MINUTES PLANNING, ZONING AND PARKS COMMITTEE ST. CROIX COUNTY GOVERNMENT CENTER, HUDSON, WI April 22, 2003 Present: Supervisors Art Jensen, Veronica Anderson, Jan Zoerb, Linda Luckey and Lois Burri were present. Staff. Steve Fisher, Jon Sonnentag, Deb Zimmermann, Pete Kling, Bob Heise, Dave Fodroczi, Ellen Denzer, Chuck Whiting, Brian Halling Others: Jason Paukner, Doug Zahler, Dave and Jamie Nestrud, Gary Sachse, Ron Raymond, Karl J. Yeager, Pat Carpenter, Tom Healy Chairman Jensen called the meeting to order at 9:00 a.m. Burri moved, seconded by Anderson and carried, to adopt the agenda. Date of next meeting: The next meeting for this committee is April 30, 2003 for a rezoning hearing. Approval of minutes: Motion by Luckey, seconded by Burri and carried to adopt the minutes from the April 15, 2003. Minor Subdivisions: See attachment A: Major Subdivisions: See attachment B: Concept Plats: The following concepts plats having 20% slopes were presented to the Committee for their review: Nestrud Concept The committee reviewed this concept for disturbance of 20% slopes to allow an access into a 35- acre parcel. Doug Zahler, surveyor for the property, stated that they will only disturb what is absolutely necessary of the 20% slopes for the construction of the driveway. The committee agreed to allow this, but would like something signed by the County and the owners stating that if the property is further developed, the committee has the right to administer Section 18.20 of the St. Croix County Subdivision Ordinance. Fisher will have this drafted and signed. The applicant will proceed with an application to appear before the Board of Adjustments. Update on Ordinances: A lengthy discussion was held by the staff and committee on the ordinance re -write. Fisher handed out an outline completed by the staff and discussed the new sections regarding conservation design and went over the table of contents for the septic ordinance. The staff hopes to have a draft completed in approximately two months for committee review. Jay Tappen, Regional Planning, will be helping out with the ordinance re- write as well. The committee supports having outside help to get this ordinance work completed. Discussion held on putting visuals /graphics in the ordinance. The committee suggested getting estimates as to what that would cost, and have available to present to Finance. The committee recessed from 12:45 p.m. to 1:50 p.m Bills, Invoices and Revenue Report: Motion by Zoerb, seconded by Burri and carried to approve March 2003 bills of $7,725.45 and to note revenue of $43,536.20. Violations and Citations: The Committee reviewed the report. Discussion held on prioritizing violations. Staff added that the office is so busy that different levels of priority must be used. Priority is determined by how severe the violation is, and the level of harm it inflicts on the public. Municipal Plats: No plats. Rezoning Schedule The Committee set the following dates for rezoning hearings: May 14, 2003, Hudson Government Center, 7:00 p.m. — Bjerstedt (Troy) May 21, 2003, Ag Center in Baldwin, 7:00 p.m. — Halleen (Stanton) and Wildwood View, Inc./ Falde (Eau Galle) Robert Pike: Fisher explained that Pike is asking for a decision by the Committee on his rezoning request in the Town of Stanton. Pike is not present today for the meeting. Discussion held. Motion by Zoerb, seconded by Anderson to table to a future meeting based on the following findings: 1) The applicant was not in attendance at the meeting, and the committee believed it to be important for him to have the opportunity to present further evidence on the request, pursuant to a letter of March 18 stating that Pike wanted to "produce further evidence necessary to the decision making process ". 2) The Committee still believes that it is necessary for the applicant to appear before the Town of Stanton again to obtain a new recommendation once the "codified" rezoning criteria is in place. Staff will inform the applicant. Fees: The Committee reviewed the updated fee schedule for the Zoning Department. Motion by Anderson, seconded by Zoerb to approve the revised fee schedule, with the new fees going into effect July 1, 2003. Motion carried on a unanimous vote. It was noted that the subdivision fees will be reviewed at the time of the ordinance re -write. Zoning Department truck trade -in: Fisher informed the committee that the green truck will be traded in and the department will be purchasing a new truck. Tim Ramberg, Highway Department, has been working with Fisher on this. Motion by Jensen, seconded by Bum and carried to approve Zoning to gather information on the purchase of a new truck. County Surveyor: Chuck Whiting, David Fodroczi, and Brian Halling joined the group. A lengthy discussion was held on this position. Whiting addressed the issues relating to this position and how it integrates with Zoning, Planning and Highway departments, and how to budget for this. Fodroczi told the committee that he met with Ramberg, Halling and Whiting last week, and had a very productive meeting. Whiting suggested that the staff put together something for the committees articulating their needs for this position, and then can determine where surveyor should be housed. Discussion held. The committee suggested that this presentation be given to the Transportation Committee as well, as it has been helpful to them. All were in agreement that the objective of this is to come up with a work plan that meets the needs of Planning, Highway and Zoning. Motion by Zoerb, seconded by Anderson and carried to direct Fodroczi to work with Tim Ramberg put together a needs assessment that addresses the needs of all departments to present to the two committees. Staff Recommendation: Conditional approval: 1) Water course to be labeled as drainage course. Committee action: Motion by Anderson, seconded by Luckey to approve with condition recommended by staff, carried. 5. Owner: Fred Lenertz — Map D Location: NW ' / 4 - SE 1 /4, Section 5, Town of Kinnickinnic. 4 lots totaling 9.61 acres, original parcel 80- acres. Staff Recommendation: Condition approval: 1) Map `B" must satisfy conditional approval and must be approved prior to or simultaneously with the proposed CSM "D "; 2) Map revisions; 3) Financial guarantees equal to 120% of the construction estimates are required for both erosion control and road construction, consistent with St. Croix County Subdivision Ordinance — Section 18.19; 4) No construction, including earth moving, shall take place prior to approval of the financial guarantees; a construction waiver may be granted provided the financial guarantees are approved; 5) Road and erosion control estimates must be submitted and approved. A letter of credit, cashiers check, bond or other acceptable financial guarantee must be submitted for County approval. Financial guarantee is to be in effect for a minimum of one year and to be automatically renewable unless the county releases the money before this timeframe; 6) The Zoning Office, County Highway Dept and the Land and Water Conservation Dept must be notified 3 days prior to construction beginning. Staff Recommendation: Condition approval: 1) A soil on -site must be completed within 60 days. Results must deem site suitable for septic system; 2) Map revisions as requested; 3) The temporary cul -de -sac must be constructed in its entirety; 4) The joint access serving Lots 1 and 2 must be constructed to County standards to the point where it divides for the separate lots; 5) No construction, including earth moving, shall take place prior to approval of the financial guarantees; 6) Road and erosion control estimates must be submitted and approved. A letter of credit, cashiers check, bond or other acceptable financial guarantee must be submitted for County approval. ATTACHMENT B MAJOR SUBDIVISIONS April 22, 2003 Indigo Ponds — Preliminary Owner: Pohlen Estate Location: Section 25, Town of Hudson, 53 lots totaling 181.058 acres Staff Recommendation: Table Committee Action: Motion by Jensen, seconded by Burri to table this plat due to a number of unresolved issues regarding net buildable acreage, 3:1 lot ratio, and minimum access. The committee agreed that one house per 35 acres may be constructed prior to final plat approval. The plat may be heard at the next meeting on May 13, 2003, if the pending issues are resolved. Motion carried. 2. Deer Meadows - Preliminary Owner: Scott Green Location: Section 30, Town of St. Joseph, 8 lots totaling 29 acres. Staff Recommendation: Conditional approval: 1) Future roadway easement must be dedicated, but does not need to be built at this time; 2) Minor map revisions as requested; 3) No construction, including earth moving, shall take place prior to approval of the financial guarantees; a construction waiver may be granted provided the financial guarantees are approved; 4) Road and erosion control estimates must be submitted and approved. You must submit a letter of credit, cashiers check, bond or other acceptable financial guarantee for County approval. Financial guarantee is to be in effect for a minimum of one year and to be automatically renewable unless the County releases the money before this timeframe; 5) The Zoning Office, County Highway Dept and the Land and Water Conservation Dept must be notified 3 days prior to construction beginning; Committee Action: Motion by Zoerb, seconded by Burri to approve with conditions recommended by staff, carried. 3. The Ponderosa — Preliminary Owner: Kyle Vanasse Location: Section 22, Town of Somerset, 2 lots totaling 16.78 acres Staff Recommendation: Conditional approval: 1) Minor map revisions as requested. Committee Action: Motion by Jensen, seconded by Anderson to approve with condition recommended by staff, carried. 4. Waldroff Meadows III - Preliminary Owner: David Waldroff Location: Section 20 and 21, Town of Richmond, 1 lot totaling 12.248 acres Staff Recommendation: Approval Committee Action: Motion by Burri, seconded by Jensen to approve, carried. 5. Waldroff Meadows II — Final Owner: David Waldroff Location: Section 20 and 21, Town of Richmond, 1 lot totaling 12.248 acres Staff Recommendation: Conditional approval: 1) A note shall be placed on the map indicating that any future use may require stormwater calculations and erosion control plans submitted by a licensed engineer. Mound View Estates - Final Owner: Dick Beer Location: Section 11, Town of Hudson, 10 lots totaling 28.187 acres Staff Recommendation: Conditional approval: 1) Minor map revisions as requested. roadway construction and erosion control must be submitted and approved by the County; 2) No construction, including earth moving, shall take place prior to approval of the financial guarantees; a construction waiver may be granted provided the financial guarantees are approved; 3) Road and erosion control estimates, equal to 120% of the estimates, must be submitted and approved.
