1) An Ordinance Amending the St. Croix County Nonmetallic Mining Ordinance. The
ordinance amendments are required in order to comply with ch. NR 135 Wis. Adm. Code.
A copy of the proposed amendment is available from the St. Croix County Zoning Office.

St. Croix County Planning, Zoning and Parks Committee
November 5, 2003
St. Croix County Agricultural Center, Baldwin, Wisconsin
Committee members present: Supervisors Veronica Anderson, Jan Zoerb, Linda Luckey and
Lois Burri. Art Jensen was absent and excused. Staff present: Steve Fisher, Deb Zimmermann,
Rod Eslinger
Vice Chairperson Luckey called the meeting to order at 7:00 p.m. A motion was made by Zoerb,
seconded by Burn and carried to adopt the agenda. The next meeting is scheduled for November
11, 2003 at the Government Center in Hudson.
Luckey explained the hearing process and opened the hearing.
Eslinger read the notice into the record, and then gave a brief overview of the ordinance. St.
Croix County was one of two counties in the state that had a non - metallic mining ordinance in
place, but needed to update it to be compliant with the state Administrative Code NR 135. The
staff has done that, and a draft copy was mailed out to all 21 towns, as well as other interested
parties.
The DNR has approved of the ordinance, as well as the PZP Committee and St. Croix County
Corporation Counsel. Eslinger explained that this hearing is for comments and questions on the
ordinance. The public will have two more weeks after tonight to submit further comments.
Luckey asked for questions from the audience.
Bennie Stenner, Kraemer Company, had a list of questions relating to special exceptions,
reclamation, and various "wording ". He submitted suggested changes in writing to the staff .
Butch Meyer had questions on the definition of non - metallic mining. Eslinger read the definition
uses in NR 135. Eslinger also explained that the annual fees set forth in the ordinance are the
minimum fees that are set by the state. The fees cover administrative costs for review. This fee
schedule can be amended from time to time by the PZP Committee whenever deemed necessary.
Luckey asked for testimony from the audience.
Mark Iverson, with Cedar Corp, suggested a change on page 10 to have the 300 -feet within the
wetland areas changed to 1000 feet, as other rules fall into that category.
Jim Schmitt, Monarch Paving/Mathy Construction, had several suggestions regarding
definitions, shoreland issues, buffer and screening issues, permit conditions and reclamation. He
submitted his suggestions in writing to the staff.
Russell Utecht had questions on financial assurance that is required. Eslinger explained that the
amount used would be different for each site as is site specific, according to what is involved.
Bill Peabody, Everett Simonson and Doug Hall all had comments on the liability insurance and
felt that $1 million was too much. Eslinger explained that this has been in the ordinance since
1989 and is usually taken care of by the operator, not the owner. He will talk to Corporation
Counsel about this to clarify.
No further comments were made. Luckey explained that the committee will review all
comments in two weeks and then vote on whether or not to move forward to County Board for
approval.
Motion by Burn, seconded by Anderson to close the hearing. Meeting adjourned at 7:55 p.m.
