APPROVAL OF MINUTES Board of Adjustment Regular Meeting March 22, 2018 8:30 AM RESULT: ACCEPTED Board of Adjustment Special Meeting April 12, 2018 1:00 PM RESULT: ACCEPTED PUBLIC HEARINGS 1. Request for Conditional Use Permit - Town of Emerald - Mathy Construction 2. Request for Conditional Use Permit - Town of Somerset - Brand Buggy LLC 3. Request for Conditional Use Permit - Town of Troy - Walsh SITE VISITS BUSINESS ITEMS 1. Conditional Use Permit - Town of Emerald - Mathy Construction - renewal for a non-metallic mining operation, pursuant to Section 17.15 (6) (g) of the St Croix County Zoning Ordinance Borrell presented. Candy Anderson with Milestone Materials took the stand. Quarry has been in operation since 1948. Kaitlyn Filkins new employee at Milestone working with Candy. Kent Olstvag - area manager. Renew for 5 years. No need for site visit. MOTION: To approve as presented. RESULT: APPROVED \[UNANIMOUS\] MOVER: David Peterson, Vice Chair SECONDER: James Nelson, Citizen AYES: Buck Malick, David Peterson, David Niccum, James Nelson, Edward Sontag 2. Conditional Use Permit - Town of Somerset - Brand Buggy LLC - To operate a Motor Vehicle Dealership pursuant to Section 17.18 (9) (h) of the St. Croix County Zoning Ordinance. Grabau presented. Conflict between what was presented to the Town of Somerset and what was on the CUP application - where for sale cars will be located and paving if they are behind fence. Additional photos of this property taken 6/27/18 were shown. Peterson questioned paving and was assured by staff that the ordinance is not ambiguous. Nelson questions condition 4 as to number of cars at any one time for sale. Malick questions paving and its effect on water run off. Steve Olson comments on this for the Board. Patrick Flandrick takes the stand. He is co-owner of Brand Buggy LLC. Facility is locked at night. No salvage titles. Recess at 9:19am. Paving to be completed by November 15, 2018. Hearing closed at 11:54 am. MOTION: To approve the Conditional Use Permit as Amended to include a limit of 10 cars and paving of the area not later than November 15, 2018 used for selling cars behind the fenced area. Conditional Use Permit - Town of Troy - Walsh - Filling and grading within 40 feet of the slope preservation zone (17.36 F.3.a.5)) and filling and grading 10,000 square feet or more outside of the slope preservation zone (17.36 F.3.a.6)). Borrell presented. There is an error on staff report - states Town of St Joseph should be Town of Troy. Jim Walsh spoke of the lines on the map and the intent to restore a traditional farm home to the property. Jan Kucia Town of Troy spoke on drainage. Recess at 9:59 am for site visits. 11:46 returned from site visits. Closed hearing at 11:47am. MOTION: To approve the Conditional Use Permit as staff has presented it.
