are completed. 5) The applicant shall secure all necessary local, state or federal approvals for this project. 6) Any future use that may occur within this approved structure shall be subject to standards listed in any future zoning district for which this property may be zoned, regardless of the list of approved uses for the current R-2 Residential or shoreland overlay zoning district. 7) The permit does not allow for any additional construction, reconstruction or alteration of structures or buildings, removal of trees or other vegetation beyond the limits of this application, specifically in the required 35-foot vegetative buffer from the ordinary high-water mark. Failure to comply with the standards listed herein shall result in the revocation of this land use permit and may result in diffations and issuances of fines pursuant to Section 15.555 Land Use Permits. This permit does not grant any modifications to property not included in the initial scope as submitted in the application. This permit is valid for one year, with the possibility of up to two (2) six-month extensions if the applicant submRs the appropriate permit extension fee and documentation to the Zoning Administrator. A copy of the Land Use Permit placard should be submitted to the town's local Building Inspector upon applying for town building permit(s). The orange placard shall be posted on thejobsite and visible from public view.
