Location: The E %z of the NW '/4 and the NW '/a of the NW ' /4, all in Section 19, T30N -R19W, Town of St. Joseph. 2) Robert and Shirley Orf to rezone approximately 190 +/- acres of land from Agriculture to Ag /Residential. Location: The NW ' / 4 of the SW ' / 4, part of the SE '/ of the NW '/4, and the SW '/4 of the NW ' / 4, all in Section 3, T29N- R19W, and the SE '/ of the NW '/4 and the NE '/4 of the NW ' / 4 of Section 35, T30N -R1 9W, Town of St. Joseph. In the case of cancellation of this hearing, such notice will be announced on WIXK and WEVR Radio Stations, or call the Zoning Office at 715 - 386 -4680 before 5:00 p.m. Art Jensen, Chairman Planning, Zoning and Parks Committee MINUTES St. Croix County Planning, Zoning and Parks Committee December 10, 2003 St. Croix County Government Center, Hudson, Wisconsin Committee members present: Supervisors Art Jensen, Veronica Anderson, Jan Zoerb, Linda Luckey and Lois Burri. Staff present: Steve Fisher Chairman Jensen called the meeting to order at 7:00 p.m. A motion was made by Anderson, seconded by Luckey and carried to adopt the agenda. Jensen explained the hearing process and opened the hearing. Fisher read the hearing notice and explained that these requests were previously tabled by the committee in March 2003, as they did not meet the St. Joseph Town Plan. Since that time, the Town of St. Joseph has revised their plan and the applicants are in front of the committee for a decision, based on the revised Town Plan. Gloria Basel: The request is to rezone approximately 114 + /- acres of land from Agriculture to Ag/Residential. Location: The E %2 of the NW %4 and the NW %4 of the NW 1 /4, all in Section 19, T30N -R19W, Town of St. Joseph. Gloria Basel explained the rezoning request saying that the land has been in her family since 1909 and no one is interested in buying the property for farming, and it is not a large enough parcel to make a living in farming. Furthermore, County Road V is very busy and with all the traffic is unsafe for farm machinery to even travel on it. The Town Plan has been revised and now shows this area to be in Ag/Residential, and would be compatible with surrounding uses. She has no immediate plans for development, but she plans on retiring and may sell it in the future. The following landowners spoke in favor of the rezoning: Henry Lentz, Ted Anderson, Bob Orf, Don Roettger and Richard Beer, stating that the property would be compatible with the surrounding uses. Teresa Johnson, Chairperson for the Town of St. Joseph, spoke on behalf of the town and stated that the town feels that this should be rezoned, as it meets all the requirements of the town. There was no opposition to the request. Fisher went over the staff report, stating that the request is consistent with the County and Town Plans. The committee reviewed the staff report. Discussion held. Hearing closed. Motion by Luckey, seconded by Jensen and carried to approve the rezoning request for Gloria Basel to rezone 114 +/- acres of land from Ag to Ag/Residential and forward to County Board for approval. The approval was based on the following findings: I. The parcel is in the rural planning area and is an appropriate use. 2. The whole site is within a primary environmental corridor. 3. Environmental corridor features include wetlands /closed depressions. 4. Surrounding zoning is exclusive ag to the east and ag residential to the north, south and west. 5. The site is located on County Road V, running north and south through the property and abuts town roads to the north and south. 6. Potential development is approximately 38 three -acre home sties. 7. As the owners consider design elements they should be encouraged to: protect the closed depressions and wetlands; use best management practices, erosion and sediment control and stormwater management for the steep slopes; and protect the interior woodland habitat. 8. During design, POWTS should be located so that there is not a conflict with the wetlands, closed depressions and the limiting soils for POWTS. 9. The St. Croix County Natural Resource Management Plan Goals II, III and IV also encourages protection and preservation of surface waters and wetlands; fish and wildlife habitats; and agricultural land and soils to preserve ecological functions and recreational and scenic values and wildlife habitat. 10. The ag/residential zoning designation for 114 acres is consistent with the Town of St. Joseph Comprehensive Plan, dated 1995, and amended 2003. 11. The Town motion states that the rezoning conforms to §91.77 as the Town has adequate public facilities to accommodate any potential development. 12. Town indicated that future implementation of impact fees will generate revenue to offset costs related to public services and facilities needed in the future. 13. Town also indicated that any impacts to environmental areas would be addressed through subdivision Chapter 168 and Comprehensive Plan, both of which promote efficient and desirable use of land. The request will be forwarded to the County Board. Bob Orf: The request is to rezone approximately 190 +/- acres of land from Agriculture to Ag/Residential. Location: The NW 1 /4 of the SW 1 /4, part of the SE 1 /4 of the NW 1 /4, and the SW 1 /4 of the NW 1 /4, all in Section 3, T29N -R19W, and the SE 1 /4 of the NW 1 /4 and the NE 1 /4 of the NW 1 /4 of Section 35, T30N -R19W, Town of St. Joseph. Bob Orf explained his request to the Committee stating that he has no immediate plans for this property, but may sell for development in the future. He has been going through this process to rezone this property for a long time. He reiterated that the Town of St. Joseph has revised the Town Plan and this request now meets that Plan. Richard Beer, Ted Anderson, Gloria Basel, Henry Lentz and Don Roettger all spoke in favor of the request. Teresa Johnson again spoke on behalf of the Town of St. Joseph stating that the Town voted in favor of this rezoning and they believe it meets the Town Plan. There was no opposition to the request. Fisher went over the staff report, stating that the request is consistent with the Town and County Plan. There is an 80 -acre parcel in Section 35, and a 110.9 -acre parcel of land in Section 3. The request is to rezone both parcels to Ag/Residential. The committee reviewed the staff report and maps and a discussion was held. The hearing was closed. Motion by Luckey, seconded by Anderson and carried to recommend approval of the rezoning request for Bob Orf for 80 acres to be rezoned from Ag to Ag/Residential, and forward to County Board for approval. The approval was based on the following findings: 1. The parcel is in the rural planning area and is an appropriate use. 2. Site consists of approximately 35 acres of cropland, 23 acres of woodland in Managed Forest Law program and 22 acres of woods. 3. The whole site is part of an environmental corridor. K 4. Environmental features include: 12 -20 percent slopes, intermittent streams, shorelands, wetlands and adjacent to Noreen Pond. The site is approximately %z mile from Bass Lake. 5. There are no limitations for Private Onsite Wastewater Treatment Systems (POWTS). 6. Surrounding land uses include large open acreages to the south, east and west and small residential tracts of the north. 7. Surrounding zoning is ag residential to the north, south and west and exclusive ag to the east. 8. Potential development is about 25 three -acre lots. 9. The soils on the site are Class II and III under the Soil Classification System of the Natural Resource Conservation Service. 10. The St. Croix County Natural Resource Management Plan Goals II, III and IV also encourages protection and preservation of surface waters and wetlands; fish and wildlife habitats; and agricultural land and soils to preserve ecological functions and recreational and scenic values and wildlife habitat. 11. The Town of St. Joseph has recommended approval of the request and has considered §91.77 in making their decision. 12. The ag residential zoning designation for 80 acres is consistent with the Town of St. Joseph Comprehensive Plan, dated 1995, amended 2003. 13. The Town motion states that the rezoning does not have an impact on woodlands or environmental features because no change in use or development is proposed at this time. The Town further states that the property is suitable for potential development in the future and potential development would not cause negative impacts to environmental features or areas. The motion further states that any impacts to environmental areas would be addressed through the town subdivision ordinance. 14. The Town also states that they have, or intend to provide, adequate public facilities to accommodate any potential development of the property. The request will be forwarded onto County Board. Motion by Jensen, seconded by Luckey and carried to recommend approval of the rezoning request for Bob Orf for 110 +/- acres to be rezoned from Ag to Ag/Residential, and forward to County Board for approval. The approval was based on the following findings: 1. The parcel is in the rural planning area and is an appropriate use. 2. All but eight acres of the site is planted to trees in the Managed Forest Law program according to the applicant. 3. A very small portion of the site is prime farmland. 4. The whole site is part of an environmental corridor. 5. There are no limitations for Private Onsite Wastewater Treatment Systems (POWTS). 6. Surrounding land uses include open recreation land to the south, east and west and a subdivision to the north. 7. Surrounding zoning on the north portion of the site is ag residential to the west, north and on two small sites to the east. Surrounding zoning on the south portion of the site is conservancy to the west, south and east. 8. A town road running east and west between the north and south portions splits the site. 9. Potential development is about 35 three -acre lots. 10. The soils on the site are Class III under the Soil Classification System of the Natural Resource Conservation Service. It should be noted that they are highly erosive due to slopes. 11. The St. Croix County Natural Resource Management Plan Goals II, III and IV also encourages protection and preservation of surface waters and wetlands; fish and wildlife habitats; and agricultural land and soils to preserve ecological functions and recreational and scenic values and wildlife habitat. 12.
