HomeMy WebLinkAboutBoard of Adjustment 06-25-1985BOARD OF ADJUSTMENT MEETING AND HEARINGS June 25, 1985 9:00 a.m. - 5:00 p.m. Meeting called to order by Chairman Stephens at 9:00 a.m. in the County Board Room, Courthouse, Hudson, Wisconsin. All members present. Minutes of the May 28 and June 13 hearings approved as written. Hearing called to order at 10:00 a.m. Chairman Stephens set the rules for the hearing. Zoning Administrator read notice of the hearing as published in the county and local newspapers. 1. ARTICLE: 3.12 5.7, Lottline setback, St. Croix Riverway APPELLANT: A. Sherman Peterson LOCATION: WZ of the SWk of Section 26, T30N-R19W, Town of St. Joseph — 2 - Dr. Khan presented his request for a sideyard setback in the Riverway District explaining his reasons for the request. Mr. Steve Johnson, MN -WI Boundary Area Commission, has no objections if the map is accurate. Mr. Jake Vander Voort, D.N.R., has not seen the site but would like to be there when the Board inspects the property. He feels the same way as Steve Johnson. Mr. Ray Brown, Chairman, Town of St. Joseph, presented their request to fill on Perch Lake Road to make the road usable. They will have to put approximately 18 inches of fill in the water to bring the road six inches above the water. Questions by Board Members. Mr. Jerry Harvieux presented the request of Martin Croes to construct a joint driveway on the property line that would service both the house and a field entrance. At the present time the field entrance is through the yard. Mr. Robert Slaback presented the request of Dairyland Power to construct a substation in the Town of Baldwin. He would also like a 60 foot setback from the Town Road in order to keep the rest of the property as farmable as possible. Kenneth Klanderman, adjoining landowner, informed the Zoning Administrator that he has no objections. Cindy Swanberg, D.N.R., objected to the substation due to the adjoining wetland area and D.N.R. acquiring the property in the future. Mr. Slaback rebutted Mg. Swanberg's remarks. Questions by members of the Board. Mr. Marion De Jong presented his request to have a field access driveway that would be less than 500 feet from an adjoining driveway. At the present time, he has an easement on the adjoining landowner's property and is having some difficulty. Questions by members of the Board. Mr. John Bartlett presented the request of Lois Bartlett to construct a garage that would be less than.133 feet from the centerline of a Town Road. The garage would not be closer to the road than the present house. Mr. Tom Cuper presented his request to construct a house that would be approximately 100 feet from the centerline of a Town Road. He wishes to replace a mobile home at the same location. Mr. Steve Wilcox presented the request of William Williamson to construct a dock, deck and storage area on Bass Lake that would not meet the 75 foot setback area. Questions by Board Members. Mr. Al Nyhagen presented the request of William Mc Kinnon to fill and grade closer than 300 feet of a pond in order to construct a road on his property. The road would be for future development of the property and access to farm land he sold. Mr. Richard Scray appeared in opposition to the request. He would like to have the filling and grading spelled out. Mr. Ray Brown, Town Chairman, objected to constructing a road without township approval. Mr. Fred Hallemek, adjoining landowner, objected to the road construction and fill on the property. Also the amount of trees that would be removed and drainage and erosion problems. Mr. Gerald Licka, adjoining landowner, objected to the road and road separation. - 3 - Mr. Dan Koich, D.N.R., feels that Section 2.3.5 of the St. Croix County Zoning Ordinance requires additional information on the plan and Sedimenta- tion be maintained. He objects to the request of Mr. Mc Kinnon although he has not been on the site. Mr. Nyhagen rebutted the remarks of those objecting. Mrs. Susan Meyers presented their request to install a lift on their property within the St. Croix Riverway District. Mr. Jake Vander Voort, D.N.R., would like to visit the site with the Board. Steve Johnson, MN -WI Boundary Area Commission, informed the Zoning ministrator that he has no objections to the lift. Mr. J. Sherman Peterson presented his request to construct a deck on a home he is constructing that would be approximately 64 feet from Bass Lake. Mrs. Helmet Lutsep objected to the construction of a deck on the house. Questions by members of the Board. Motion by Supervisor Meinke to recess the hearing for inspection of the properties in question. Seconded ty Supervisor Kelly. Motion carried. After inspection of the properties in question, the Board went into closed session to discuss all requests. Board returned to open session to make the following decisions. 1. A. Hamid Khan: Motion by Supervisor Stephens to approve the request of A. Hamid Khan as the construction causes no interference with neighbors or River view. Seconded by Kelly. Motion carried. Vote to approve: Kelly, yes; Meinke, yes; Stephens, yes. 2. Town of St. Joseph: Motion by Supervisor Kelly to approve the request of the Town of St. Joseph as it is necessary to put the public road back in service. Seconded by Supervisor Meinke. Motion carried. Vote to approve: Meinke, yes; Kelly, yes; Stephens, yes. 3. Martin and Florence Croes: Motion by Supervisor Stephens to grant Croes a 300 foot separation for a new field access driveway east of the present driveway. New driveway will meet all state highway codes as to culvert size, etc. Seconded by Supervisor Meinke. Motion carried. Vote to approve: Meinke, yes; Kelly, yes; Stephens, yes. 4. Dairyland Power: Motion by Supervisor Meinke to approve the request of Dairyland Power for a substation with a 100 foot setback from a Town Road. The substation is necessary to serve the community. Seconded by Supervisor Stephens. Motion carried. Vote to approve: Meinke, yes; Kelly, yes; Stephens, yes. 5. Marion De Jong: Motion by Supervisor Kelly to approve the request of Marion De Jong to have a field access driveway 150 feet from the drive- way to the east. Culverts and driveway specifications to be set by State Highway Department regulations. Driveway is necessary for access to fields with machinery. Seconded by Supervisor Meinke. Motion carried. Vote to approve: Meinke, yes; Kelly, yes; Stephens, yes. 64 Lois A. Bartlett: Motion by Supervisor Stephens to approve the request of Lois Bartlett to construct a garage in line with their present home. New structure will not cause a traffic hazard. Seconded by Super- visor Kelly. Motion to approve: Meinke, yes; Kelly, yes; Stephens, yes. 7. Tom Cuper: Motion by Supervisor Meinke to approve the request of Tom Cuper to construct a house on the same location as the present mobile home. The new structure will not cause a traffic hazard and the well is located near the present mobile home. Seconded by Supervisor Kelly. Motion carried. Vote to approve: Meinke, yes; Stephens, yes; Kelly, yes. 8. William Williamson: Motion by Supervisor Stephens to approve the request of William Williamson as the dock and deck setback will not cause any interference with the neighbors or environment. Seconded by Supervisor Meinke. Motion carried. Vote to approve: Meinke, yes; Kelly, yes; Stephens, yes. - 4 - 9. William Mc Kinnon: Motion by Supervisor Kelly to approve the request of William Mc Kinnon as no significant environmental damage would occur to either pond in question. Seconded by Supervisor Meinke. Motion carried. Vote to approve: Meinke, yes; Kelly, yes; Stephens, yes. 10. Joseph and Susan Meyers: Motion by Supervisor Kelly to approve the request of Joseph Meyers as the lift will not cause any site or erosion problems. Seconded by Supervisor Stephens. Motion carried. Vote to approve: Meinke, yes; Kelly, yes; Stephens, yes. 11. J. Sherman Peterson: Motion by Supervisor Stephens to approve the request of J. Sherman Peterson to construct a deck as there is no alternate location for it. Putting the deck in another area would destroy two trees. The site for deck granted causes no significant view or environmental intrusion. Seconded by Supervisor Meinke. Motion carried. Vote:to approve; Meinke, yes; Kelly, yes; Stephens, yes.
