BACKGROUND INFORMATION
Wis. Stat. § 60.62(3) requires that counties review and approve all amendments to town zoning
ordinance text and maps prior to the amendment taking effect. The Town of St. Joseph, which
has a town zoning ordinance, has approved a map amendment that requires County Board
approval.
In summary, the proposed rezoning of property is for six (6) acres located in the northern part of
th
the Town adjacent to 144 Avenue (see location map). The zoning would change from the
Preservation Residential Zoning District to the Agricultural and Rural Residential Zoning
District under the Town of St. Joseph Zoning Ordinance. The purpose of the rezoning is to
facilitate development of residential lots.
Community Development Department staff has reviewed the information provided by the Town
of St. Joseph regarding the rezoning of the land and the process and procedures for town review
and adoption and recommends approval of the resolution to approve the rezoning.
The rezoning request is consistent with the Town’s Comprehensive Plan Future Land Use Map
and designated land use categories of Rural Residential and Preservation Residential for the
parcel.
The Town Board approved the rezoning on December 14, 2023, following a duly advertised
notice for public hearing on November 9, 2023, and continued to December 14, 2023.

1 WHEREAS, Steven Vader owns 6.0 acres of land in the Town of St. Joseph, that is
2 zoned Preservation Residential; and

4 WHEREAS, the subject parcel is legally described as follows:

6 That part of the NW ¼ of the SE ¼ and part of the NE ¼ of the SW ¼ all in Section 19,
7 Township 30 North, Range 19 West, Town of St. Joseph, St. Croix County, Wisconsin,
8 described as follows:

10 Commencing at the West ¼ corner of Section 19; thence S88°51’02”E, along the east-west ¼
11 line, 2453.64 feet to the point of beginning; thence continuing S88°51’02”E, along said ¼ line,
12 563.92 feet; thence S00°02’12”W, 424.27 feet to the North line of Lot 1 of Certified Survey Map
13 recorded in Volume 9, Page 2416, at the St. Croix County Register of Deeds Office; thence
14 S84°11’50”W, along said North line, 15.27 feet to the Westerly line of said lot; thence
15 S00°09’32”E, along said westerly line, 33.00 feet to the North line of said lot; thence
16 S89°50’28”W, along said North line, 547.14 feet the NW corner of said lot; thence
17 N00°09’32”W, 471.64 feet to the point of beginning.

21 WHEREAS, the owner has petitioned the Town of St. Joseph to rezone the subject
22 property from Preservation Residential to Agricultural and Rural Residential for development
23 purposes; and

25 WHEREAS, following a duly advertised public hearing notice as required by law, the
26 Town of St. Joseph Town Board held said public hearing on November 9, 2023, and was
27 continued to December 14, 2023; and

29 WHEREAS, the Town Board approved the rezoning of 6.0 acres from Preservation
30 Residential to Agricultural and Rural Residential on December 14, 2023; and

32 WHEREAS, pursuant to Wis. Stat. § 60.62(3), in counties having a county zoning
33 ordinance, no town zoning ordinance amendment is effective unless approved by the county
34 board; and
35
36 WHEREAS, St. Croix County has a zoning ordinance; and
37
38 WHEREAS, the Community Development Committee has reviewed the proposed
39 amendment and recommends approval.

41 NOW, THEREFORE, BE IT RESOLVED by the St. Croix County Board of
42 Supervisors that the amendment to the Town of St. Joseph Zoning Ordinance described above is
43 hereby approved.
