Staff present: Rod Eslinger, Deb Zimmermann, Bob Heise Members of the LWCD Committee present: Leon Berenschot, Ron Raymond, Chris Bethke Chairman Jensen called the meeting to order at 7:00 p.m. A motion was made by Zoerb, seconded by Anderson and carried to adopt the agenda. Jensen explained the hearing process and opened the hearing. Don Ziegler: Eslinger read the notice into the record. The request is to rezone approximately 5 +/- acres of land from Agriculture to Ag/Residential. Location: The SW 1 /4 of the NE 1 /4 of Section 4, T31N -R17W, Town of Stanton. Don Ziegler, presented his request to the committee. He explained that he would like to rezone approximately 5 acres from Ag to Ag/Residential and split this parcel into two separate parcels. The property is not good farmland, and has not been farmed for years. Eslinger went over the staff report, stating that the soils are 50% Class III and Class IV soils. The request meets the criteria for rezoning property in the Town of Stanton and is consistent with the County Plan. This request was originally before this committee about a year ago, and there was a mapping error indicating different soils on the property. That has since been corrected and the staff supports this rezoning request. The hearing was recessed. Discussion held. Motion by Jensen, seconded by Burn and carried to recommend approval of the request to rezone approximately 5 acres from Ag to Ag /Residential and move onto County Board for their approval, based on the following findings: 1. The parcel is in the rural planning area and is an appropriate use. 2. A very small portion of the site is good farmland. 3. There are probable sand deposits located under the whole site. 4. Surrounding land uses include two small lots to the west, open agricultural land to the north, east and south and the wildlife areas. 5. Surrounding zoning is exclusive ag to the east, north and south and ag residential to the west. 6. The site has access to a town road to the south. 7. Proposed use is two residential lots approximately 2.5 acres each. 8. Potential development is two home sites. 9. Site layout, with a roadway easement for one of the lots, is provided. 10. The soils on the site are approximately 50 percent Class III (eroded) and 50 percent Class IV, with a very small amount of Class II, base on the Soil Classification System of the Natural Resource Conservation Service Soil Survey for St. Croix County. 11. The St. Croix County Natural Resource Management Plan Goals II, III and IV also encourages protection and preservation of surface waters and wetlands; fish and wildlife habitats; and agricultural land and soils to preserve ecological functions and recreational and scenic values and wildlife habitat. 12. There is no Town Plan, however, the town is in the process of developing a plan. 13. The Town of Stanton recommends approval of the request and has considered §91.77 in making their decision. The Town Board states that it meets their rezoning criteria because it does not have a history of economically viable farming activities, a very small portion of the lots have woodlands, the soil is predominately Class IV, and a public road is not required. The request will be forwarded to the County Board. Norman and Shirlee Feyereisen: Eslinger read the notice into the record. The request is to rezone approximately 83 +/- acres of land from Agriculture to Ag/Residential. Location: The SW 1 /4 of the NE 1 /4 , the SE 1 /4 of the NE 1 /4, the NW 1 /4 of the SE 1 /4, and the NE 1 /a of the SE 1 /4, all in Section 8, T28N -R19W, Town of Troy. Jason Paulkner, Humprey Engineering, is the surveyor for the property and is representing the owner. He went over the proposed development for the property, stating that they have worked with the Town of Troy on the 60/40 Plan, and conservation easements will be recorded. The town has approved of the rezoning request. Eslinger went over the staff report, stating that the request is consistent with the Town and County Plan. The hearing was recessed. Discussion held. Motion by Luckey, seconded by Anderson and carried to recommend approval of the rezoning request for 83 acres to be rezoned from Ag to Ag/Residential, based on the following findings: 1. The parcel is in the rural planning area and is an appropriate use. 2. Site consists of open cropland and some pastureland. There is an intermittent stream on the site 3. None of the site is environmental corridor. 4. None of the site has limitations for Private Onsite Wastewater Treatment Systems (POWTS). 5. Surrounding land uses include agriculture to the south, and residential development to the north, west and east. 6. Surrounding zoning is exclusive ag to the south and ag residential to the north, east and west. 7. Access to the site is off of Townsvalley Road to the west and CTH FF to the north. 8. Proposed use is 37 lots under the Town of Troy Subdivision Ordinance — 18 lots under the 60 /40farm plan and 19 lots from the Transfer of Development Rights. 9. The applicant is attempting to cluster the development on the least desirable farmland. 10. The applicant states that site was reviewed under the Town of Troy's 60/40 Farm Plan provisions in the subdivision ordinance. 11. Town of Troy has reviewed the rezoning and recommends approval, stating that they have considered §91.77 in making their decision. 12. The St. Croix County Natural Resource Management Plan Goals 11, III and IV also encourages protection and preservation of surface waters and wetlands; fish and wildlife habitats; and agricultural land and soils to preserve ecological functions and recreational and scenic values and wildlife habitat. 13. The Ag Residential zoning designation for 82.53 acres is generally consistent with the 2 Town of Troy Growth Management Plan, dated 2000. The parcel is mostly prime farmland. Cluster development is proposed for the less productive portions of the site, and the remaining agricultural lands are protected through conservation easement and transfer of development rights, which limit development to 6 -acre lots. The request will be forwarded to County Board. Land, Water and Parks Director Job Description: Heise handed out a copy of the job description that has been reviewed by personnel, to the members of the two committees. A lengthy discussion was held by the committee members and Heise in reviewing the job description. A few changes were suggested. Heise will get back to Deb Kathan, and this will be placed on the October 28 PZP Committee agenda for approval. Heise indicated that the Personnel Committee meets on November 3 ra and it would be helpful if this could be approved and on that agenda.
