PUBLIC HEARING NOTICE
The St. Croix County Planning, Zoning and Parks Committee will be conducting a public
hearing on Wednesday, December 17, 2003 at 7:00 p.m. at the St. Croix County
Government Center, 1101 Carmichael Road, Hudson, Wisconsin (lower level community
room), to consider the following petition(s):
1) Richard and Philipine Beer to rezone approximately 221+/- acres of land
from Agriculture to Ag /Residential. Location: The SE ' / 4 of the SW '/4,
Section 35, T30N -R19W and the NW ' / 4 and the N %2 of the SW %, Section
2, T29N -R1 9W, Town of St. Joseph.
2) Ted and Bergetta Anderson to rezone approximately 87 +/- acres of land

December 17, 2003

Committee members present: Supervisors Art Jensen, Veronica Anderson, Jan Zoerb, Linda
Luckey and Lois Burri. Staff present: Steve Fisher, Deb Zimmermann
Chairman Jensen called the meeting to order at 7:00 p.m. A motion was made by Zoerb,
seconded by Burn and carried to adopt the agenda.
Jensen explained the hearing process and opened the hearing. Fisher read the hearing notice.
Richard and Philippine Beer: The request is to rezone approximately 221 +/- acres of land from
Agriculture to Ag/Residential. Location: The SE %4 of the SW '/4, Section 35, T30N -R19W and the
NW 1 /4 and the N %2 of the SW 1 /4, Section 2, T29N -R19W, Town of St. Joseph.
Richard Beer explained the rezoning request, and went over the information given to the
committee. The parcel is not large enough to provide a person to make a living off of farming it.
The parcel is surrounded on three sides by the Willow River State Park, so there is no room for
expansion for agricultural use. Beer would like to build a home on this property, and his
children have shown interest in building on the parcel, as well. He explained that retirement is in
the near future for he and his wife, and they would like to sell off some of the property for
development. The parcel is surrounded by land zoned ag/residential and conservancy. The
Town of St. Joseph has recommended approval of the request.
Bob Orf and Ted Anderson, neighboring property owners spoke in favor of the rezoning of the
property. There was no opposition to the request.
Teresa Johnson, Chairperson for the Town of St. Joseph, spoke on behalf of the town and stated
that the town strongly feels that this should be rezoned, and the rezoning was approved on a
unanimous vote at the town level.
Fisher went over the staff report, stating that the request is consistent with the County and Town
Plans. The committee reviewed the staff report. Discussion held.
Hearing recessed. Motion by Luckey, seconded by Jensen and carried to approve the rezoning
request to rezone 221 +/- acres of land from Ag to Ag/Residential and forward to County Board
for approval. The approval was based on the following findings:
1. The parcel is in the rural planning area and is an appropriate use.
2. Site consists of farm fields, farm structure and some woods.
3. All but 40 acres of the site is environmental corridor.
4. The environmental features include: 12 -20 percent slopes, proximity to the Willow River
and Willow River State Park, woods and some shorelands and one closed depression.
The Willow River is approximately 500 feet from the southeastern side of the site.
5. There are no limitations for Private Onsite Wastewater Treatment Systems (POWTS).
6. Surrounding land uses include the Willow River State Park on the east, southeast and
west, large acreages to the west and north and small acreage homesites to the northwest
and southwest.
7. Surrounding zoning is ag residential to the north, northeast and southwest and
conservancy to the west, southeast and east.
8. The site is accessed by three county roads, I to the south, A to the east and E which splits
the northern portion of the site. The northern 40 acres of the site also has access to a
town road, Bass Lake road.
9. For the present time, the proposed use is approximately three three -acre home sites.
Retirement planning is the state reason for rezoning.
10. Potential development is approximately 72 three -acre lots.
11. The St. Croix County Natural Resource Management Plan Goals II, III and IV also
encourages protection and preservation of surface waters and wetlands; fish and wildlife
habitats; and agricultural land and soils to preserve ecological functions and recreational
and scenic values and wildlife habitat.
12. The Town of St. Joseph has recommended approval of the rezoning, and has considered
§91.77 in making their recommendation.
13. The Ag Residential zoning designation for 220.76 acres is consistent with the Town of St.
Joseph Comprehensive Plan, dated 1995, amended 2003.
14. The Town motion states that the rezoning does not have an impact on woodlands or
environmental features because no change in use or development is proposed at this time.
The Town further states that the property is suitable for potential development in the
future and potential development would not cause negative impacts to environmental
features or areas. The motion further states that any impacts to environmental areas
would be addressed through the town subdivision ordinance.
15. The Town also states that they have, or intend to provide, adequate public facilities to
accommodate any potential development of the property.
The request will be forwarded to the County Board.
Ted Anderson: The request is to rezone approximately 87 +/- acres of land from Agriculture to
Ag/Residential. Location: The E % of the SW 1 /4, and an access strip of land located in the W % of
the SW 1 /4, Section 24, T30N -R20W, Town of St. Joseph.
Ted Anderson explained his request to the Committee stating that he has no immediate plans for this
property, but may sell for development in the future. His brother -in -law currently farms some of
this property. The land surrounding the property is predominantly ag/residential property. Fisher
had questions about access to the property. Anderson explained that his brother owns the property
where the road easement is located and a town road is there so they have access to the property.
Teresa Johnson spoke on behalf of the town and agreed that the road into the property is a road that
is dedicated to the town. She further stated that the town voted to approve of the rezoning request
on a unanimous vote.
Bob Orf and Richard Beer both indicated that they were in favor of the rezoning request. There was
no opposition to the request.

Plan. The committee reviewed the maps of the property. Discussion held on road access.

approval of the rezoning request for 87 acres to be rezoned from Ag to Ag/Residential, based on the

6. There are two small areas with slight to severe limitations for Private Onsite Wastewater
Treatment Systems (POWTS).
7. Surrounding land uses include a subdivision to the north and southeast, small acreages to
the south and ag or forested land to the east and west.
8. Surrounding zoning is ag residential to the north, east and south and exclusive ag to the
west.
9. Potential development is about 25 three -acre lots.
