Staff present: Steve Fisher and Deb Zimmermann Chairman Jensen called the meeting to order at 7:00 p.m. A motion was made by Luckey, seconded by Burri and carried to adopt the agenda. The next meeting is scheduled for April 8, 2003 at the Government Center in Hudson. Jensen explained the hearing process and opened the hearing. Gerald LaVenture: Fisher read the notice into the record. The request is to rezone approximately 153 +/- acres of land from Agriculture to Ag/Residential. Location: The SW t /4 of the NE 1 /4, the SE 1 /a of the NE '/4, the NE '/a of the SE '/a and the NW 1 /a of the SE 1 /4, all in Section 2, T31N -R19W, Town of Somerset Gerald LaVenture, 1339 State Highway 35, New Richmond, WI, is the owner of the property. He explained that he bought the farm from his parents, and now plans to give 10 acres to his sister to build a home. Eventually, his children will build homes on the property. Louise Rothmeyer, 2377 65 St., New Richmond, WI, had a question on where the 10 -acre parcel would be located on the property. LaVenture explained. There was no opposition to the request. Fisher went over the staff report and the GIS and LESA maps with the committee. The Town of Somerset has recommended approval of the request and has considered §91.77 in making their decision. The property is non - productive farmland with probable sand deposits, so there are no limits for septic systems. The property is surrounded by Ag/Residential zoning on three sides. The request is consistent with the Town plan, meeting 4 of 5 criteria for the Town of Somerset. Fisher added that the request is consistent with the County Plan. Motion by Luckey, seconded by Burri and carried to recess the hearing. Discussion held. Motion by Jensen, seconded by Burri and carried to approve the rezoning request and to forward to the County Board for approval based on the following findings: 1. The parcel is in the rural planning area and is an appropriate use. 2. Site is located along State Trunk Highway 35. The site probably would not directly access STH 35. 3. A very small portion of the site is prime farmland. 4. There are no limitations for Private Onsite Wastewater Treatment Systems (POWTS). 5. Surrounding land uses include smaller residential lots to the west, and open agricultural land to the north, south and east. 6. Surrounding zoning is exclusive ag to the south and northeast and ag residential to the north, west and east. 7. The site has access to a town road to the west. This access is limited and an extensive internal road system would be needed if the site developed. 8. Proposed use is two new building sites. The specific location has not been indicated. 9. Potential development is 43 lots. 10. A conceptual site layout showing access is provided. 11. None of the soils on the site are Class I, II or III under the Soil Classification System of the Natural Resource Conservation Service. 12. Land Evaluation Site Assessment Score is 108. 13. The St. Croix County Natural Resource Management Plan Goals II, III and IV also encourages protection and preservation of surface waters and wetlands; fish and wildlife habitats; and agricultural land and soils to preserve ecological functions and recreational and scenic values and wildlife habitat. 14. The Town of Somerset has recommended approval of the rezoning, and has considered §91.77 in making their recommendation. The Somerset Town Plan uses five guidelines to delineate where preferred development areas shall be located. Based on the criteria in the plan, this rezoning is generally consistent with the Town Plan.
