Staff present: Steve Fisher and Deb Zimmermann Chairman Jensen called the meeting to order at 7:00 p.m. A motion was made by Anderson, seconded by Luckey and carried to adopt the agenda. The next meeting is scheduled for July 22, 2003 at the Government Center in Hudson. Jensen explained the hearing process and opened the hearing. Raymond E. and Pamela J. Johnson: Fisher read the notice into the record. The request is to rezone approximately 6 +/- acres of land from Ag -II to Ag/Residential. Location: The SE ' / 4 of the NE' /4 and the SW' /4 of the NE' /4 of Section 17, T28N -R16W, Town of Eau Galle. Ray Johnson, owner of the property, explained that he is asking for this property to be rezoned to allow him to sell this parcel, with the existing buildings, to an interested buyer. The parcel is currently 32 acres, and he has had a hard time selling it. He would like to split off the 6- acres, with the buildings, and keep the remaining 26 +/- acres in Ag -II to sell as one parcel in the future. Fisher went over the staff report. The Town of Eau Galle has recommended approval of the request. The request is consistent with the County Plan. Fisher pointed out that there are very limiting soils on the property for a septic system and it is highly unlikely that this parcel could accommodate another home. Johnson agreed with Fisher on this and would have no problem with a condition being placed on this rezoning stating that this parcel will not be further subdivided in the future. Motion by Anderson, seconded by Zoerb to close the hearing. Discussion held by the committee. The committee asked the staff to check with the Town of Eau Galle on criteria for recommendations from the Planning Commission on rezonings. Motion by Jensen, seconded by Anderson and carried to approve of the rezoning request for 6 +/- acres to be rezoned from Ag -II to Ag/Residential based on the following findings: 1. The land is in the rural planning area and is an appropriate use. 2. The site is heavily wooded with a large wetland. There is an existing home on the site. 3. Almost all of the site is identified on the primary environmental corridor map. Environmental features include woods, two drainageways and a wetland that covers approximately one -third of the site. 4. The whole parcel has slight to severe limitations for Private Onsite Wstewater Treatment (POWTS). No additional building sites are requested at this time. 5. There are no probable sand or gravel deposits on the site. 6. The surrounding land uses include large farms to the west, south and north and 20- acre hobby farms to the east and further north. 7. The land around the parcel is zoned ag/residential to the north and east and AG -II to 1 the west and south. 8. The site is located on a town road. 9. The proposed use of the land is one six -acre lot with the existing home and future development of the Ag II parcel. 10. The Land Evaluation Site Assessment Score is 84. 11. The Town Board has recommended approval of the rezoning. With the following condition: 1. This 6 -acre parcel shall not be further subdivided in the future. This information shall be placed on the deed and recorded. This request will be forwarded to the County Board for the August 19 agenda. Minutes: Motion by Jensen, seconded by Zoerb to approve the following minutes with corrections as noted: April 22, May 14, May 21, June 10 and June 11. Motion carried.
