of the SW ' /4 of the SE 1 /4, SE '/4 of the SE '/4 and in part of the NE '/4 of the SE
'/4 of Section 22, all in T28N -R19W, Town of Troy.

May 14, 2003

Committee members present: Supervisors Art Jensen, Lois Burri, Veronica Anderson, Jan Zoerb
and Linda Luckey. Staff present: Steve Fisher and Deb Zimmermann
Chairman Jensen called the meeting to order at 7:00 p.m. A motion was made by Anderson,
seconded by Zoerb and carried to adopt the agenda. The next meeting is scheduled for May 21,
2003 at the Agriculture Center in Baldwin.
Jensen explained the hearing process and opened the hearing.
Todd Bjerstedt: Fisher read the notice into the record. The request is to rezone approximately
256 +/- acres of land from Agriculture to Ag/Residential. Location: The NW 1 /4 of the SW 1 /4, the
NE 1 /4 of the SW 1 /4, part of the SE 1 /4 of the SW 1 /4, the SW 1 /4 of the NE 1 /4, the NW 1 /4 of the SE 1 /4,
part of the SW 1 /4 of the SE 1 /4, SE 1 /4 of the SE 1 /4 and in part of the NE 1 /4 of the SE 1 /4 of Section 22,
all in T28N -R19W, Town of Troy.
Jason Paukner of Humphrey Engineering, has been working with Bjerstedt on this project. He
explained that there will be 75 lots in this subdivision, with 140 —acres of the 250 acres being
preserved in open space. The lots will be over one acre in size, with the farmette being 12 acres.
They are working with the Town on an area to make into a park.
Todd Bjerstedt is the developer, and told the Committee that he is excited about this
development and the fact that they will be preserving the land along with putting in a
subdivision. He has worked with the Town of Troy and his plan meets the requirements of their
subdivision ordinance.
Fisher went over the staff report with the Committee stating that this request is consistent with
the County and the Town Plan. He further added that this is one of the best cluster
developments that he has seen for preserving open space. The staff recommends approval of the
request. The Committee went over the maps of the proposed layout of the subdivision, with the
staff and the applicant. Discussion held.
Motion by Jensen, seconded by Anderson and carried to approve the request for 256 -acres to be
rezoned from Agriculture to Ag/Residential based on the following findings:
1. The rezoning of this parcel is consistent with the County Plan.
2. The parcel is in the rural planning area and is an appropriate use.
3. None of the site is environmental corridor.
4. There are a few portions of the site with moderate to severe limitations for Private Onsite
Wastewater Treatment Systems (POWTS).
5. Surrounding land uses include agriculture to the north, south, west and east and
residential development to the northwest and southwest.
6. Surrounding zoning is exclusive ag on all sides except a residential subdivision to the
northwest and southwest.
7. Access to the site is off Glover Road, which runs north and south through the property.
8. Total 40/60 Farm Plan lots and TDR lots = 76/ future units of lots 1 and 2 = 81 units.
9. Potential net development, based on two -acre lot size, is 126 lots.
10. The applicant is attempting to cluster the development on the least desirable farmland.
11. The applicant states that site was reviewed under the Town of Troy's 40160 Whole Farm
Plan provisions in the subdivision ordinance.
12. Town of Troy has reviewed the rezoning and recommends approval stating that they have
considered §91.77 in making their decision.
13. The St. Croix County Natural Resource Management Plan Goals 11, III and IV also
encourages protection and preservation of surface waters and wetlands; fish and wildlife
habitats; and agricultural land and soils to preserve ecological functions and recreational
and scenic values and wildlife habitat.
14. This is a cluster development and conserves natural resources and open spaces.
15. The Ag Residential zoning designation for 256 acres is consistent with the Town of Troy
Growth Management Plan, dated 2000. The parcel is mostly prime farmland. Cluster
development is proposed for the less productive portions of the site, and the remaining
agricultural lands are protected through conservation easement, which limits development
to 12 -acre lots.
Motion by Anderson, seconded by Zoerb and carried to adjourn meeting at 7:30 p.m.
