CROIX RIVERWAV PERMIT NUMBER: WP-2024-001(for reference only) PROJECT ADDRESS: Twin Springs Road PROJECT LOCATION: Part of Government Lot 1, Section 15, T30N R20W, Town of Somerset PARCEL/ALT ID: 032-2083-80-100 / N/A Mr. Miller, Community Development Staff has finished the review of the submitted Land Use Permit Application #LUP-2024- 001 for the demolition of the dwelling at the above -stated address in the Lower Saint Croix Riverway. In response to the application, this is a Letter of Determination and a Record of Nonconforming Use, per Section 15,600.3. of the Saint Croix County Code of Ordinances, which outlines the conditions as it pertains to the razing of the nonconforming dwelling. The following are the findings of fact for the site and the project: • The project is located in the Town of Somerset and is under general zoning administered by the County. • The project is located in the R-2 Residential, Shoreland Zoning Districts, and the Lower Saint Croix Rivenvay Overlay Zoning District. • The dwelling and property is in conformance with Chapter 16 Shoreland Zoning. • The boundaries of the property were modified via Certified Survey Map number 33-7325, filed with the Register of Deeds on November 13, 2023. • The dwelling is a legal nonconforming structure due to not meeting the 200-foot setback to the ordinary high-water mark and 25-foot setback to any property line, as described in Section 17.36.G.5 Structure Setbacks, and does not meet the required front yard setback of 50 feet from the right-of-way, as described in Section 15.231 R-2 Residential District. • Lot l of Certified Survey Map number 33-7325 is a legal nonconforming lot, as the lot is less than the required 1.5 acre minimum lot size as described in Section 15.231 R-2 Residential. • The total extent of the project consists of razing the dwelling, which was damaged beyond repair by fire. The foundation is to remain in place until a new building is constructed or removed. • This Letter of Determination does not cover any approval for any other work on this site. (715) 386-4742 1) As a vested right a legal nonconforming lot may be used for an allowable use in the applicable zoning district, if that use complies with all other development standards of the applicable zoning distinct. 2) As a vested right, nonconforming principal structures located within the OHWM setback area, blufAine setback area or slope preservation zone may be structurally altered or reconstructed and foundations may be replaced, improved or structurally altered if all of the requirements in Section 17.36.1.2.d.a.1. are met. 3) Under the vested right, to reconstruct the legal nonconforming dwelling a land use permit shall be obtained from the department. 4) To retain the vested right to reconstruct the legal nonconforming dwelling, in addition to securing the land use permit, town building permit, and any other required approvals, construction shall have commenced by January 25, 2025. 5) The vested right shall be invalid upon the expiration of the town building permit if work approved under said building permit is not complete to the satisfaction of the Town Building Inspector. 6) The applicant shall secure all necessary local, state or federal approvals for this project. 7) Any future use that may occur shall be subject to standards listed in any future zoning district for which this property may be zoned, regardless of the list of approved uses for the current R-2 Residential, Shoreland Overlay Zoning District, or the Lower Saint Croix Riverway Overlay Zoning District. 8) The letter of determination does not allow for any additional construction, reconstruction or alteration of structures or buildings, removal of trees or other vegetation beyond the limits of razing the dwelling. Failure to comply with the standards listed herein shall result in the further by the County. A copy of the Letter of Determiation shall be submitted to the town's local Building Inspector upon applying for town building permit(s). This letter shall be forwarded to any proseptive buyers of the property. Future owners are subject to the codintions listed herein.
