Planning and Development Committee
June 7, 1993

Present: Chairman Tom Dorsey, Supervisor Bill Oemichen, Linda
Luckey, Bob Boche and George Menter.
Staff present included Mary Jenkins, Tom Nelson and Dave
Fodroczi.
Guests in attendance were Supervisor Jerry Neumann,
Muriel Olsen, Larry Anderson, Dennis Anderson, and
several owners of land adjoining or near the Olsen
property.
The meeting was called to order by Chairman Tom Dorsey at 7:30 p.m.
The hearing for Muriel Olsen, Town of Somerset, was re -opened. Ms.
Olsen is requesting a special exception use to allow the creation
of a minor subdivision within the Riverway District. Chairman
Dorsey explained to those present that at the May 25 meeting of the
Planning and Development Committee, a decision on the request was
postponed until this date to allow committee members to view the
property. Dorsey stated that all members visited the site earlier
in the evening, and that viewing the property and hearing from the
Somerset Town Board are the only two issues that are being
addressed tonight.
Supervisor Jerry Neumann, speaking for the Somerset Town Board,
stated that the proposed accesses for Lot 2 and Lot 4 meet all
driveway criteria, and that the Town Board concluded that the
safest location for the driveways is where they are currently
staked. Audience member Dennis Anderson referred the Committee to
17.64(5)(3) of the Zoning Ordinance which states "A minimum
distance of 200' spacing between access driveways and the
centerline of an intersecting highway". He questioned the location
of the driveway for Lot 4 due to Maple Hill Road. However, Maple
Hill Road does not cross Anderson Scout Camp; it comes to a "T"
intersection. Staff stated that the ordinance has always been
interpreted such that only a driveway on the same side of Anderson
Scout Camp Road as Maple Hill would need to be 200' away from the
centerline of Maple Hill Road. Chairman Dorsey called for a motion
to close the hearing. Motion by Supervisor boche, seconded by
Supervisor Luckey to close the hearing —Motion carried. Decision:
Motion by Boche, second by Menter to grant the special exception
use to create a minor subdivision within the Riverway District with
the driveways placed at the location proposed by Ms. Olsen, and
recommended by the Somerset Town Board. It was agreed by committee
that due to the curve on Twin Springs Road, visibility is more
restricted there than on Scout Camp Road.
Roll call vote: Menter, yes; Boche, yes; Luckey, yes; Oemichen,
yes; Dorsey, yes -Motion carried.
Jenkins then presented the certified survey map for Muriel Olsen,
creating three lots of 10.01 acres, located at G.L. 3, Sec. 14,
T30N-R20W, Town of Somerset. Motion by Supervisor Oemichen, second
by Supervisor Boche to conditionally approve the map with the
conditions being that the surveyor show the previously recorded
distance on north line, lot 2; that both road names be underscored,
and the tangent bearing at 4, the; should be '.-Motion carried.
INDUSTRIAL ZONING DISTRICT
Fodroczi reported that he has requested zoning ordinances from
eight urban/suburban counties throughout the state. So far, four
have been received. Discussion on performance ordinances and
standards.
ADULT ENTERTAINMENT ORDINANCE
The Committee reviewed study materials on adult entertainment
ordinances and case law which Fodroczi received from the Planners
Advisory Service. Motion made by Oemichen, seconded by Luckey to
conduct a study similar to the New Hanover County Study to be ready
for the July Committee meeting -Motion carried.
Chairman Dorsey adjourned the meeting at 9:40 p.m.
