Staff present: Steve Fisher and Deb Zimmermann Chairman Jensen called the meeting to order at 7:00 p.m. A motion was made by Anderson, seconded by Burri and carried to adopt the agenda. The date of the next meeting is March l lth at the Government Center in Hudson. Jensen explained the hearing process and opened the hearing. Pat McNamara: Fisher read the notice into the record. The request is to rezone approximately 7 + / -acres of land from Agriculture to Ag/Residential. Location: A parcel of land located in part of the SW 1 /4 of the NW 1 /4 of Section 8, T30N -R17W, Town of Erin Prairie. Ed Flanum, surveyor for the applicant, and Pat McNamara were in attendance. They explained that the intention of the property owner is to add .97 acres onto an existing parcel. The other parcel requesting to be rezoned is approximately 6 acres and would be a future building site for the applicant. He has no plans to develop the property, but would like to rezone both pieces at the same time. The 6 acres is currently rented out for farming. The town is aware of the request, but they have not formally been before the town for a recommendation. Jason Raymond, an adjoining property owner that operates a dairy farm, had concerns about the rezoning and development in the area. McNamara assured Raymond that there would not be any development. Fisher went over the staff report with the committee stating that staff has reviewed this request and believes that the .97 -acre add on parcel is a good idea, as it makes the existing parcel more compliant, and would then be 1.77 acres is size. The staff does not think that rezoning the 6 acre parcel would be consistent with the county plan, and pointed out the reasons why by going over the staff report. The LESA score is 150, making the property best suited to remain in Ag zoning. Fisher reiterated that the applicant has not been before the town for a recommendation and that it is important to have that happen before a decision is made. Motion to recess the hearing by Luckey, seconded by Zoerb and carried. Discussion held. Motion by Zoerb, seconded by Luckey and carried to table the request until the applicant appears before the town and there is a recommendation from the Town of Erin Prairie. If there is a recommendation by the March 25 PZP meeting, this request will be placed on that agenda. Gerry Veenendall: Fisher read the notice into the record. The request is to rezone approximately 5 + / -acres of land from Agriculture to Ag/Residential and 20- acres of land from Agriculture to Ag -II. Location: A parcel of land located in the NW 1 /4 of the NE 1 /4 and the SW 1 /4 of the NE 1 /4, Section 29, T29N -R16W, Town of Baldwin. Gerry Veenendall, owner of the property, presented this request to the Committee. He explained that the parcel is 80 acres in size. He would like to rezone 5 acres to Ag/Residential that would contain the original buildings on the site, rezone 20 acres to Ag -H for a building site, and will sell the remaining 55 -acres to his son, and that would remain in Ag. Paul Lokker, 857 220' Avenue, Baldwin, is on the Baldwin Town Board, and spoke on behalf of the Town. The Town of Baldwin recommends approval of the request. There was no opposition to the request. Fisher went over the staff report with the committee, stating that the request is consistent with the St. Croix County Development Management Plan and recommends approval of the request. Fisher commended the applicant for his cooperation with the county on this rezoning. Motion by Anderson, seconded by Burri and carried to recess the hearing. Discussion held. Motion by Jensen seconded by Luckey and carried to recommend approval of the request and forward to the County Board based on the following findings: 1. The parcel is in the rural planning area and is an appropriate use. 2. Site consists of open land used for farm fields with an existing residence and some woods around the residence. 3. Site is part of a larger farm of 80 acres. 4. Site is located approximately 1 mile from the Baldwin Village limits. 5. There are probably sand and gravel deposits located under about half the site. 6. There are no environmental corridors on the site. 7. Environmental features include a stream and small area of 12 to 20 percent slope. 8. The majority of the parcel proposed to be Ag II and the parcel to remain in exclusive ag have moderate to severe limitations for Private Onsite Wastewater Treatment Systems (POWTS). 9. Surrounding land uses include one small lot to the northwest, a 10 -acre site to the northeast and open agricultural land around the site everywhere else. 10. Surrounding zoning is exclusive ag to the west and south and ag residential to the north and east. 11. The site has access to a town road to the north. 12. A perk test has been done and onsite treatment is possible. 13. Proposed use is one or two new building sites, one on the proposed 20 -acre Ag H parcel and one on the 55 -acre parcel remaining in exclusive ag. 14. Potential development is three new building sites, the two proposed and one additional lot on the 5 -acres proposed for ag residential zoning. 15. A site layout and access for the parcels is provided. 16. There is no Town Plan, however, the town is in the process of developing a plan. 17. The soils on the site are Class II or better under the Soil Classification System of the Natural Resource Conservation Service. 18. The Land Evaluation Site Assessment Score is 136. 19. The St. Croix County Natural Resource Management Plan Goals 1I, 111 and IV also encourages protection and preservation of surface waters and wetlands; fish and wildlife habitats; and agricultural land and soils to preserve ecological functions and recreational and scenic values and wildlife habitat. 20. The Town of Baldwin has reviewed the rezoning application and recommended approval stipulating that the request is consistent with § 91.77. With the following condition: 1. The new 5 ( + / -) acre lot shall not be further subdivided in the future, unless approved by the St. Croix County Board of Supervisors.
