Land divisions that were processed under the subdivision ordinance prior to January 1, 2006, were required to have a 100 foot structure setback line from the road ROW drawn on the approved map of record. As of January 1, 2006, Chapter 13 St. Croix County Land Division Ordinance no longer requires the setback line to be placed on the map of record. In addition, the current County Zoning Ordinance, Chapter 15, now includes a structure setback of 50 feet from the road ROW. This created a conflict between the current structure setback of 50 feet that is allowed by today’s ordinance, and previously recorded Certified Survey Maps (CSM) and Plats that had the 100 foot setback line drawn on them. The information on a recorded Plat or CSM document has legal standing and all changes to such maps require recording a correction instrument created by a registered land surveyor per the State of Wisconsin Platting Manual, and approval from this department via Land Use Permit. This process notifies the affected Town and adjoining properties owners directly. Please submit any comments or concerns, if any, regarding this request to this department within 30 days of receipt of this letter. The request has been conditionally approved based on the application submission and the following findings: Land divisions that were processed under the subdivision ordinance prior to January 1, 2006, were required to have a 100 foot structure setback line from the road ROW drawn on the approved map of record. As of January 1, 2006, Chapter 13 St. Croix County Land Division Ordinance no longer requires the setback line to be placed on the map of record. In addition, the current County Zoning Ordinance, Chapter 15, now includes a structure setback of 50 feet from the road ROW. The setback reduction request was initiated for an expansion of an existing accessory structure within the 100 foot platted setback. The road setback reduction does not violate the general intent and purpose of this Chapter 13.10.B or is it detrimental to the health, safety, general welfare, or aesthetics of the neighborhood. The setback reduction will allow the lot and structure to be in greater compliance with the objectives and standards of Chapter 13.10.B and/or any of the underlying zoning chapters. Based on these findings, approval of the Land Use permit is subject to the following conditions: 1.A Wisconsin Registered Land Surveyor must record a correction instrument (Affidavit of Correction) within 30 days of receipt of this approval to reduce the setback, as required per Section 13.10 B.5.c of the Land Division Ordinance.
