Maximum depth of bury as specified by the manufacturer may not be exceeded without prior approval. Manhole covers exposed to grade have an effective locking device (padlock) installed. piping at the inlet and outlet is of approved material, connected to the tank with watertight fittings, and laid on stable soil to prevent settling or sagging. The farce main is sleeved with 4" Sch. 40 PVC to bridge the tank excavation and the sleeve is sealed watertight. Verify the legitimacy before clicking links or opening attachments. Hi. Page 1 are the 3 soil tests we are using, Wegerer #2, 43 and Hollister 44. All three are using the same BM 100.0 = bottom of siding on shed. Page 2 is my way of visualizing the soil tests, however it's not designed for a sloping site like this one when your doing a depth below contour. Page 3 is the revised page 3 showing the contour el and the system el. I made a math error on the 15t version I sent. In my mind this works. The system elevation of 95.5 for the lower trenches, puts the system elevation at 6.0 feet below grade. Then add the 36" of described soil required by code, requires a minimum of 108. The new boring B4 is described down to 96 inches. The system elevation cannot be raised since that would put the system elevation outside of the 0.7 GPDeft rate that the system is designed for this permit. Can you show how it will work? My lowest system EL (LSE) worksheet doesn't work on a slope like this. LSE at WB3 EL103 is 97.0 LSE at HB4 EL101.5 is 96.5 When graphed LSE at T1 is approx. 96.8; T1 System EL will be above LSE at 97.25; Upper line of the sand should be approx. 98.75 When graphed LSE at T2 is approx. 96.6; T2 SY EL at 96.75; upper line of sand approx. 98.0 T3 is on Hollister B4 contour. We decided we will need another couple borings done on lot 5 where the new septic system will be going. Although one of the borings from the soil test used for the existing system is in the area the new system will be, this will not be enough to adequately describe the soils for a new system AND the replacement area for that new system. A soil test for a conventional system needs to describe area for essentially two systems, the original and replacement system. The soil tester can use the existing boring on the new soil test to supplement additional borings, but must be able to tie in the new borings with the elevations from the original test. Also, do you have documentation you could provide on the grazing permits for the cattle in the area south of the river? Grantor's Rights Grantor also retains, reserves, and shall continue to enjoy the use of the surface of the land subject to this easement for any and all purposes that do not interfere with or prevent the use by Grantee of the easement. Grantor's retained rights include, but are not limited to, the right to build and use the surface of the easement St. Croix County 1170489 Page 3 of 5 for drainage ditches and private streets, roads, driveways, alleys, walks, gardens, lawns, planting or parking areas, and other like uses. The Grantor further reserves the right to dedicate all or any part of the property affected by this easement to any city for use as a public street, road, or alley, if the dedication can be accomplished without extinguishing or otherwise interfering with the rights of Grantee in the easement. If the Grantor or any of Grantor's successors or assigns dedicates all or any part of the property affected by this easement, the Grantee and its successors and assigns shall execute all instruments that may be necessary or appropriate to effectuate the dedications. 8. Grantee's Rights and Duties Grantee shall have the duty to repair and maintain the property subject to the easement and shall at all times keep the easement property free and open for the benefit of Grantor and any other concurrent user. Grantee shall at all times act so as to safeguard Grantor's property. Grantee shall have the right to keep access to the easement open by removing vegetation and by cutting or trimming trees or vegetation that may encroach on the easement property. Grantee shall have the right to cut and trim trees or shrubbery that may encroach on the easement property. Grantee shall dispose of all cuttings and trimmings by hauling them away from the premises. 9. Termination This easement may be terminated by written agreement signed by all owners of record and other successors to the respective interests of Grantor and Grantee in the Dominant and Servient Estates. Grantee, his/her heirs, successors, and assigns may execute and record a release of this easement at any time. This easement shall also terminate if the purposes of the easement cease to exist, are abandoned by Grantee, or become impossible to perform. 10. Failure to Perform Should Grantee fail to perform any covenant, undertaking, or obligation arising under this easement, all rights and privileges granted shall terminate and the provisions of this Agreement creating the easement shall be of no further effect. In such a case, within thirty days of receipt of a written demand from Grantor, Grantee shall execute and record all documents necessary to terminate the easement of record. Should Grantee fail or refuse to record the necessary documents, Grantor shall be entitled to bring an action for the purpose of declaring the easement to be terminated. 11. Entire Agreement This instrument contains the entire agreement between the parties relating to the rights granted and the obligations assumed. Any oral representations or modifications concerning this instrument shall be of no force and effect. Any modification of this Agreement must be in writing and must be signed by both parties. 12. Attorney's Fees If legal action is initiated by either party for the purpose of enforcing or interpreting this Agreement, or to compel the recording of a release, the prevailing party shall be entitled to recover from the losing party reasonable expenses, attorney's fees, and costs.
