HomeMy WebLinkAboutPlanning & Development Committee 09-30-1993MINUTES PLANNING & DEVELOPMENT COMMITTEE SEPTEMBER 30, 1993 PRESENT: Chairperson Tom Dorsey; Supervisors Robert Boche, Linda Luckey, and George Menter. Bill Oemichen arrived at 12:10 p.m. Staff present included Dave Fodroczi, Planning Director, Ellen Denzer, Planner, Tom Nelson, Zoning Administrator, Michelle Judge, Recording Secretary, Joe Grant, Parks Department, Brian Halling, Surveyor Technician, and Greg Timmerman, Corporation Counsel. County Surveyor Jim Rusch was also present. Other guests included Jim Weber, Laurence Murphy, Allen Nyhagen, Sally Giese, James McNamara, Jerry Chasteen, and Don Kush. Chairperson Dorsey called the meeting to order at 9:15 a.m. Motion by Menter, seconded by Boche to adopt the agenda. Motion carried. Motions by Boche, seconded by Menter to adopt minutes of June 7, July 19, August 19 and September 7. Motions carried. Joe Grant recommended that wording on page 2 of the August 24 minutes, "He further noted...", was incorrect and should be deleted. Motion by Boche, seconded by Menter to adopt the August 24 minutes with the suggested deletion. Motion carried. Action on August 31 minutes was deferred. The next committee meeting date is scheduled for October 22, 1993. PARK BUSINESS Bills and Invoices Motion by Boche, seconded by Luckey to approve the park bills. Motion carried. Crane Town Store Rivard purchased the property for $1 but a condition of the sale was that the property would be available to the public. Rivard is talking about moving it and changing its appearance. Luckey questions legal problems in restricting the public. Grant states that the County should have a say in how the building is used. If the County were to buy it back, the costs could run $15,000+ for repairs and improvements. The committee decided to look at this issue again next month. Park Manager's Report FEMA grant will pay for flood repairs at Troy Park. Bremmer will haul in sand and hopes to be finished by December. St. Croix Tree Service has already cleaned up debris. 1 The ISTEA program application was not approved for the Woodville Trail. Fedderly sent a copy of the denial letter to Grant. Grant states he would like to investigate options with an engineering firm in Ellsworth. Grant stated that watershed maintenance work has been done. Staff needs to tear out a beaver dam on structure #8. MINOR SUBDIVISIONS As presented by Brian Halling: 1. Eugene Zimmerman NE%, NWl/, and NW%, NEl/, Sec. 26, T29N-R16W, Town of Baldwin 1 lot - 16.52 Acres, Original - 80 Acres + STAFF RECOMMENDATION: Conditional approval subject to rezoning; Soil test; Map changes (sheet 1 and 2 drafted by different people) ; In the description, along the south line of the NE -NW, the distance (276.571) was left out; the word "recorded" is misspelled in line 24; Acreage should be 16.52 in the description. Postponed to the October meeting. The parcel needs to be rezoned. 15. The road must be dedicated to the public. Motion by Boche, seconded by Menter to conditionally approve. Motion carried. 16. Robert A. and Robert M. Racich Gov't Lot 1, Sec. 25,T28N-R20W, Town of Troy 1 lot - .518 Acres, Original - 137 Acres + STAFF RECOMMENDATION: Conditional approval subject to adding the R( ) in the legend; The word government is misspelled in line 6 of the description. No action taken. Greg Timmerman, Corporation Counsel, was present to discuss the issues. The subdividers wish to purchase this land in order to build a road to access nine homes in the Riverway District. Construction of the road would involve filling and grading on slopes in excess of 12o and this is not allowed. The Planning and Development Committee would need to determine M whether or not a variance could be granted. A hearing would also have to be held for land division in the Riverway District. The Committee suggested that the subdividers resolve the slope issues with the Planning and Development Committee. 17. John English NE1/, NE%, Sec. 8,T31N-R19W, Town of Somerset 2 lots - 20.14 Acres, Original - 20.14 Acres STAFF RECOMMENDATION: Conditional approval subject to soil test; Fees to be paid; On map, "ETC" on general notice statement is misspelled; change bearing on south line lot 1 to N89o2513911E to make it close; lot 1 total acreage should be 3.344. Motion by Boche, seconded by Menter to conditionally approve. Motion carried. 18. Halleen Farms NE%, NE%, and SEl/, NEl/, Sec. 2 8 , T31N-R17W, Town of Stanton 1 lot - 10.00 Acres, Original - 80 Acres; Farm consolidation STAFF RECOMMENDATION: Conditional approval subject to soil test; General notice statement; Additional fee ($100 escrow) to be paid. Motion by Boche, seconded by Menter to conditionally approve. Motion carried. MAJOR SUBDIVISIONS As presented by Tom Nelson: Country Meadows First Addition - Surveyor Carl Hatfield requested final approval. A motion was made (Boche, Menter) and passed to approve with the following condition: 10% of the erosion control escrow monies are to be retained for one year. Sunridge - Nelson recommends one year extension for design continuation. Drainage ditch would remain stable for one year. Oemichen made motion to approve, seconded by Menter. Motion carried. ZONING BUSINESS Ordinance Amendment, Town of Hudson Nelson presented an ordinance amendment from the Town of Hudson regarding mini -storage, which is a non -conforming use. Motion by Luckey, seconded by Boche to recommend to the County Board that this amendment be approved. Motion carried. 5 Ordinance Amendment, More Than Two Residences in Ag District Nelson presented the proposed language for an ordinance amendment for more than two dwellings on a property as a special exception. On memo, change #2 to say "size of parcel should be considered when reviewing application." Remove "Child or spouse" in #1. Change #1 to say, " earns at least 500-. of his/her gross annual income." In standard #3 change the word "residence" to "residences." Motion by Menter to hold public hearing on October 22 at 11:00 a.m., seconded by Oemichen. Motion carried. Adult Entertainment Ordinance Committee and staff discussed comments from public hearing, including written comments from Corporation Counsel Timmerman. Timmerman was concerned about inconsistency in setbacks, i.e. 650 feet in Ag-residential; 2,000 feet in Ag and Ag-2. Courts have upheld 1,000 foot setbacks for residential districts. Oemichen commented that cases have principally dealt with urban areas and we have adjusted for rural densities. Fodroczi stated concern that setbacks from establishments serving alcoholic beverages do not have a clear court precedent. Oemichen made a motion, seconded by Luckey to change 650 the residential setback from 650 feet to 1,000 feet; change the 2,000 feet setback to 1,500 feet in Ag and Ag-2; add playground and library to the 2,000 foot setback provision; and add a setback of 500 feet from establishments serving alcoholic beverages. Safety issues should be considered. Motion carried. Committee will present the study and proposed ordinance to the County Board for adoption at the October 19th meeting. Committee broke for lunch at 1:15 p.m. and reconvened at 2:00 p.m. George Menter returned at 2:25 p.m. Request for Park Money Release, Towns of Hudson and Pleasant Valley Sally Geise presented a request from the Town of Hudson for $26, 350 for park costs. Boche made a motion to release funds as actual bills are submitted, seconded by Menter. Motion carried. Nelson presented a request for park funds from the Town of Pleasant Valley in the amount of $1,521 for the purchase of swings for the park at the Town Hall. Motion by Oemichen to approve the release, seconded by Boche. Motion carried. Any Other Business Motion by Boche, seconded by Menter to approve Nelson conference attendance (October 27-29). Motion carried. 0 Bills and Invoices Motion by Menter, seconded by Boche to approve Zoning bills. Motion carried. Rezonements Lemire - rezone from Ag-residential to Commercial. Set public hearing in Town of Star Prairie for November 1, 1993. 7:30 p.m. viewing, 8:00 p.m. hearing. Holman - rezone from Ag to Commercial. Set public hearing in Town of Rush River for November 17, 1993. 7:30 p.m. viewing, 8:00 p.m. hearing. Town of Warren Zoning Ordinance The Town of Warren sent copies of their recently adopted zoning ordinance and land use plan. Discussion. A motion was made (Oemichen, Menter) and passed to have Tom Nelson send a letter to the Town of Warren asking if they wish to withdraw from County zoning. Town of Troy Riverway Oemichen discussed the controversy in the St. Croix Cove area regarding alleged violations of the Riverway Ordinance and asked to have a closed session meeting regarding St. Croix Riverway District issues in the Town of Troy scheduled for October 11 at 7:00 p.m. The closed session will be held to discuss potential county liability issues and will reconvene into open session after. He also that the meeting to include Greg Timmerman. 1994 BUDGET Fodroczi distributed a list of budget cuts made by the Finance Committee on September 27 and 28 and a draft of the Committee minutes from those meetings. He also presented and reviewed a summary of budget cuts by committee. Although Planning & Development Committee budgets make up less than 30 of County budget, over 50915 of the proposed budget cuts came from the Committee's budgets. Discussion. Jerry Chasteen from West Central Wisconsin Regional Planning expressed his concern to the Committee about the proposed removal of funds for regional planning. He reviewed a list of projects that the commission has recently completed in St. Croix County. The Committee learned that if the County does not pay its dues, the villages, towns, etc. cannot receive services from Regional Planning even if the villages, towns, etc. paid for the services themselves. Discussion. VA Budget discussion to be put on agendas for October 11 and 22 meetings. PLANNING BUSINESS 35/64 Corridor Planning Don Kush from West Central Wisconsin Regional Planning Commission reviewed current planning for the 35/64 corridor from Houlton to New Richmond. He explained several land use implications of alternative designs of the highway as an "expressway" and as a "freeway". Fodroczi explained that the Highway Committee had reviewed a similar presentation from WisDOT officials. He distributed a letter from the Highway Committee supporting the "freeway" design for the facility. Discussion. Oemichen suggested further discussion at the next regular Committee meeting on October 22 with representatives from the Highway Committee invited. Bills and Invoices Menter made a motion to approve bills for Planning, seconded by Oemichen. Motion carried. GIS/LIS Annual Conference Fodroczi explained that this was a national conference with several technical workshops to be held in Minneapolis on November 1-4. He requested authorization to attend the conference and up to two workshop registrations for other staff from Land Records training funds. Oemichen made a motion to approve Fodroczi conference and two additional workshops, seconded by Menter. Motion carried. Chairperson Dorsey adjourned the meeting at 5:30 p.m. Committee agreed to carry unfinished business to a special meeting at 7:00 p.m. on October llth at the Government Center.
