PUBLIC HEARING NOTICE
The St. Croix County Planning, Zoning and Parks Committee will be conducting a public
hearing on Wednesday, November 19, 2003 at 7:00 p.m. at the St. Croix County
Government Center, 1101 Carmichael Road, Hudson, Wisconsin (lower level community
room), to consider the following petition(s):
1) Sandra Kluedtke to rezone approximately 40 +/- acres of land from
Agriculture to Ag /Residential. Location: The SE '/ of the SW '/4, Section 17,
T30N -R19W, Town of Somerset
2) Walter Germain to rezone approximately 44 +/- acres of land from
Agriculture to Ag /Residential. Location: Part of the NE ' / 4 of the SE '/4, part
of the SE '/ of the SE '/4, and the S %z of the SW '/a of the SE '/4, all in
Section 14, T31 N -R1 9W, Town of Somerset.
3) Mike Germain to rezone approximately 40 +/- acres of land from Agriculture
to Ag /Residential. Location: NW y / 4 of the NW '/4, Section 10, T31 N -R19W,
Town of Somerset.
Information on this petition may be obtained from the office of the Zoning Director, Hudson,
St. Croix County, Wisconsin. In the case of cancellation of this hearing, such notice will be

MINUTES
St. Croix County Planning, Zoning and Parks Committee
November 19, 2003
St. Croix County Government Center, Hudson, Wisconsin
Committee members present: Supervisors Art Jensen, Veronica Anderson, Jan Zoerb, Linda
Luckey and Lois Burri. Staff present: Steve Fisher, Deb Zimmermann
Chairman Jensen called the meeting to order at 7:00 p.m. A motion was made by Anderson,
seconded by Jensen and carried to adopt the agenda.
Jensen explained the hearing process and opened the hearing. Fisher read the hearing notice.
Sandra Kluedtke: The request is to rezone approximately 40 +/- acres of land from Agriculture to
Ag/Residential. Location: The SE' /a of the SW 1 /a of Section 17, T30N -R19W, Town of Somerset.
Sandra Kluedtke explained her rezoning request. She would like to build a home on the
property, and she has a neighbor interested in buying 10 acres of the property from her.
Don Roettger spoke in favor of the rezoning of the property. There was no opposition to the
request.
Fisher explained to the committee that all of the rezoning requests tonight are located in the
Town of Somerset. The Town now has a Comprehensive Plan that is completed and has been
adopted. Staff thinks that they have done a good job on this. The plan is to have an
Ag /Residential community in the Town of Somerset.
Fisher went over the staff report, stating that the request is consistent with the County and Town
Plans. There have been some questions on the site access. Discussion held. The applicant
explained that they would acquire more land to gain adequate access if needed.
Hearing recessed. Discussion held on access to the property. Motion by Luckey, seconded by
Zoerb and carried to approve the rezoning request to rezone 40 acres of land from Ag to
Ag/Residential and forward to County Board after staff verifies that the access to 42 Street is
adequate for a future road. The approval was based on the following findings:
1. The parcel is in the rural planning area and is an appropriate use.
2. Site consists of open land used for farm fields with some woods. There are scattered
closed depressions and moderate slopes on the site.
3. None of the site is prime farmland.
4. The whole site is environmental corridor.
5. The environmental features include a closed depression, shorelands, steep slopes and
intermittent stream and some woodland.
6. There are no limitations for Private Onsite Wastewater Treatment Systems (POWTS).
7. Surrounding zoning is exclusive ag to the west and ag residential to the north, south and
east.
8. The site has access to a town road, 42 Street, to the west. This access is limited and an
extensive internal road system would be needed if the site developed. The site access
needs to be confirmed prior to rezoning.
9. Proposed use is one new building site and sale of approximately 10 acres to an adjoining
landowner. The specific building location has not been indicated.
10. Potential development is approximately 13 lots.
11. The County Highway Department has verified that there is suitable access to the site.
12. The St. Croix County Natural Resource Management Plan Goals 11, III and IV also
encourages protection and preservation of surface waters and wetlands; fish and wildlife
habitats; and agricultural land and soils to preserve ecological functions and recreational
and scenic values and wildlife habitat.
13. The Town of Somerset has recommended approval of the rezoning, and has considered
§91.77 in making their recommendation. The Somerset Town Plan uses five guidelines to
delineate where preferred development areas shall be located. Based on the criteria in the
plan, this rezoning is generally consistent with the Town Plan.
14. The area is in proximity to some existing development. The parcel's terrain is suitable
for development.
The request will be forwarded to the County Board once access is verified.
Walter Germain: The request is to rezone approximately 44 +/- acres of land from Agriculture to
Ag/Residential. Location: The SW 1 /4 of the SE 1 /4, Section 14, T3 IN-RI 9W, Town of Somerset.
Ty Dodge of JEO Consulting Group, is the surveyor for the property and is representing the owner.
He explained that the applicant has two parcels currently zoned agriculture and they are less than 35
acres in size. The applicant would like to add some of this land onto his existing Ag/Residential
property, but cannot combine land that has unlike zoning. He plans to split the 20 acre parcel along
Highway 35. Neither property is conducive to ag use due to the slopes, and wetlands. The Town of
Somerset has approved of the request, and a letter from the town will be forthcoming.
Fisher went over the staff report, stating that the request is consistent with the Town and County
Plan. He reiterated that both sites are below 35 acres and rezoning the property would make them
compliant with the county requirements. The committee reviewed the maps of the property.
The hearing was recessed. Discussion held. Motion by Luckey, seconded by Zoerb and carried to
recommend approval of the rezoning request for 44 acres to be rezoned from Ag to Ag/Residential,
based on the following findings:
1. There are two separate parcels in this rezoning; the northern site is approximately 24
acres and the southern site is approximately 20 acres.
2. Both parcels are in the rural planning area and are an appropriate use.
3. The northern site is part of a larger site of 226 acres. The southern site is a separate site.
4. Each site consists of an existing home with outbuildings on open rolling land with some
woods. Neither site is currently used for farming.
5. The northern site has two closed depressions, shorelands, wetlands and moderate slopes.
6. The southern site has a very large wetland and closed depression, a second closed
depression, woods, moderate slopes and shorelands.
7. The northern site is approximately a third prime farmland, the southern site has a very
small area of prime farmland.
8. Both sites are completely within an environmental corridor.
9. There are no limitations for Private Onsite Wastewater Treatment Systems (POWTS) on
the northern site and only a very small area of limitation on the southern site.

10. Surrounding zoning is exclusive ag to the east and ag residential to the north, south and
east.
11. The northern site has access to State Trunk Highway 35 to the east. The southern site has
access to State Trunk Highway 35 from a shared driveway. These accesses are limited
and an extensive internal road system would be needed if the site developed.
12. Proposed use is to sell the northern building sites with approximately 5.5 acres and
combine the remaining acres with the adjoining property.
13. No changes are proposed at this time on the southern site. The rezoning is requested
because the lot size is not 35 acres as required by the exclusive ag district.
14. Potential development is approximately 13 lots.
15. The St. Croix County Natural Resource Management Plan Goals H, III and IV also
encourages protection and preservation of surface waters and wetlands; fish and wildlife
habitats; and agricultural land and soils to preserve ecological functions and recreational
and scenic values and wildlife habitat.
16. The Somerset Town Plan uses five guidelines to delineate where preferred development
areas shall be located. Based on the criteria in the plan, this rezoning is generally
consistent with the Town Plan.
17. The area is in proximity to some existing development. The parcel's terrain is suitable
for development.
The request will be forwarded to County Board once staff verifies that the town has approved of
the request.
Mike Germain: The request is to rezone approximately 40 +/- acres of land from Agriculture to
Ag/Residential. Location: The NW 1 /4 of the NW 1 /4, Section 10, T31N -R19W, Town of Somerset.

The request is to allow the owner to develop the property into residential lots of 3 to 5 acres in size.
Dodge explained that this land also contains wetlands and steep slopes and is not suitable for
farming.
Gary Dallek and Margaret Cook, both adjoining property owners, spoke in favor of the rezoning
request.
Fisher went over the staff report, reiterating that it is a rugged site and not conducive for farming.
The town has approved of the request and staff believes it is consistent with the Town and County
Plans. The committee reviewed the maps of the property.
The hearing was recessed. Discussion held. Motion by Jensen, seconded by Zoerb and carried to
approve the request to rezone 40 acres of land from Agriculture to Ag/Residential based in the
following findings:
1. The parcel is in the rural planning area and is an appropriate use.
2. Site consists of open rolling land with two large closed depressions and some woods.
3. The site has a large closed depression with water, a second smaller closed depression,
moderate to severe slopes and shorelands.
4. There are no prime farmlands on this site.
5. The whole site is an environmental corridor.
6. There are no limitations for Private Onsite Wastewater Treatment Systems (POWTS) on
the site.

7. Surrounding land uses include open agricultural land to the east, west and north and
smaller residential sites to the south.
8. Surrounding zoning is exclusive ag to the north, west and south and ag residential to the
east.
9. The site has access to a town road, 50 Street, to the west.
10. Proposed use is to develop residential lots of between three and five acres each.
11. Potential development is approximately 12 lots.

Upcoming meetings: Fisher informed the Committee that the December P hearing has been
