BUSINESS ITEMS

Scott Cox, Corporation Counsel, summarized the Circuit Court's Decision in this matter.
RESULT: DISCUSSED
2. Determination of procedures to be utilized regarding remand to the Board of
Adjustment of Calda Donna's application for Variances
We have four Variances and one Conditional Use Request to consider. Joe Miller, BOA
alternate citizen member was in the audience during the hearings in 2016. Mr. Miller will
sit on this board during these proceedings in the absence of Mr. Malick. Mr. Cox handed
out to the board five options of how to proceed and a model worksheet to use while
reviewing this case.
Motion To adopt Option A. The board is to consider only the record of the 2016
proceeding, no public hearing will be held. Staff will be present to answer questions and
Corporation Counsel will be there for advice. Each member to receive a copy, either
written or paper, of the 2016 hearing transcripts and exhibits.
