June 11, 2003

Committee members present: Supervisors Art Jensen, Lois Burri, Veronica Anderson, Jan Zoerb
and Linda Luckey. Staff present: Rod Eslinger and Deb Zimmermann
Chairman Jensen called the meeting to order at 7:00 p.m. A motion was made by Zoerb,
seconded by Anderson and carried to adopt the agenda. The next meeting is scheduled for May
27, 2003 at the Government Center in Hudson.
Jensen explained the hearing process and opened the hearing.
Craig Rasmussen.: Eslinger read the notice into the record. The request is to rezone
approximately 3 +/- acres of land from Agriculture to Ag/Residential and 34 +/- acres of land from
Agriculture to Ag -II. Location: The NE %4 of the NW 1 /4, Section 25, T29N -R16W, Town of
Baldwin.
Craig Rasmussen, owner of the property, explained that he is asking for this property to be
rezoned to allow his daughter to build a home on the site. The remaining land would be 34-
acres, which is less than the required 35 acres for Ag zoning, and he is requesting that this 34
acres be rezoned to Ag -II. There is an existing home on the 34 acres, and most of this property is
in the Managed Forest Law Program. There is adequate driveway separation for a new
driveway, and the site has had a soil test completed on it, and is suitable for a conventional septic
system.
Eslinger went over the staff report, stating that the request is consistent with the Town and
County Plans, and is an appropriate use for the property. The staff would recommend approval
of the request. Discussion held.
Motion by Jensen, seconded by Zoerb and carried to approve of the rezoning of 3 +/- acres from
Ag to Ag/Residential and 34 +/- acres from Ag to Ag -II based on the following findings:
1. The parcel is in the rural planning area and is an appropriate use.
2. Site is forested and the applicant states that it is in the Managed Forest Program.
3. Site access is located on County Trunk Highway D.
4. None of the site is environmental corridor.
5. There are some limitations for Private Onsite Wastewater Treatment Systems (POWTS).
6. Surrounding land uses include two smaller residential lots to the northwest, and open
agricultural land to the north, south, west and east.
7. Surrounding zoning is exclusive ag to the north, east and south and ag residential to the
west.
8. Proposed use is one building site.
9. The Land Evaluation Site Assessment Score is 105.
10. The St. Croix County Natural Resource Management Plan Goals lI, III and IV also
encourages protection and preservation of surface waters and wetlands; fish and wildlife
habitats; and agricultural land and soils to preserve ecological functions and recreational
and scenic values and wildlife habitat.
11. The Town of Baldwin has reviewed the rezoning application and recommended approval
stipulating that the request is consistent with § 91.77.
This request will be forwarded to the County Board for their June agenda.
